The house resumed the consideration of the report of the committee of the whole house, on bills Nos. 48 and 49, [H. of R. file.]

And the question being on agreeing to the report on bill No. 48,

Mr. Hamilton moved the previous question, when

Mr. Elmore, moved a call of the house, which was made, and the sergeant at arms sent to notify Messrs. Hicks, Hunkins, Olin, and Parsons that their presence was desired in the House. A motion was then made by Mr. Hamilton, to dispense with further proceedings in the call of the house.

And the question being put, it passed in the negative.

A message from the Council by their Secretary:

"Mr. Speaker:-the Council have concurred in the amend ments of the house to bill

No. 31, [C. F.] a bill to abolish certain offices therein named."

The Council have passed bill

No. 62. [C. F.] a bill to amend an act entitled an act to change the time of holding courts in certain counties of the second judicial distret, and to previde for a change of venue criminal cases, and for other purposes.'

And ask the concurrence of the house therein.

The Council have passed bill

No. 10, (H. of R. file)" a bill concerning removals from office,"

With amendments, in which the concurrence of the house is asked.

Also, bill

No. 31, [H. of R.] a bill to provide for laying out and estab lishing Territorial roads therein named,”

With an amendment, in which the concurrence of this house s asked.

No. 41, (H. R.) "a bill for an act to make valid the official acts of Frederick Borcherdt, a justice of the peace,"

With an amendment to the title thereof, in which the concur. rence of this house is asked.

Also, a bill

No. 18, [H. of R.]" a bill to provide for laying out the several territorial roads therein named."

With amendments, in which the concurrence of the house is asked

Also, a bill

No. 36, [C. F.] "a bill to repeal an act entitled an act to a mend an act entitled an act to prescribe the mode of proceedings in chancery, and for other purposes, approved 13th January, 1840,"

And ask the concurrence of the house therein.

The Council have considered bill

No. 4. [H. R.) "a bill concerning road taxes,"

And have postponed the same indefiditely.

Also, a bill

No. 32, [H. R.] "a bill for an act to amend an act, entitled an act for opening or vacating public Highways; and the acts amendatory thereto,"

Which bill is indefinitely postponed.

No. 36, [II. of R. file] entitled "a bill to provide for the pay. ment of fees for the subdivisions of sections of land into half sections, and quarter secsions,"

Has been considered and rejected by the Council.

No. 2, [H. of R.] a bill supplementary to an act to amend an act for assessing and collecting county revenue,,'

Has been considered by the Council. and postponed indefinite. ly.

No. 33,[H. of R.] "a bill to repeal an act entitled an act concerning the admission of Attorneys at law, and for other purposes."

Has been considered and rejected by the Council.

The Council have passed "joint resolution relative to the distributive share of Wisconsin in the nett proceeds of the pub. lic lands," and ask the concurrence of the House therein; also, resolution No. 5 [H. of R.] being a "resolution to rescind a resolution to provide an office for the Auditor and Treasurer of the Territory."

The members that were absent having appeared, further proceedings in the call of the house were dispensed with.

The previous question was then put in these words, "Shall the main question be now put ?" and passed in the negative.

And the ayes and noes being called for,

Those who voted in the affirmative are

Messrs, Agry, Elmore, Hicks, Hopkins, Judson, Meeker, Parsons, Thompson and Tripp-9.

Those who voted in the negative, are

Messrs. Capron, Crossman, Darling, Hamilton, Hunkins, Long, Manahan, Masters, Olin, Palmer, Platt, Price, Trowbridge, Van Vleet, Walker and Ellis (Speakes) 16. .'

So the bill lies over until the next sitting of the House... Leave was then granted to the committee of the whole to sit again for the consideration of bill No. 49.

On motion of Mr. Hamilton,

The House resolved itself into the committee of the whole House, Mr. Darling in the chair, having under consideration.

bill No. 48, [C. F.] "A bill to provide for the levying and col lectiag a Territorial revenue."

Pending the report of the committee, the Speaker resumed the chair, when a message in waiting was received from the Governor by Mr. Charles Doty.

The committee of the whole House again resumed its session and after some time spent therein, rose and reported the bill back to the House with amendments.

Mr. Platt moved that the bill do lie on the table.

Which being put was disagreed to.

The amendments to the said bill No. 48, were then agreed to. Mr. Long from the committee on enrolled bills, reported the following to be correctly enrolled, to wit:

"Joint resolution relative to making a settlement with the Milwaukee and Rock River canal company.

"

"An act to authoirze the election of an additional Justice of the Peace in certain towns," and

"An act to abolish certain offices therein named."

The same were signed by the Speaker, and ordered to be presented to the President of the Council for his signature.

Mr. Hamilton moved to amend the bill by striking out the fifth section, and inserting in lieu thereof, the following, to wit:

That there shall be levied and collected in each county in the Territory, in the year 1843, a tax of three eighths of a mill on the dollar on the assessment rolls of said counties, and it shall be the duty of the proper authorities to cause the assessment rolls to embrace all real estate and the improvement thereon and all personal property.

Mr. Platt moved to amend the amendment by striking therefrom, all after the words "real estate,"

And the question being put thereon, passed in the negative.
And the ayes and noes being called for,

Those who voted in the affirmative are,

Messrs. Agry, Crossman, Darling, Meeker, Palmer, Platt, Price and Tripp-8.

And those who voted in the negative are

Messrs. Capron, Elmore, Hamilton, Hicks, Hopkins, Hunkins, Judson, Long, Manahan, Masters, Olin, Parsons Thompson, Trowbridge, Van Vleet, Walker, and Ellis [Speaker]-17. On motion of Mr. Darling,

Ordered that the said bill No. 48, do lie on the table.

The Speaker laid before the House the report of the Treasu. rer of the Territory, relative to the scrip that was issued to the creditors of the Territory.

Also, a communication from the Secretary of the Territory, on the same subject.

Which were read, laid on the table, and ordered to be printed. The Speaker also laid before the house a message from the Governor, which was read, and is as follows:

To the House of Representatives:

In reply to the resolution of the house of the 8th instant, I have the honor to state that there has never [to my knowledge] been issued under my signature, any bonds purporting to be Wisconsin canal Bonds,' or any other Territorial bonds of "the denomination of one thousand dollars, or of any other denomination."
