No. 15, (H.) "Resolution relative to the adjournment of the present session of the assembly," and the amendment thereto made by the council, were read;

When Mr. Olin moved that the same do lie on the table;

And the question being put,

It passed in the affirmative.

And a division being called, there were ayes 15, noes not counted.

Mr. Long from the committee on enrollment, reported as correctly enrolled the following entitled bill, which was signed by the speaker, to wit:

No. 13, (C.) "A bill to incorporate the trustees of the village of Mineral Point."

The hour devoted to morning business having expired,

Mr. Elmore renewed the motion made by him this morning, to reconsider the vote by which the house refused on yesterday to amend the journal at the instance of Mr. Hicks.

And the question being put thereon,

It passed in the negative.

And the ayes and noes having been called for by Mr. Hicks, Those who voted in the affirmative were,

Messrs. Agry, Hopkins, Masters, Palmer, Platt, Price, and Thompson-7.

Those who voted in the negative were,

Messrs. Bartlett, Birchard, Capron, Darling, Ellis, Elmore, Grant, Hunkins, Long, Manahan, Meeker, Olin, Parsons, Tripp, Trowbridge, and Walker (speaker)-16.

Mr. Hicks, by leave, offered the following resolution, to wit: "Resolved, That no motion or question not entertained by the house, or any remarks of any member in debate, be entered upon or make any part of the journal;"

And the question being put, on the adoption thereof,

It passed in the negative.

And the ayes and noes having been called for by Mr. Hicks,

Those who voted in the negative were,

Mr. Crossman, by leave, and agreeably to previous notice given, introduced the following entitled bill, which was read the first and second times, and

On motion of Mr. Darling,

Was referred to the committee on the judiciary, to wit:

No. 25, (H.) "A bill to incorporate the first congregationalist church and society in Madison."

On motion of Mr. Paliner,

Ordered, that the undermentioned resolution be taken up, to wit:

"Resolved, That the committee on the judiciary be instructed to inquire into the expediency of repealing the act concerning the City of the Four Lakes, approved April 15th, 1843."

And the question being put, on the adoption thereof,
It passed in the affirmative.

On motion of Mr. Palmer,

Ordered, that the undermentioned bill, be referred to the committee of the whole house, to wit:

No. 22, (H.) "A bill to authorize the register of deeds of the county of Green to procure certain copies of records in the office of the register of deeds of Milwaukee and Iowa counties,"

On motion of Mr. Ellis,

Ordered, that the undermentioned bill be re-committed to the committee of the whole house, to wit:

No. 13, (H.) "A bill to set off the town of Howard, in the county of Brown."

On motion of Mr. Agry,

Ordered, that the undermentioned bill be referred to the committee of the whole house, to wit:

No. 15, (H.) "A bill for an act for the preservation of timber upon rivers and streams."

Thereupon, the house resolved itself into the committee of the whole house, for the consideration of the aforementioned bills; Mr. Price in the chair;

And after some time spent therein, the committee rose, and by their chairman reported bill No. 13 with, and No. 22 without amendment, and that they had made some progress on bill No. 15, and desired leave to sit again thereon.

Leave was accordingly granted to sit again for the consideration of bill No. 15, when the amendment to bill No. 13 was con

curred in, and the bill together with bill No. 22, were severally

ordered to be engrossed.

On motion of Mr. Agry,

The house adjourned.

WEDNESDAY, January 10, 1811.

The undermentioned petitions were severally presented and referred, to wit:

By Mr. Crossman: the petition of the county commissioners of the county of Dane, praying that the expenses of the prosecution of James R. Vineyard be paid by the territory;

Referred to the committee on the judiciary.

By Mr. Darling: the petition of citizens of Calumet county, praying that the county may be detached from the county of Brown, and attached to some other county more conveniently situated, to be organized for judicial purposes. Also,

The petition of citizens of Calumet county, praying for the passage of a law requiring the county of Brown to refund to the county of Calumet certain school moneys;

Which were severally referred to the committee on the judiciary.

By Mr. Thompson: the petition of inhabitants of Wisconsin territory, praying for the passage of a law permitting David Merrill and others to build a bridge across Milwaukee river at Walker's Point;

Referred to the committee on internal improvements.

Mr. Crossman, from the committee on engrossed bills, reported as correctly engrossed

No. 13, (H.) “A bill to set off the town of Howard, in the county of Brown;" and

No. 22, (H.) "A bill to authorize the register of deeds of the county of Green to procure certain copies of records in the office of register of deeds of Milwaukee and Iowa counties."

Mr. Long, from the committee on enrolled bills, reported that they did, on this day, present to the governor for his approval: "An act to incorporate the trustees of the village of Mineral Point;"

"An act to change the time of holding the annual meetings of the several boards of county supervisors;"

"An act to organize the county of Sauk;" and

"An act to provide for the election of a printer to the legisla tive assembly."

Mr. Darling, from the committee on the judiciary, to which a petition on the subject had been referred, reported the uncermentioned bill, to wit:

No. 26, (II.) "A bill to authorize the trustees of school district No. 1, in the town of Rochester, to collect certain moneys, and pay over to district No. 8;"

Which was read the first and second time.

A message from the council, by their secretary:

"Mr. Speaker: The council have passed the following, in which I am directed to ask the concurrence of this house, to wit: No. 7, (C.) 'A bill to provide for the election of clerks of the boards of supervisors, and for other purposes;"

No. 26, (C.) ‘A bill to authorize the erection of a bridge across Root river;'

No. 27, (C.) "A bill prescribing the time of holding the annual sessions of the legislative assembly;"

No. 28, (C.) A bill to provide for the punishment of the offence of trespass on the lands of individuals, and for other purposes;' No. 32, (C.) 'A bill in relation to the territorial road from Mineral Point, by Whitewater, to Milwaukee.'

And have passed

No. 18, (H.) A bill to authorize the president and trustees of the village of Southport to discontinue a street.""

Bills on their passage being announced by the speaker,

The undermentioned bill was read the third time, passed, and the title thereof agreed to, to wit:

No. 22, (H.) "A bill to authorize the register of deeds of the county of Green to procure certain copies of records in the office of register of deeds in Milwaukee and Iowa counties."

The following entitled bill was read the third time and passed, to wit:

No. 13, (H.) "A bill to set off the town of Howard, in the county of Brown."

On motion of Mr. Elmore,

The title to the said bill was amended to read "A bill to set off the several towns therein named."

The message from the council was taken up, when

The undermentioned bills were severally read the first and second times, to wit:

No. 32, (C.) "A bill in relation to the territorial road from. Mineral Point, by Whitewater, to Milwaukee."

No. 28, (C.) "A bill to provide for the punishment of the offence of trespass on the lands of individuals, and for other purposes;"

No. 27, (C.) "A bill prescribing the time of holding the annual session of the legislative assembly;"

No. 26, (C.) "A bill to authorize the erection of a bridge across Root river;"

No. 7, (C.) "A bill to provide for the election of clerks of the boards of supervisors, and for other purposes."

The speaker laid before the house a communication from James Morrison, treasurer of the territory, in answer to a resolution of this house relating to the vouchers in his hands for which scrip was issued; which was read, and

On motion of Mr. Birchard,

Referred to the committee on finance. [SEE APPENDIX.] Mr. Elinore, by leave, offered the following resolution, which was adopted, to wit:

No. 17, (H.) "Resolution concerning a light-house at Sauk Harbor," as follows:

"Resolved, by the council and house of representatives of Wisconsin territory, that our delegate is hereby requested to urge upon congress the necessity of making an appropriation for the purpose of placing a revolving light at Sauk Harbor, within this territory."

On motion of Mr. Crossman,

Ordered, that the reports of the select committee relative to the account of Daniel Baxter, be taken up for consideration.

Mr. Crossman then moved that the majority report of said committee be accepted, and the committee discharged from the further consideration thereof; when,
