Be it resolved by the Governor and Legislative Council of the Territory of Florida, That all such sums of money so paid and received, or that may hereafter be so pa:d and received, shall be, and the same are hereby appropriated as a fund for the relief of, and to be distributed to the poor and orphan children belonging to this Territory, whose parents or fathers have fallen or may fall victims to our enemy in this present murderous

war.

Be it further resolved, That all military officers or other persons, who have received, or who may hereafter receive, any such sum or sums, shall, without delay, pay over the same, without any defalcation or commission to the treasurer of this Territory, to be held by him for such poor or orphan children, to be distributed for their use, in such manner as may be directed by law.

And be it also further resolved, That any officer or other person, who has or may receive any such sum or sums, and shall fail to pay, or cause the same to be paid over to the said treasurer as directed in the above resolution, shall be liable to indictment, before the superior court, and to fine in double the amount of any such sum or sums of money, which he shall so fail to pay to the said treasurer..

Which were read and laid on the table until Monday. mr. Wood offered the following resolutions,

Resolved, That a special committee be appointed to examine the full length potrait of George Washington, now exhihiting at the Masonic Hall in the city of Tallahassee, and that they have leave to report by bill or otherwise, on Monday next, on the expediency and propriety of purchasing the same for the purpose of being placed in the Legislative Council chamber.

And the rule being waived, after being read; said resolutions were considered and adopted and messrs. Wood, Blount and. Smith were appointed on said committee.

mr. Tabor offered the following resolutions:

Whereas, the lands adjacent to, and bordering upon the River Econfeeno in Washington county in this Territory, are rich and fertile, which lie at present uncultivated; and whereas, the increase of population in said county would be accelerated; the value of said lands, and the agriculture and politi cal prosperity of that region of country, greatly advanced by suitable improvements in the navigation of said river, of which improvements said river is deemed highly susceptible.

Be it therefore resolved by the Governor and Legislative Council of the Territory of Florida, That our Delegate in Congress, be and he is hereby requested to use his_best_exertions, to obtain from Congress an appropriation of Five Thousand Dollars or such sum of money, as may by that honourable body be deemed necessary and expedient to be applied to the improvement and navigation of said river.

Resolved further, That a copy of the foregoing preamble and resolution be duly certified and transmitted to the Honourable Joseph M. White.

Which was read, and laid on the table until Monday.

mr. Macon offered the following resolutions:

Resolved, That a committee be appointed to confer with the Governor as to the legality and propriety of disposing of a portion of the public capitol square and that they make report to the Legilative Council.

Which was read and laid on the table until Monday.

mr. Blount from the Judiciary committee, reported a bill entitled, an act to enable executors, administrators, and guardians to sell the real estate of infants," which was read, and ordered for a second reading, and twenty five copies are ordered to be printed.

Also from the same committee to whom said bills had been referred reported unfavourably on the following bills; which reports were concurred in by the House, to wit:

A bill entitled, "an act in further addition to the acts now in force regulating Judicial proceedings," which was again read and ordered for a third reading on Monday next.

Also a bill entitled, "an act for the relief of the militia and volunteers of Florida, called into the service of the U. States, during the present Indian war," which was again read and ordered for a third reading on Monday.

Also a bill entitled, an act for the relief of the heirs of Adam Hunter deceased," which was again read and ordered for a third reading on Monday.

Also a bill entitled, "an act for the relief ef the heirs of Hezekiah Wilder deceased," which was again read, and ordered for a third reading on Monday next.

Also a bill entitled, "an act for the relief of the widow and heir of Wm. Smith deceased," which was again read, and ordered for a third reading on Tuesday next.

Also a bill entitled, "an act to authorize the county caurt of Jackson county to levy a tax for the building a jail and for other purposes," which was again read and ordered for a third reading on Wednesday next.

Also a bill entitled, "an act for the relief of the heirs of Sharod M'Call deceased," which was read a second time, and ordered for a third reading on Monday next.

Also to the same committee to whom was referred the petition of John Britt, administrator of Sextus Camp deceased, and report a bill therewith entitled, "an act to authorize the guardian of the minor heirs of Sextus Camp deceased, to sell certain real estate," which was read, and ordered for a second reading on Wednesday next.

Also the same committee to whom was referred a bill entitled, an act for the relief of the heirs of Cullin Edwards deceased," reported unfavourably on said bill; which report was concurred in by the House.

Also the said committee to whom was referred the message of his Excellency the Governor, respecting the Tallahassee fund, dated 4th February 1836. Beg to be discharged from the further consideration of said message and its accompanyment, and that the same be referred to the committee on Finance, which was ordered to be done.

mr. Berthelot from the committee on Enrolments reported as correctly Euroled:

"An act to incorporate the city of St. Joseph."

"An act to incorporate the Pensacola Steam Saw-mill company."

"An act to amend the Charter of the Union Bank of Florida."

"An act for the relief James Stewart."

"An act to authorize the guardian of the heirs of Thomas Wright deceased, to sell their real estate within this Territory."

"An act to authorize Sion Smith to dispose of certain real estate," and

A resolution requesting the Delegate in Congress to obtain an appropriation for improving the navigation of Hoimes' creek in Washington county.

The House then adjourned until Monday next, at 12 o'clock.

Monday, February 8.

The House met pursuant to adjournment, a quorum being present the journal of yesterday's proceedings was read.

mr. Morton from the majority who voted for the rejection of certain resolutions offered by mr. Dennis, moved a reconsideration of said vote. The yeas and nays being called on said motion by messis. Wood and Walker, were Yeas messrs. Berthelot, Blount, Brown of Jackson, Dennis, Higginbotham, Holloman, Hunter, Kenan, Macon, M'Neil, Morton and Ramsey-12. Nays mr. President, messrs. Burritt, Downing, Johnson, Smith, Walker and Wood-7. So said vote is ordered to be reconsidered: and said resolutions placed among the orders for to-morrow.

mr. Wood pursuant to previous not ce asked and obtained leave to introduce the following bills :

A bill entitled, "an act to incorporate the St. Joseph's Bank," and

A bill entitled, "an act to incorporate the St. Joseph's insurance company," which were severally read and referred to the committee on Banks.

mr. Brown of Jackson pursuant to previous notice asked and obtained leave to introduce a bill entitled, "an act supplemental to the several acts relating to the Bank of West Florida," which was read and referred to the committee on Banks. mr. Blount moved the following resolution:

Resolved, That the 38th rule of this House be so amended as to permit the introduction of bills until to-morrow inclusive which, the rule being waived, was considered and adopted.

mr. Burritt gave notice that he will on to-morrow ask leave to introduce a bill entitled, "an act to incorporate the East Florida Silk company."

mr. Wood gave notice that he will to-morrow introduce a bill to incorporate the "Florida Silk company.'

mr. Smith from the militia committee to whom the same had been referred, reported with amendments a bill entitled, an act to establish and organize a corps of military exempts in the city of St. Augustine," which was read the first and second times, the rule being waived; and ordered for a third reading

on to morrow.

mr. Berthelot from the committee on Schools and Colleges made the following report:

The committee on Schools and Colleges have instructed me
to report, that they have endeavoured to ascertain what has
been done in relation to lands set apart for the purposes of edu-
cation by Congress, but have not succeeded in eliciting any
satisfactory information on the subject. They find, that by
the act of 1828, commissioners were appointed to lease those
lands until the Territory becomes a State: but what was done
by those commissioners under said act is to be derived only
from rumour.
The committee believe that under that act se-
veral sections have been leased, but how many, to whom, and
at what prices they have been unable to learn. The territorial
treasurer has informed the committee that several persons have
offered to pay into the treasury the rents due upon those leases,
but being unauthorized, he has refused to receive such pay-
ments. The committee would respectfully recommend to this
council, the passage of a law, to authorize and make it the du-
ty of the territorial treasurer to receive demands, and sue for
the rents now due and that may hereafter become due upon
such leases, and making the commissioners accountable to the
said treasurer for acts done by virtue of the several laws re-
lating to the school lands, requiring the treasurer to report an-
nually what sections have been disposed of, what still remain-
ing, what rents are due upon such leases, and all matters rela-
ting to the said lands, proper to be known by this body. Also,
a bill to grant a lease of two sections of land to J. A. S. Nor-
man for the purposes of education.

Which was read and concurred in.
Also, introduced the following bills:

A bill entitled,

mr. Morton from the select committee to whom the Governor's message on the subject had been referred, reported a bill entitled, an act to improve the capitol square in the city of Tallahassee and for other purposes," which was read and ordered for a second reading on to merrow.

mr. Morton from the select committee to whom was referred a bill entitled, "an act for the relief of Albert G. Tomlinson," reported the same to the House without amendments: which report was concurred in, and sa:d bill was read again, and ordered for a third reading on to morrow.

The House went into committee of the whole on a bill entitled, an act to amend an act to incorporate a company called the St. Andrews and Chipola canal company, passed the 3d day of February 1832," after some time spent therein the committee rose, and mr. Downing therefrom reported progress and asked leave to sit again: which report was concurred in by the House.

The resolutions offered on the 5th inst. by mr. Ramsey were again read and concurred in by the House.

A bill entitled, 66 an act for the more effectual defence of the Territory of Florida," was postponed and made the order of the day for Wednesday next.

A bill entitled, "an act to organize an additional regiment o militia in the counties of Hamilton and Madison," was read the third time and passed: ordered that the title be as above stated.

A bill entitled, "an act to incorporate the St. Augustine and Picolata Rail-Road company," was read the third time, and the yeas and nays being called upon its passage by messrs. Berthelot & Macon, were Yeas mr. President, messrs. Blount, Brown of Jackson, Burritt, Dennis, Downing, Higginbotham, Holloman, Hunter, Johnson, Kenan, Macon. M'Neil, Morton, Ramsey, Smith, Tabor, Walker and Wood-19. Nays mr. Berthelot-1. So said bill is passed: ordered that the title be as above.

A bill entitled, "an act to authorize the executors of Thomas W. Seabrook to sell his estate both real and personal," was postponed and made the order for Wednesday.

A bill entitled, "an act to regulate the patrols of the Territory of Florida," was postponed until Wednesday next. A bill entitled, an act to amend an act concerning depositions, passed November 17th 1828," was again read: ordered for a second reading on Wednesday next, and twenty five printed copies are ordered.

A bill entitled, "an act to amend an act regulating the mode of suing out writs of error and of prosecuting appeals in the Territory of Florida," was again read and ordered for a third reading on to morrow.

A bill entitled, "an act to amend an act to regulate proceedings in Chancery, approved Nov. 8th 1823," was again read and ordered for a third reading on to-morrow.

A bill entitled, "an act respecting certain records in the clerks office of Columbia county," were referred to a select committee; messrs. Smith, Walker and Burritt were appointed thereon.

A bill entilted, "an act to amend an act entitled, an act incorporating the town of Appalachicola," was again read and ordered for a third reading to morrow

A bill entitled," an act respecting the escheated estate of William Pritchard deceased," was again read and ordered for a third reading to morrow.

The resolutions offered on Saturday last by mr. Johnson were again read: the yeas and nays being called on their passage by messrs. Morton & Johnson, were Yeas messrs. Brown of Jackson, Dennis, Holleman, Hunter, Johnson, Kenan, M'Neil, Morton, Smith, Tabor and Walker-11. Nays mr. President, messrs. Berthelot, Blount, Burritt, Downing, Higginbotham, Macon, Ramsey and Wood-9. So said resolu tions are adopted.

The House then adjourned until to morrow at 11 o'clock.
