provisions of either of said sections hereby repealed. But the samo shall remain as valid and effectual, for that purpose, as if this act had not been passed.

Sec. 2. There shall be three commissioner3 clected by joint ballot of the Council and House of Represeutatires, on Friday, the eighth day of Mirch, A. D. 13:37, at 12 o'clock, M., who shall hold their offices until the termination of the next regular annual session of the Legi-latire Assembly, and until another election shall be had, who shall be styled Cummissioners of Public Buildings, and an election shall be inade at each regular annual session of the Lrgislative Assembly, by the Council and House of Representatives in joint baļlot, of commissioners of public buildings, and said commi-sioner3 so elected shall hold their offices until the termina. tion of the nest regular annual session of the Legislative Assembly after their election.

Sec. 3. It shall be the duty of the commissioners appointed under the law to which thi;i; in addition, immediately to settle their accounts with the commissioners who shall be appointed in pur<u• ance of the provisions of this act, according to justice and equity, and to pay cver 10 them all monies or evidences of debt in their . hands, or in the hands of either of them, and all books, accounts, and papers of every description relating to their office or the discharge of their official duties; and if said commissioners appointcd under the act to which this is in addition, or either of them, shall neglect or refuse to comply with the requirements of this act or any of them, it shall be the duty of the commissioners appointed in pursuance of the provisions of this act, to cause suit to be instituted against them in the name of the Territory, to compel the performance of the duties herein required of them, and to that end the proper courts shall be authorized to issue writs of injunction, mandarnus, or such other writ as may be necessary:

Sec. 4. It shall be the duty of the commissioners of public buildings, to cause the public buildings at the Town of Madison, which have been commenced, to be completed and finished accor. ding to the contract with James Morrison, in a suitable manner for the convenient occupation of them by the Legislative Assembly; said commissioners shall elect one of their number treasurer, whose duty it shall be to receive, keep, and at proper times disburse all monies or other evidences of debt which shall come to the hands of said commissioners, and to draw from the treasury of the United States, such sum or sums of money which have been or may here. after be appropriated by congress towards the erection of public buildings for the use of said Territory, and shall pay the same on

contracts made for the construction of the work at such times as may be directed by a majority of the board on the certificate of the acting commissioner, that the work has been constructed and performed according to any such contract, and that the same is justly due thereon. The said commissioners before they enter upon the discharge of the duties of their office, shall execute bonds Commissioners

to give bondo. to the Territory, with two or more sufficient sureties, to be approved by the Governor of the Territory, in the penal sum of forty thousand dollars, conditioned for the faithful performance of the dutes of their office and that they will annually render to the Legislative Assembly a true account of all monies received and paid out by them. And they shall agree upon one of their number 4cm to be acting commissioner, whose duty it shall be to superintend in duties: person, the erection and completion of said buildings; and the said acting commissioner shall have power at all times when he may think proper, to call the board of commissioners together for the purpose of transacting any business relative to their duties. It shall be the duty of the acting commissioner to prepare and file with the Governor, quarterly, a statement of their doings during the quarter next preceding the filing of such statement, sworn and subscribed by him, and to submit to the Legislative Assembly, at every session of the same, a statement subscribed and sworn to by them, of all their procedings.

Sec. 5. The commissioners elected under this act shall allow and pay to A. A. Bird, the acting commissiorier, five dollars per A. A. Bird, his day for each day actually employed and to the other commissioners compensation.es

procured. by the Council and House of Representatives, and for the rooms to be occupied by the supreme Court, and the Executive of the Territory, and the Committee rooms; and they are hereby authorised to appropriate any unexpended balance of monies which may remain in their hands after the completion of the Capitol, to defray the expense of procuring such furniture.

Sec. 8. This act shall take effect from and after its passage.

AN ACT to establish certain towns in the counties of Milwaukee, Brown,

Racine, and Walworth, and the counties thereunto attached for judicial purposes, and to provide for the election of certain officers therein.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin,

Section 1. That the towns as hereinafter described, shall be, The following and the same are hereby set off and established within the counties towns established.

to wit: beginning on the shore of Lake Michigan, at the south Lako

east corner of Milwaukee county ; thence west to the south-west corner of town five north, range twenty-two east; thence north to the north-west corner of town six north, range twenty-two east; thence east to the shore of Lake Michigan; thence southerly along the shore of said lake, to the place of beginning; be; and the same is hereby set off into a separate town by the name of Lake.

Sec. 3. That the country included within the following limits,

to wit: beginning at the south-east corner of town five north, of Klanikennick. range twenty-one east ; thence west to the south-west corner of

town five north, of range twenty-one east; thence north to the north-west: corner of town six north, of range twenty-one east; thence east to the north-east corner of town six north, range twenty-one east; thence south to the place of beginning; be, and the same is hereby set off into a separate town by the name of Kinnikennick.

Sec. 4. That the country included within the following limits, to wit: beginning on the shore of Lake Michigan, at the south-east corner of township seven north, of range twenty-two east; thence west to the south-west corner of town seven north, of range twenty-one east; thence north to the north-west corner of town eight north, of range twenty-one east; thence east to Lake Michigan; thence southerly along the shore of said lake, to the place of beginning; be, and the same is hereby set off into a separate town by the name of Milwaukee.

Sec. 5. "That the country included within township five north, of range [of] nineteen east, be, and the same is hereby set off into a separate town by the name of Vernon.

Sec. 8. That the country included within the following limits, to wit: beginning at the south east corner of town eight north of range twenty east, thence west to the south-west corner of town eight north of range nineteen east, thence north to the north-west corner of town eight norih of range nineteen east, thence east to the north-east corner of town eight nách range zwenty east, thence south to the place of beginning; be and the same is hereby set off into a separate town by the name of Lisbon.

SEC. 9. That township five north of range eighteen east, be set off into a separate town by the name of Mequanego.

That the country included within the following limits, to wit: beginning at the south east corner of town seven, north, of range twenty east; thence west to the south west corner of town seven north of range nineteen east; thence north to the north-west corner of town seven north of range nineteen east; thence east to the north east corner of town seven north of range twenty east; thence south, to the place of beginning; be and is hereby set off into a separate town by the name of Brookfield.

That the country included within the following limits, co wit: beginning at the south east corner of town five north, of range seventeen east; thence west to the south-west corner of Ganesoo. town five north of range seventeen east; thence north to the northwest corner of town six north of range seveneteen east; thence east to the north east corner of town six north of range eighteen east; thence south to the south-east corner of town six north range eighteen east; thence west to south-west corner of town six north range eighteen east; thence south to the place of beginning; be and the same is hereby set off into a separate town by the name of Genesee.

Sec! 12. That the country included within the following limits, to wit: beginning at the south east-corner of town seven north of range eighteen east; thence west to the south-west corner of town

Sec. 13. That all the country included within the bounds of the county of Washington, shall be, and the same is hereby set off into a separate town by the name of Washington.

Sec. 14. That all the country included within the bounds of the county of Dodge, shall be, and the same is hereby set off into a separate town by the name of Dodge.

Sec. 15. That the country included within the following limits, to wit: beginning at the south-east corner of town five north, of range sixteen east, thence west to the south west corner of town five north, of range fifteen east, thence north to the north-west corner of town six north, of range fifteen east, thence east to the north-east corner of town six north, of range sixteen east; thence south to the place of beginning, and all within said bounds, sba!! be a town by the name of Bark River.

Sec. 16. That the country included within the following limits, to wit: beginning at the south-east corner of town five north, of, range fourteen east, thence west to the south-west corner of town five north, of range thirteen east, thence north to the north-west corner of town five north, of range thirteen east, thence east to the north-east corner of town five north, of range fourteen east, thence south to the place of beginning, be, and is hereby set off into a separate town by the name of Finch.

Sec. 17. That the country included within the following limits, to wit: beginning at the south-east corner of town six north, of range fourteen east, thence west to the south-west corner of town six north, of range thirteen east, thence north 10 the north-west corner of town seven north, of range thirteen east, thence east to the north-east corner of town seven north, of range fourteen east, thence south to the place of beginning ; be, and is hereby set off into a separate town by the name of Jefferson.

Sec. 18.
