The House met pursuant to adjournment, a quorum being present, the Journal of yesterday's proceedings was read. mr. Kenan gave notice that he will on some future day ask leave to introduce the following bills: A bill entitled, "an act to enable the guardian of the infant children of Hezekiah Wilder deceased to convey certain real estate." A bill entitled, "an act to authorize the guardian of the minor heirs of Cullian Edwards deceased to dispose of certain real estate," and A bill entitled, "an act to enable the widow and guardian of the surviving heir of William Smith deceased to sell certain real estate in the town of Quincy in Gadsden county." mr. Holloman gave notice that he will on some future day ask leave to introduce a bill to be entitled, “ an act to amend the several acts now in force relating to the revenue in this Territory." mr. M'Cants moved that the vote on the passage of the bill entitled, "an act to prohibit the circulation of incendiary publications," be reconsidered: the yeas and nays being required on said motion by messrs. Duval and Tabor: were Yeas mr. President, messrs. Blount, Brown of Jackson, Burritt, Downing, Hawkins, Higginbotham, Holloman, Hunter, Johnson, M'Cants, Morton, Ramsey, Smith and Walker-15. Nays messrs. Berthelot, Brown of Columbia, Dennis, Duval, Kenan, Macon, M'Neil and Tabor-8. So said motion prevailed, and said bill is ordered to be reconsidered. On motion of mr. Duval the further consideration of said bill is postponed until the first day of July next; and said bill is lost. mr. Duval pursuant to notice before given, asked and obtained leave to introduce a bill entitled, "an act for the relief of James Stewart," which was read and ordered for a second reading on to-morrow. mr. Morton from the committee on the State of the Territory to whom was referred the petition of R. and W. King &co. praying that the Steam-Boat Florida, may be exempt from pilotage over the bar of St. Johns' river, reported unfavourably on said petition; which report was concurred in by the House. Also from the same committee, reported unfavourably on the petition of T. Livingston and others praying a charter to un stages from Tallahassee to Jacksonville. The yeas and nays being required on concurring with the report of the committee by messrs. Berthelot & M'Cants, were Yeas mr. President, messrs. Blount, Brown of Jackson, Downing, Hawkins, Holloman, Johnson, Kenan, Macon, M'Neil, Morton, Ramsey, Tabor and Walker14. Nays messrs. Berthelot, Brown of Columbia, Burritt, Higginbotham, Hunter, M'Cants and Smith-7. So said report was concurred in. Also from said committee, reported favourably on a bill entitled, “an act in addition to an act entitled an act to establish and regulate the rates of pilotage for the St. Johns' and Nassau river," and A bill entitled, 66 an act to amend the several acts now in force relating to roads, highways and bridges," which reports were concurred in by the House, and said bills were each read a second time and ordered for a third reading on to-morrow. mr. Dennis from the select committee to whom was referred a bill entitled, "an act to repeal an act to authorize John M. Wright to establish a ferry on the Ocklocknee river and for other purposes," reported said bill to the House with amendments; which report was concurred in and said bill was read the second time and ordered to be engrossed for a third reading on to-morrow. A. bill entitled, "an act to Incorporate the Florida Insurance and Banking company," was taken from the orders of the day; mr. Duval moved that the further consideration of said bill be postponed until the first day of July next the yeas and nays being required on said motion by messrs. Morton and Duval : were Yeas messrs. Duval, Macon and Walker-3. Nays mr. President, messrs. Blount moved that a bill entitled, "an act to amend the charter of the Union Bank of Florida," be postponed until to-morrow. The yeas and nays being required on said motion by messrs. Duval and Johnson, were Yeas mr. President, messrs. Berthelot, Blount, Brown of Columbia, Brown of Jackson, Burritt, Downing, Hawkins, Higginbotham, Holloman, Hunter, Johnson, Morton, Ramsey, Smith, Tabor and Walker-17. Nays messrs. Dennis, Duval, Kenan, Macon, M'Cants and M'Neil-6. So said motion prevailed. A bill entitled, "an act providing for the more effectual defence of the Territory of Florida," was on motion of mr. Downing referred to the select committee appointed to confer with the Governor. A bill entitled, "an act to establish the 13th regiment of Florida militia in the counties of Madison and Hamil. ton," was read the second time, and referred to a committee of the whole House. The House went into committee thereon after some time spent therein, the committee rose, and mr. Duval therefrom reported progress, and asked leave to sit again: mr. Blount moved that the committee of the whole be discharged from the further consideration of the bill; which motion prevailed: and said bill was on motion of mr. Smith referred to the committee on the militia. Sundry resolutions offered on yesterday by mr. Duval were on motion of mr. Morton postponed until to-mor row. Smith asked and obtained leave without previous notice, (the rule being for that purpose waived) to intro duce a bill entitled, "an act in further addition to the acts now in force regulating judicial proceedings," which was read and referred to the Judiciary committee. mr. Smith gave notice that he will on some future day ask leave to introduce a bill entitled, "an act to Incorporate the St. Augustine and Picolata Rail-Road company." mr. Downing gave notice that he will on to-morrow introduce a bill to, amend the laws relating to mortg ages." Also a bill to "amend the charter of the Life Insurance and Trust company." Also a bill to enable mrs. Eliza Shaw to sell a tract of land in said bill to be mentioned. mr. Berthelot having announced the death of Captain George Fisher junior, one of his constituents, asked and obtained leave to offer the following resolution : RESOLVED, UNANIMOUSLY BY THIS PRESENT LEGISLATIVE COUNCIL OF THE TERRITORY OF FLORIDA IN COUNCIL ASSEMBLED, That whereas it has pleased Divine Providence to take into his own presence the spirit of their late friend and associate, they will, as an evidence of his heroic gallantry, displayed in the late affair at Withlacoochee, and as a testamonial of their respect for his character as a man, attend his funeral at 12 o'clock this day, in a body. The rule being waived, said resolution was considered and adopted without dissent. mr. Downing rose and announced the death of Samuel Miles Esqr., a member of this House, from the county of Hillsborough. and moved the following resolutions : RESOLVED UNANIMOUSLY, That the members and officers of this House, do wear crape on the left arm till the end of the present session. RESOLVED, That a special committee be appoined to superintend the funeral, and That this House do now adjourn as a mark of respect to the deceased, until to-morrow at 11 o'clock, and [the rule being waived] said resolutions were considered and adopted. Brown of Jackson, pursuant to previous notice asked and obtained leave to introduce a bill entitled, "an act to authorize the county court of Jackson county to levy a tax for the building of a jail and for other purposes," which was read and on his motion referred to the Judiciary committee. mr. Wood gave notice that he will on some future day introduce a bill entitled, "an act to amend an act incorporating the town of Appalachicola." mr. Burritt gave notice that he will on some future day introduce a bill entitled, " an act to amend an act concerning depositions, passed November 17th 1828." Also a bill entitled, "an act to amend an act regulating the mode of suing out writs of error and prosecuting appeals in the Territory of Florida, passed February 8th 1832." Also a bill entitled, "an act to amend an act entitled an act to establish a tariff of fees, passed February 1st 1834." mr. Labor offered the following resolutions : Whereas, the land adjacent to, and bordering upon Holme's creek in Washington county in this Territory; are rich and fertile lands, the most of which lie at present in an uncultivated state, and whereas the increase of population in said county would be accclerated, the value of said lands, and the agriculture and political prosperity of that region of country greatly advanced; by suitable improvements in the navigation of said creek, of which improvements said creek is deemed highly susceptible. Be it therefore resolved by the Governor and Legisla tive Council of the Territory of Florida, That our Delegate in Congress be, and he is hereby requested to use his best exertions, to obtain from Congress an appropriation of Six Thousand Dollars, or such sum of money, as |
