Resolved, That the report of the joint committee on enrolment be recommitted to the same committee with instructions to report whether the resolutions entitled "Joint resolutions to authorize the cancelling of certain canal bonds" were left with the Executive, or were returned to the Assembly by the commit. tee, and that the committee be also instructed, that whenever hereafter, the Executive shall refuse to receive a bill, they shall leave the bill and report the fact to their respective Houses.

A motion was then made by Mr. Price, that the House do now adjourn; which was disagreed to.

On motion of Mr. Darling,

A call of the House was made, and it appearing that a quorum

was present,

Further proceedings in the call of the House were dispensed with.

A message from the Council by their Secretary.

"Mr. Speaker-The Council have concurred in the second and fourth of the amendments of the House of Representatives to the amendments of the Council to bill No. 6, (H. of R. file) en. titled "a bill to divide the town of Warren, in the county of Milwaukee, and to establish the town of Nemahbin," and have non.concurred in the first and third amendments of the House of Representatives to the said amendments of the Council; and that they have refused to concur with the House of Representatives in the passage of a resolution entitled "resolution relative to the appointment of a joint committee to confer with the Governor."

Mr. Olin presented the petition of inhabitants of Milwaukee county, in relation to common schools and highways,

Which was referred to the joint committee on town and county government.

Mr. Olin offered the following resolution.

Resolved, That the Speaker be, and is requested, to invite the Rev. Mr. Clark to officiate as Chaplain in this House.

Mr. Tripp moved to amend the resolution by adding thereto "and that each member contribute five dollars for the support of the said chaplain."

Mr. Olin accepted the amendment offered by Mr. Tripp.

Mr. Hamilton then moved to amend the resolution by stri. king out the words following, "and that each member contribute five dollars for the support of the said chaplain," and insert instead thereof the words "provided no charge is made on the territorial treasury, in consequence of such invitation."

Mr. Crossman moved that the resolution do lie on the table. Which was disagreed to.

Mr. Trowbridge moved to amend the amendment by adding

thereto "and provided no appropriation shall be made therefor, in the general appropriation bill."

Which was determined in the negative,

The message from the Council returning bill No. 6, (H. of R. file) entitled "A bill to divide the town of Warren in the county of Milwaukee, and to establish the town of Nemahbin," was taken up for consideration, when the House insisted on the first and third amendments of this House to the said bill, in which the Council had refused to concur, and appointed Messrs. Tripp and Darling a committee on their part to confer with a like com. mittee to be appointed by the Council, relative to said disagree. ment.

Ordered, That a conference thereon be requested.

Mr. Darling gave notice that he should on some future day ask leave to introduce "a bill in relation to the annual report required of territorial officers."

On motion of Mr. Hamilton,

The House resolved itself into the committee of the whole, Mr. Darling in the chair, for the consideration of the following bills, to wit:

No. 5, [II. of R. file] entitled "a bill concerning justices of the peace."

No. 7, (H. of R. file) entitled "a bill to provide for the punishment of embezzling public money."

No. 13, [C. F.] entitled "a bill fixing the time of holding the annual sessions of the Legislative Assembly and for other pur poses," and

No. 16, [C. F.]" a bill to repeal so much of the several acts of the Legislative Assembly of this Territory as authorizes the sale of any portion of the lands granted to the Territory by the act of Congress of June 18, 1833, to aid in the construction of the Milwaukce and Rock river canal, and to amend an act approved February 19th, 1841, supplementary to the several acts in relation to said canal."

After some time spent therein, the committee rose and re. ported bills Nos. 13 and 16 without amendment, and Nos. 5 and 7, with amendinents.

Bills Nos. 13 hnd 16, were then ordered to a third reading. The report of the committee on bill No. 5, (which was to strike out the enacting clause) was agreed to.

So the bill was negatived.

The amendments reported by the committee to bill No. 7, were agreed to, and the bill ordered to be engrossed for a third reading.

Mr. Hamilton, from the committee on the judiciary, to which the amendments of the Council to bill (No. 1, of this House) entitled "a bill to change the time of holding courts in certain counties in the 2d judicial district," was referred made the fol. lowing report:

The committee on the judiciary to which was referred the amendment of the Council to bill No. 1, [H. of R. file] recom. mend to the House to strike out in the second amendment of the Council, all from the word "the" in the first line of the 5th section, to the word "spring" in the 5th line of said section, and add a new section to be called section 6, as follows:

The judge of any district court in which any criminal prose. cution now is, or may hereafter be pending, upon the applica. tion of the defendant or of the prosecuting attorney, for any of the causes now prescribed by law for awarding a change of ve. nue in civil cases, shall have power either in term time or vaca. tion to award a change of venue to the nearest county where the causes complained of are not alleged to exist.
