tions have been conducted with distinguished ability, and the committee have no hesitation in saying that they are entitled' to the confidence of the public.

Since the period has passed, required by law, for the Banks of this territory to make their annual statements to the executive, to be by him submitted to the Legislative Council, wo new Banking institutions have commenced operations, (viz :) the Southern Life Insurance and Trust Company, located at St. Augustine, and the Commercial Bank of Florida, at Appalachicola. The concee have every reason to believe that those institutions have commenced operations upon a solid basis, and from the high characters of the individuals who have the management of them, it is confidentially expected that they will have a tendency to increase the money facilities of the country, and preserve a healthy and sound circulating medium.

The committee have understood that since the commencement of the present session, the Farmers Bank of Florida," intended by its charter to be located at Marianna in Jackson county, has gone into operation, or rather that it has notes in circalation: whether the Bank has complied with the requisitions of its charter, the committee cannot learn. Although dilige: t inquiry has been made, the committee cannot discover that the officers and directors reside within the Territory of Foida, or that even the office of the institution is within Jack son county, on the contrary they understand from different sources imited to consideration, that the whole operations of the Bank are conducted in Georgia, and that the officers and dircctors reside some where in the vicinity of Macon, in that State. The committee cannot think that it is right and proper that the corporate franchises of the institution should be exer. cised in that manner, and they deem it but an act of duty to the people of Florida, and the adjoining States to advise them to be ware of the notes of the Bank. The committee recommead that legal steps be forthwith taken to compel a forfeture and surrender of the charter, and for that purpose propose the adoption of the accompanying resolution. Resolved, That the attorney of the United States, for the district of west Florida, be requested and required to institute proceedings in the nature of quo warranto forthwith, against the persons exercising the powers and priviledges granted by the act incorporating the Farmers Bank of Florida,” and if it be found that they have no right to exercise such powers, that be adopt legal mcasures to restrain them from so doing.

An act respecting the escheated estate of Wm Pritchard, deceased.

An act amendatory of the several acts relating to the School Lands in the Territory of Florida.

An act for the relief of Eliza M. Shaw.

A resolution allowing Duval county an additional member. A resolution authorizing the Territorial Treasurer to purchase the full length portrait of Washington, to be placed in the Legislative Hall.

mr. Morton from the select committee to whom the subject was referred made the following report:

The select committee to whom was referred so much of the annual message of the Governor as relates to the compilation Laws of this Territory, beg leave to report:

That in the discharge of their duty they addressed a note to one of the contractors informing him of their wish to receive any explanations he might have to make, or reasons he might wish to assign, why the work has not been delivered according to contract, and received in reply a communication in writing which is herewith submitted.

The committee feel it due to the council to express their, opinion that proper diligence has not been used in the fulfilment of the contract by the contractors; but the committee being of opinion that the Governor is vested, by the act of the last council (approved, February 12th 1835) with sufficient power to enforce its fulfilment, do not think that any further action on the part of this council is necessary.

All of which is respectfully submitted.

Smith from the select committee to whom was referred a bill entitled, "an act to provide for the more effectual defence of the Territory of Florida," reported as a substitute therefor a bill entitled, "an act to provide for the more effectual defence of the Territory of Florida and for the militia and volunteers of said territory, employed in that defence," which report was concurred in and said bill was read the second time and ordered for a third reading to morrow,

mr. Wood from the select committee to whom was referred the petition of S. B. Shelton, reported a bill entitled, an act to divorce Sarah B. Shelton," the yeas and nays being required on concurring with said report, by messrs. Brown of Columbia and Johnson, were Yeas mir. President, messrs Blount, Brown of Columbia, Brown of Jackson, Burritt, Dennis, Downing, Higginbotham, Holloman, Hunter, Macon. M'Cants, Morton, Ramsey, Smith, Walker and Wood-17. Berthelot from the committee to whom was referred a bill entitled, "an act to regulate the patrols of the Territory of Florida," reported as a substitute therefor a bill entitled, an act to repeal an act concerning patrols, passed February 6th 1884, and for other purposes," which report was concurred in

by the House, and said bill was read a second time and ordered for a third reading on to day.

Certain resolutions offered on yesterday by mr. Morton were again taken up, and amended on his motion by striking out one in the first resolution and inserting "two" in the place of it, also by striking out the words "from East Florida" in said resolution, also a blank in the third resolution, was in like manner filled up with the words "five hundred" when said resolutions were read; the yeas and nays being required on the passage of said resolutions, by messrs. Dennis and Smith, Yeas mr. President, messrs. Berthelot, Blount, Brown of Columbia, Brown of Jackson, Burritt, Downing, Duval, Higginbotham, Hunter, Kenan, M'Cants, M'Neil, Morton, Ramsey, Smith, Walker and Wood-18. Nays messrs. Dennis, Johnson and Macon-3. So said resolutions are passed.

The House then proceeded to the election of commissioners authorized by said resolutions, when Joseph L. Smith & Chas. Downing, members of this House, were declared duly elected. mr. President laid before the House the following executive messages: EXECUTIVE OFFICE, February 13th 1836.

I nominate to the council, James B. Latimer, of Maryland, commissioner to take the acknowledgement and proof of the execution of Deeds, Mortgages and other conveyances of Lands, Tenements, & Hereditaments lying & being in the Territory of Florida: and of any contract, letter of attorney or any writing under seal, to be used or recorded ir. said Territory.

The House in committee of the whole again took under consideration a bill entitled, an act for the compensation of the members and officers of the council and for other purposes," after some time spent therein the committee rose, and mr. Burritt therefrom reported progress, and asked leave to sit a gain, which report was concurred in by the House.

The House took under reconsideration the following bills returned rejected, or for amendment, by the Governor, viz:

"An act to amend an act to prevent trespasses and depredations on lands within the jurisdiction of Flordia," the yeas and nays being required on the passage of said bill, in opposi tion to the objections of the Governor; were Yeas messrs. Berthelot, Blount, Brown of Columbia, Brown of Jackson,

Burritt, Dennis, Downing, Higginbotham, Hollomar, Hunter, Johnson, Kenan, M'Cants, M'Neil, Morton, Ramsey, Smith, Tabor, Walker and Wood-19. Nays mr. President, messrs. Duval and Macon-3. So said bill is passed, by the required lawful majority.

A bill entitled, “an act concerning the hostile negroes and mulattoes in the Seminole war," was amended in conformity to the suggestions of the Governor, and read the third time and passed; ordered that the title be as before stated.

A bill entitled, "an act to authorize the guardian or tutor of Jayene Fontainuals and Ylla to sell and dispose of the real es tate of said heirs within this Territory." and

A bill entitled, an act to authorize the guardian and tutor of the minor heir of Daniel E. Burch deceased, to sell the real estate of said heir within this Territory," were on motion of mr. Blount indefinitely postponed.

A bill entitled, "an act to incorporate the Florida Insurance and Banking company," was taken up; the yeas and nays being taken on its passage, in opposition to the Governor's ob jections and rejection, were Yeas messrs. Berthelot, Blount, Brown of Columbia, Brown of Jackson, Burritt, Dennis, Downing, Duval, Higginbotham. Hunter, Johnson, Kenan, Macon, M'Cants, M'Neil, Morton, Ramsey, Smith, Tabor and Walker -19. Nays mr. President and mr. Wood-2. And said bill is passed by the majority required by law.

A bill entitled, "an act to authorize the Governor of the Territory of Florida, to raise volunteers for the defence of the South Eastern Frontier," was on motion of mr. Blount indefinitely postponed.

"an act to establish two terms of the Superior Court in Columbia county,' was taken up for reconside ration; the yeas and nays being taken thereon, in opposition to the Governor's objections; were Yeas mr. A bill entitled, "an act to incorporate the city of Key West," was taken up for reconsideration and amended in conformity with the suggestions of the Governor; when said bill was read the third time and passed.

A bill entitled, "an act to repeal the 27th section of an act etitled, an act concerning wills, letters testamentary, and letters of administration, and the duties of executors, administrators and guardians," was on motion of mr. Brown of Jackson, in-definitely postponed,

A bill entitled, an act to grant a lease of two sections of School Lands, to J. A. S. Norman, for the purposes of edu cation," was taken up: mr. Morton moved the indefinite postponement of said bill; the yeas and nays being required thereon, by messrs. Morton and Brown of Jackson, were Yeas messrs. Berthelot, Brown of Jackson, Dennis, Kenan, Macon, Morton and Ramsey-7. Nays mr. President, messrs. Blount Brown of Columbia, Burritt, Duval, Higginbotham, Hunter, Johnson, M'Cants, M'Neil, Ramsey, Smith, Tabor and Wood -14. So said motion is lost.

The House went into committee of the whole on said bill; after some time spent therein the committee rose, and mr. Duval therefrom reported said bill ariended; which report was concurred in, and said bill (the rule being waived) was read the second and third times and put or its passage; the yeas and nays being required thereon, by messrs. Morton and Brown of Jackson, were Yeas mr. President, messrs. The resolutions offered on this morning by mr. Duval in relation to an appropriation for a revised code, were again read and adopted.

A bill entitled, "an act to divorce Sarah B. Shelton, from her husband Philo B. Shelton,” was read the third time; the yeas and nays being required on its passage, by messrs. Johnson and Morton, were Yeas messrs. Blount, Brown of Columbia, Burritt, Downing, Hunter, M'Cants, Morton, Ramsey, Walker and Wood 10 Nays mr. President, messrs. Berthelot, Brown of Jackson, D unis, Duval, Higginbotham, Holleman, Johnson, Kenan, Macon, M'Neil, Smith and Tabor-13. So said bill is lost. when it again
