The question was then taken on the motion of Mr. Agry, and determined in the affirmative.

And the ayes and noes were taken and were as follows:

Ayes-Messrs. Agry, Crossman, Darling, Elmore, Hicks, Hopkins, Hunkins, Judson, Manahan, Meeker, Olin, Parsons, Platt, Price and Tripp--15.

Noes-Messrs. Hamilton, Long, Masters, Palmer, Thompson, Trowbridge and Walker-7.

The House then resolved itself into the committee of the whole house, on the said bill, Mr. Elmore in the chair.

After some time spent therein, the committce rose, reported progress and asked leave to sit again.

Mr. Hamilton moved the previous question.

And the question being put in these words, "shall the main question be now put?" and it passed in the affirmative.

The main question was then put on granting leave to the committee of the whole to sit again on the said bill, and it passed in the affirmative.

Mr. Crossman made a motion to adjourn,

Which was disagreed to.

A motion was then made by Mr. Hicks to take up bill No. 23, (H. of R. file)" a bill to repeal the 8th section of an act entitled an act to amend an act concerning justices of the peace." Which being put was disagreed to.

A message from the Council, by their Secretary:

"Mr. Speaker:-The Council have concurred in the first, fourth, fifth, sixth, seventh, eighth, nineth, tenth, sixteenth, sev. enteenth, eighteenth, nineteenth, twenty-first, twenty.second, twenty-third, twenty-fifth, twenty-sixth, twenty-seventh, ameadments of this house to bill No. 65 [C F] "A bill to provide for the payment of the expenses of the Legislative Assembly," have non-concurred in the second, third, eleventh, twelfth, thirteenth, fourteenth, fifteenth, twentieth, and twenty-fourth, amendments,

and have amended the sixth, sixteenth, twenty-fifth, twenty. sixth, and twenty-seventh amendments, in which the concurrence of the house of Representatives is asked.

A message from the Council by their Secretary:

"Mr. Speaker-The Council have concurred in the amend ments of the house to bill No. 55, [C. F.] "a bill to organize the town of Pike, in the county of Racine, and to annex certain lands to the town of Southport in said county."

On motion of Mr. Tripp,

The rule setting apart one hour for the transaction of morn. ing business, was suspended for this day.

When the message from the Council returning bill No. 65, [C. F.]" a bill to provide for the payment of the expenses of the Legislative Assembly," with the action of the Council thereon, was taken up.

And the question being put, will the house insist on their second amendment to the said bill, it passed in the affirmative. On motion of Mr. Tripp,

A call of the house was then made.

When Mr. Walker moved that further proceedings in the call of the house be dispensed with.

Which was disagreed to.

The sergeant-at-arms was then directed to notify Messrs. Hamilton and Parsons, that their presence was required in the house.

And the said members having appeared, they were excused from paying the fees of one dollar, imposed by the resolution of yesterday.

On motion of Mr. Hunkins,

The messenger was then directed to notify the fireman that his attendance was required in the house.

The question was then put, will the house insist on its third amendment, and it passed in the affirmative.

The question was then put on concurring in the amendment of the Council to the 27th amendment of the house, and it passed in the negative.

And the ayes and noes being called for,

Those who voted in the affirmative are,

Messrs. Crossman, Hamilton, Hicks, Masters, Palmer, Platt, Price, and Walker-8.

Those who voted in the negative arc,

Messrs. Agry, Capron, Darling, Elmore, Hopkins, Hunkins, Judson, Long, Manahan, Meeker, Olin, Parsons, Thompson, Tripp, Trowbridge, Van Vleet, and Ellis (Speaker)-17.

So the house non-concurred in said amendment.

Mr. Darling made a motion to amend the amendment of the Council to the sixth amendment of the house, by adding thereto, the words "or unaccounted for."

And the question being put thereon, it passed in the affirma. tive.

The question then recurred on concurring in the amendment as amended, and being put it passed in the affirmative.

The question was then put, will the house insist on its elev. enth amendment, and it passed in the affirmative.

So the house insisted on the said amendment.

The question was then put, will the house recede from its 12th amendment.

And it passed in the affirmative.

The question was then taken on receding from the 13th amendment of the house; and it passed in the affirmative. The question was then put on receding from the 14th amendment of the house.

And it passed in the affirmative.

The question was then put on insisting on the 15th amend.

And it passed in the affirmative.

The question was then put on corcurring in the amendment of the Council to the 16th amendment of the house

And it passed in the negative.

So the house non-concurred in the said amendment.

The question was then put, "will the house insist on its 20th amendment."

And it passed in the affirmative.

The question was then put will the house recede from its 24th amendment.

And it passed in the negative.

And the ayes and noes being called for, on the said question, Those who voted in the affirmative, are

Messrs. Crossman, Darling, 'Elmore, Hamilton, Hunkins Meeker, Olin, Parsons, Tripp and Ellis, [Speaker]--10.

Those who voted in the negative are,

Messrs. Agry,' Capron, Hicks, Hopkins, Judson, Long, Manahan, Palmer, Platt, Price, Thompson, Trowbridge, Van Vleet and Walker,--14.

So the House insisted on its 24th amendment.

Mr. Hamilton moved to amend the amendment of the Coun. cil, to the 25th amendment of the House by adding thereto, the following, to wit:

Also, for printing for the House of Representatives from 12th April to the close of the present session inclusive, $111,63.

To Seth Van Bergen for furnishing, cutting and hauling to the steps of the capitol, five cords of wood as per agreement with the superintendent of territorial property $13,50.

Mr. Manahan moved to amend the said amendment, offered by Mr. Hamilton, by adding thereto, the following:

To J. G. Knapp, for publishing in the Madison Express, the proceedings of the house of Representatives $75,00.

And the question being put thereon, it passed in the affirma tive.

Mr. Walker moved further to amend the amendment offered by Mr. Hamilton, by adding the following:

To J. and L. Ward for stationery furnished Barlow Shackford, late Librarian, five hundred dollars, to be paid when said stationery or so mnch as has not heretofore been delivered, shall be delivered as per bill, to the superintendent of Territorial property, and when so delivered, shall be kept for the use of the next Legislative Assembly.

And the question being taken thereon, it passed in the affirmative.

And the ayes and noes being called for,

Those who voted in the affirmative, are,

Messrs. Agry, Capron, Hamilton, Hicks, Hopkins, Hunkins, Long, Olin, Palmer, Platt, Price, Van Vleet, and Walker—13. Those who voted in the negative, are,

Mr. Capron asked to be excused from attendance in the house for to-day on account of illness.

And was accordingly excused.
