Mr. Hamilton from the committee of conference, to which the subject was referred, made the following joint report :

The committee of conference to whom was referred "a bill to authorize Henry Thien to build a dam on the Milwaukee river," report that they recommend to insert in lieu of the words stricken out in the House of Representatives, the following words, "the said Thien shall construct a head gate, abutments, and all the work necessary to make a lock in said dam, at the time said dam shall or may be built, provided, that the comple. tion of said lock shall be left until the supervisors or the county. commissioners of the county of Washington shall so direct. them."

The question being put on the adoption of the report it was agreed to.

Ordered, That the Council be acquainted therewith.

And then the House adjourned until 7 o'clock, P. M.

Messrs. Argy, Meeker and Hopkins, were excused from attendance this evening.

Mr. Van Vleet by leave presented the petition of inhabitants of the village of Racine, praying authority to levy a tax for the construction of a harbor at the mouth of Root River.

Referred to the committee on internal improvements.

Mr. Walker, from the committee on internal improvements, to which several petitions were referred, reported a bill of the following title, to wit:

No. 14, “a bill to authorize the mill owners on Root river, to tap Lake Muskego."

Which was read the first and second times.

On motion of Mr. Darling,

The House took up Bill No. 13, from the Council, entitled "a bill fixing the time of holding the annual sessions of the Legislative Assembly, and for other purposes, and on motion of Mr. Hamilton, the said bill was committed to the committee of the whole House.

The House then resolved itself into the committee of the whole House on the said bill, Mr. Elmore in the chair. After a short time spent therein, the committee rose, and Mr. Elmore reported the bill with an amendment.

Mr, Hamilton moved to strike out the third section of the amendment; which was disagreed to.

On motion of Mr. Hicks,

The report of the committee was amended by striking out the word "shall," and inserting "may," in the last section of the amendment, and was then agreed to.

The said bill was then read the third time, passed and the title thereof agreed to.

On motion of Mr. Hamilton,

The House took up bill No, 1, (H. of R. file) entitled “a bill to change the time of holding courts in certain counties of the 2d judicial district;"

And on his motion the House resolved itself into the commit. tee of the whole, Mr. Hunkins in the chair, for the consideration of the second amendinent of the Council to said bill.

After some time spent therein, the committee rose and recom.

mended the House to concur in the second amendment of the Council with an amendment.

And the question being put, it was agreed to. So the second amendment of the Council was concurred in with an amend. ment.

Mr. Darling moved a reconsideration of the vote by which the House refused to concur in the first amendment of the Council. (relative to an additional term of the district court, to be held in Milwaukee county,) which was determined in the negative;

On motion of Mr. Platt,

The following resolution was taken up and unanimously adopted:

Resolved by the House of Representatives of the Territory of Wisconsin, That the provision of the act of Congress establish. ing the territorial government of Wisconsin, approved April 20, 1836, that no person holding a commission under the United States or any of its officers except as a militia officer, shall be a member of the said Council, or shall hold any office under the government of the said territory," although it may be fairly construed as excluding post masters from being members of that branch of the Legislative Assembly called the Council, does not prohibit a postmasters from being a member of this House.

On motion of Mr. Walker,

Bill No. 8, (C. F.) entitled "a bill to change the name of

Henry Sanders Brown" was taken up and ordered to a third reading.

On motion of Mr. Walker,

The sixteenth rule was suspended in reference to the said bill.

Which was then read the third time, passed, and the title thereof agreed to.

And then the House adjourned.

Tuesday, March 21, 1843.

On motion of Mr. Tripp,

Resolved, That the committee on the militia be instructed to revise the militia law, and report by bill or otherwise.

Mr. Walker, from the committee on internal improvements a bill to amend an act entitled an reported bill No. 15, entitled

act to incorporate the village of Racine."

Which was read the first and second times.

Mr. Manahan from the committee on corporations reported bill No 16, entitled " a bill to authorize Levi Godfrey, to build & dam on Fox river,"

Which was read the first and second times.

Agreeably to previous notice, and by leave Mr. Crossman introduced bill No 17, “a bill to abolish the office of auditor of the Territory, and provide for the election of comptroller of public accounts and Territorial treasurer."

Which was read the first and second times.

Mr. Thompson from the committee on corporations reported bill No. 18, entitled "a bill to provide for laying out the several Torritorial roads therein named."

Which was read the first and second times.

Agreeably to previous notice and by leave Mr. Thompson introduced bill No. 19, entitled "a bill regulating the manner of petitions to the Legislative Assembly."

On motion of Mr. Platt.

The House, resolved itself into the committee of the whole House, Mr. Agry in the chair, having under consideration the following bills of this House, to wit:

No. 2, "a bill supplementary to an act to amend an act for a5sessing and collecting county revenue."

No. 4, "a bill concerning road taxes."

No. 8, "a bill to establish a Territorial road from Prairie du Chien, to Lake Superior."

No. 9, "a bill to amend an act entitled an act to provide for the printing and distribution of the laws of Wisconsin."

No. 11, "a bill for an act to amend an act entitled an act regulating taverns and groceries."

No. 12, "a bill supplementary to an act entitled an act con. cerning judgments and executions," and

No. 13, 44 a bill in relation to the duties of certain Territorial officers."

Pending the report of the committee, the Secretary of the Council was announced, when the Speaker took the chair, and the following message was received:

"Mr. Speaker-The Council have adopted the joint report of the joint committee of conference on "a bill to authorize Henry Thien to build a dam on the Milwaukee river."

The Council have also concurred in the amendments of the House of Representatives to bill
