NO. 5.

Resolution appointing a special messenger to procure the laws of the last annual session of the Legislature.

Be it resolved by the Council and House of Representatives, That William B. Long, be appointed special messenger to proceed forthwith to the town of Burlington, in the Territory of Iowa, and procure for the use of this Territory such number of copies of the laws of the last session as may be the due proportion belonging to the Territory of Wisconsin, and that he shall receive for the service such compensation in addition to his expenses, as may hereafter be allowed by the Legislature.

Approved, December 6, 1838.

NO. 6.

A resolution to appoint a fiscal agent of the Legislative Assembly.

Be it resolved by the Council and House of Representatives, That Moses M. Strong Esq. be and hereby is appointed fiscal agent of the Legislative Assembly, to hold said appointment during the pleasure of the Legislature, and as such agent is hereby authorized to adjust all accounts for any monies appropriated by law to defray the expenses of the present session of said Legislative Assembly; provided, he gives a bond as hereinafter mentioned, with two or more sufficient sureties, and to receive the amount thereof from the Secretary of the Territory out of such sums as have been or may hereafter be appropriated by Congress, for the payment of the expenses of the present session of the Legislature of Wisconsin.

Resolved further, That the said fiscal agent be and hereby is authorized to borrow in gold and silver or the notes of the bank of Illinois or its branches, or the notes of the bank of Missouri, for the use of the legislature, fifteen thousand dollars, at a rate of interest not exceeding seven per cent, for the re-payment of which, at such time as may be stipulated, the faith of the Territory is hereby pledged.

Resolved, further, That the said fiscal agent shall execute a bond to the Governor, for the use of the Territory, in the sum of twenty-five thousand dollars, conditioned for the faithful application

of all monies which may come to his hands, to such purposes as may be directed by law.

NO. 7.

A resolution to authorize the District Attorney of the United States for the Territory of Wisconsin, to examine the title to the ground on which the Capitol stands.

Resolved by the Council and House of Representatives, That the District Attorney of the United States for the Territory of Wisconsin, be requested to examine and report to the Legislative Assembly as soon as practicable, whether the said Territory has a title to the ground on which the Capitol thereof stands; and if not, in whom the title thereof is; together with such other facts in rela⚫ tion thereto, as to him may seem expedient.

NO. S.

A preamble and resolution to terminate the present session, and to fix the time for commencing the annual session of the Legislative Assembly for 1839.

Whereas, in consequence of the contemplated appointment of joint committees of the Legislature, consisting of two from the Council, and four from the House of Representatives, to visit in person and examine the different banks in this Territory, and in consequence also of the appointment of a joint committee of three from each House, to select, arrange and revise the laws, which said committees consisting in the aggregate of five members from the upper and seven from the lower branch, must necessarily, in order to the proper performance of their duties, be absent from the sessions of the Assembly for some weeks, therefore,

Resolved, (if the House of Representatives concur,) That it is expedient and proper, in consequence of the necessary absence of twelve members of both branches, on committees, for the Legislative Assembly to adjourn, until those committees shall have time to perform the duties, or a part of the duties allotted to them, and resume their places in the Representative Hall, to attend to the immediate interests of their constituents.

Resolved, (if the House of Representatives concur,) that the Legislative Assembly terminate its session for the year eighteen hundred and thirty-eight, on Saturday the twenty second instant; and that the annual session of the Assembly for eighteen hundred and thirty-nine shall commence at this place on the twenty-first day of January next.

Resolved further, (if the House of Representatives concur,) that the joint committees appointed by the Legislative Assembly, to revise the laws, and to examine the condition of the banks, be empowered to proceed to the performance of their duties during the vacation and to report at the next session.

NO. 9.

A preamble and resolutions concerning surveys to be made of a portion of the Public Lands north of the Wisconsin and Fox, and east of the Mississippi Rivers.

Whereas the country recently purchased from the Winnebagoes, is rapidly settling with a respectable and meritorious class of citizens, who are opening farms and making improvements of various kinds which must necessarily be subject to be divided and oth erwise injuriously effected by the lines of the Public Surveys, thereby occasioning much loss, and ground for difficulties of a serious character to the pioneers of this new country; Therefore,

Resolved, That our Delegate to Congress be requested to use his influence to obtain an immediate survey of the Public Lands north of the Wisconsin and Fox, and east of the Mississippi Rivers. Resolved, That the Governor be requested to forward one copy of the foregoing preamble and resolution to the commissioner of the General Land office, and one copy to our Delegate in Congress. Approved December 19, 1838.

NO. 10.

Resolutions to provide for publishing the Laws and Journals of the present session of the Legislative Assembly.

Resolved, (if the House of Representatives concur,) that the Laws passed at the present session of the Legislative Assembly

be published in the following newspapers, to wit, Wisconsin Enquirer, Miner's Free Press, Milwaukee Sentinel and Milwaukee Advertiser ; and the publishers of the respective papers above named be allowed such reasonable compensation therefor as may have been heretofore allowed for similar services.

Resolved, further, (if the House of Representatives concur,) that the Secretary of the Territory furnish a copy of said laws for the Wisconsin Enquirer immediately after their passage, and that the other papers named in the first resolution, may take copies thereof from said Enquirer, provided that each of said papers shall publish at least two columns of said laws per week until the whole may be completed.

Resolved, further, (if the House of Representatives concur,) that J. A. Noonan be and hereby is appointed to print two hundred copies of the Journal of the present session of the Legislative Assembly, and that he shall stitch and cover the said Journals and deliver the same to the Secretary of the Territory for distribution, and that he shall be allowed therefor the like compensation as may have been heretofore allowed for similar services, and that the said J. A. Noonan shall enter into a bond in the penal sum of five thousand dollars with two sufficient sureties to be approved of by the Governor of the Territory, conditioned for the faithful performance of the printing and duties to be performed by him as aforesaid. Approved, December 22, 1838.

NO. 11.

A preamble and resolution in relation to the contract for printing entered into with James G. Edwards, at the last session of the Legislative Assembly.

Whereas, James G. Edwards, on the 30th day of June last, entered into a contract with the Legislative Assembly of this Territory, for the printing and binding of the laws passed at the sessions of 1836, 1837 and 1838, together with certain other laws selected from those then in force, by a resolution of the Legislative Assembly, and whereas the said James G. Edwards has failed to comply in full with the condition of said contract. Therefore

Resolved by the Council and House of Representatives, That the said James G. Edwards be directed not to proceed any further with the printing or binding of said laws, and that whenever within two months, he shall deliver to the agent of this Territory, the

sheets already printed, he shall be paid such a compensation therefor as the Legislature may deem just and reasonable. Approved, December 22, 1838.

NO. 12.

Resolutions calling on the Secretary of the United States Treasury for certain statements therein mentioned, and for other purposes.

Resolved by the Council and House of Representatives of the Territory of Wisconsin, That the Secretary of the Treasury of the United States be requested to furnish this Legislative Assembly, with an abstract of all sums paid out of the contingent fund for the expenses thereof, showing by whom, and to whom paid, and the amount paid, and also to furnish a statement of the several sums appropriated by Congress therefor, the amount thereof received, and the amount for the present year yet unexpended or unaccounted for.

Resolved, That the Delegate in Congress for the Territory of Wisconsin, be requested to call on the Secretary of the Treasury of the United States, and procure an abstract, as requested in the above resolution.

NO. 13.

A resolution requesting the Secretary of the Territory to forward copies of memorials to Congress.

Resolved by the Council and House of Representatives, That the Secretary of the Territory be requested to forward with as little delay as possible to the Delegate in Congress from this Territory, two copies of the several memorials passed by the Legislature at the present session.
