On motion of Mr. Agry,

The house resolved into the committee of the whole, Mr. Darling in the chair, having the following under consideration, to wit: No. 39 "A bill for an act for the preservation of tim ber upon rivers and streams."

No. 50, "a bill to make valid the official acts of George Mc Williams, Edwin Hart, and Lyman Crossman, justices of the peace."

No. 2. "Memorial to Congress respecting the improvement of the Fox river," and

No. 6, "Resolution relative to a division of Grant county."

And after some time spent therein, the committee rose, and reported the said bills, resolution and memorial without amend.

ment.

Bills 39 and 50 and memorial No. 2, were severally ordered to be engrossed for the third reading.

Mr. Platt moved to amend resolution No. 6, by striking out all after the word "Resolved," and inserting the following words:

By the House of Representatives, the Hon. the Council concurring, that the voters of Grant county at the next general election, be authorised to vote for or against a division of said county, dividing the same from north to south, which votes shall be counted and canvassed by the judges of election, in the same manner as the votes for county officers are required to be canvassed, counted and returned to the clerk of the board of county commissioners, and the said clerk of said board is hereby di rected and required to send a true transcript of such returns to the Speaker of the House of Representatives and President of the Council on the first day of the next session of the Legislative Assembly of this Territory.

Which was agreed to and the resolution ordered to lie on the table.

On motion of Mr. Elmore,

Bill No. 48, [C. F.] "a bill for levying and collecting ter. ritorial revenue," was taken up, and the question being on its passage,

Mr. Platt moved a call of the house, which was made, whereupon further proceedings in the call of the house were dispensed with.

Mr. Hamilton then moved to adjourn until half past 2 P. M. and also moved a call of the house upon the said motion.

A call of the house was then made, and

On motion of Mr. Darling,

Further proceedings in the call of the house were dispensed with.

Mr. Hamilton then withdrew his motion for adjournment, and moved that the bill do lie on the table until the afternoon,

And the question being put was disagreed to.

Mr. Hamilton then renewed his motion to adjourn until half past 2 o'clock P. M., and being put, it passed in the negative. And the ayes and noes being called for,

Those who voted in the affirmative are

Messrs. Agry, Capron, Hamilton, Hicks, Platt, Price Thompson, Trowbridge, Van Vleet and Walker-10.

Those who voted in the negative, are

Messrs. Crossman, Darling, Elmore, Hopkins, Hunkins, Jud. son, Manahan, Masters, Meeker, Olin, Parsons, Tripp, and Ellis, [Speaker,]-13.

Mr. Elmore demanded the previous question.

And the question was put in these words:

"Shall the main question be now put ?" and passed in the af firmative.

The ayes and noes being called for upon the said question, Those who voted in the affirmative are,

Messrs. Crossman, Darling. Elmore, Hunkins, Manahan'

Masters, Meeker, Olin, Parsons, Thompson, Tripp and Walker

Those who voted in the negative are,

Messrs. Agry, Capron, Hamilton, Hicks, Hopkins, Judson, Platt. Price, Trowbridge, Van Vleet and Ellis, [Speaker]-11. So the main question was ordered to be now put.

Mr. Hamilton then moved a call of the house, which was made, and the sergeant-at-arms sent to notify Messrs. Long and Palmer that their attendance on the house was required... Mr. Olin moved to dispense with further proceedings in the call of the house;

Which was negatived.

Messrs. Long and Palmer having taken their seats in the house, further proceedings in the call were dispensed with.

The main question was then put, being the passage of the said bill, and passed in the affirmative.

And the ayes and noes being called for,

Those who voted in the affirmative, are

Messrs. Capron, Crossman, Darling, Elmore, Hopkins, Hunkins, Judson, Long, Manahan, Masters, Meeker, Olin, Parsons, Thompson, and Van Vleet-15.

Those who voted in the negative are,

Messrs. Agry. Hamilton, Hicks, Palmer, Platt, Price, Tripp, Trowbridge, Walker and Ellis [Speaker.]—10.

Mr. Olin moved to adjourn,

Which was disagreed to.

Mr. Platt then moved to amend the title to the said bill by adding to it:

"And to tax one portion of the people for the benefit of the other."

And the question being put thereon it passed in the negative. The title was then agreed to.

And then the house adjourned until half past 2 o'clock, P. M.

HALF PAST TWO O'CLOCK, P. M.

The Speaker remarked that he had in the morning made an erroneous decision relative to the resolution offered by Mr. Man. ahan in which it was determined that it required two-thirds of the whole house to suspend a rule of the house instead of twothirds of the members present, and he took this occasion to correct that decision.

Objection being made to considering the resolution by Mr. Hamilton,

Mr. Platt moved that the house do now take and consider resolution No. 6, relative to a division of Grant county, And on that motion he moved a call of the house, which was made, and the sergeant.at-arms was sent after absent members. Several of the members that were absent having appeared further proceedings in the call of the house were dispensed with. The house then decided to take up the said resolution,

Mr. Darling moved an amendment, which was accepted by Mr. Platt.

Mr. Hamilton moved to amend by inserting after the words "north and south," the words "between ranges one and two west."

Mr. Agry moved to amend the amendment, by striking out the words "north and south."

Which was disagreed to.

The question was then taken on the amendment, and determ. ined in the negative.

A message from the Council by their Secretary:

"Mr Speaker-The Council have passed the following enti tled bills, in which they ask the concurrence of this house, to wit:

No. 64, "a bill to amend the statutes of this Territory rela

tive to the sales of land under execution or mortgage, and to legalize certain conveyances."

No. 57," a bill to amend the act authorizing Samuel H. Farnsworth to build and maintain a dam on the Menomonee river."

And have concurred in bill No. 42 of the house, entitled "a bill for an act authorizing the Governor to offer rewards for the ap. prehension of criminals in certain cases," with amendments, in which the concurrence of this house is asked.

And have indefinitely postponed bill No. 9, of this house, entitled "a bill to amend an act entitied an act to provide for the printing and distributing the laws of Wisconsin."

No. 11, "a bill for an act to amend an act entitled an act regulating taverns and groceries," has also been indefinitely postponed by the Council.

The Council have adopted a "Resolution to provide for the election of an attorney to defend a suit against the Territory in favor of William Dougherty," and ask the concurrence of this house therein."

Mr. Hamilton then moved to amend the resolution by inserting after the words "Grant county," "and all other counties in the Territory."

Which was put and passed in the negative.

Mr. Price made a motion that the resolution be indefinitely postponed, and the question being put it passed in the negative. And the ayes and noes being called for.

Messrs. Agry, Capron, Long, Manahan, Masters, Meeker, Olin, Palmer, Price-9.

Those who voted in the negative, are
