Mr. Palmer moved to amend the motion so as to include the

minority report;

And the question being put on agreeing to the amendment proposed by Mr. Palmer,

to.

It passed in the affirmative.

And then the motion of Mr. Crossman, as amended, was agreed

The undermentioned resolution, reported by the majority of said committee, was then read the first and second time, and

On motion of Mr. Hunkins,

The rule requiring the same to be printed was suspended, viz: No. 5, (II.) "Resolution relative to an allowance to Daniel Baxter."

On motion of Mr. Agry,

Ordered, that the undermentioned bill be referred to the committee of the whole house, to wit:

No. 15, (II.) "A bill for an act for the preservation of timber upon rivers and streams."

On motion of Mr. Tripp,

Ordered, that the undermentioned bill be referred to the committee of the whole house, to wit:

No. 32, (C.) "A bill in relation to the territorial road from Mineral Point, by Whitewater, to Milwaukee."

On motion of Mr. Ilunkins,

Ordered, that the undermentioned bill be referred to the committee of the whole house, to wit:

No. 21, (II.) "A bill to authorize the construction of a bridge across the Milwaukee river, in the town of Milwaukee."

On motion of Mr. Manahan,

Ordered, that the undermentioned bill be referred to the committee of the whole house, to wit:

No. 23, (C.) "A bill to define the boundaries of certain counties therein named, and for other purposes."

Thereupon the house resolved itself into the committee of the whole house, for the consideration of the aforementioned bills; Mr. Elmore in the chair.

After some time spent therein, the committee rose and reported No. 15 with, and Nos. 23 and 32 without amendment; and that they had made some progress in bill No. 21, and desired leave to sit again thereon.

On motion of Mr. Manahan,

Ordered, that bill No. 23 be indefinitely postponed.

On motion of Mr. Crossman,

Ordered, that bill No. 15 be laid on the table.

Bill No. 32 was then ordered to a third reading;

And leave granted to sit again for the consideration of bill No. 21.

Mr. Long, from the committee on enrolled bills, reported the following to be correctly enrolled, which were signed by the speak er, to wit:

"An act for the relief of the town of Sharon, in Walworth county;"

"Memorial to congress for a donation of land to improve the Grant river slough."

Mr. Palmer, by leave, and agreeably to notice previously given, introduced the following bill, which was read the first and second time, to wit:

No. 27, (H.) "A bill to prohibit the circulation of the bills of foreign banks within the limits of the territory of Wisconsin."

On motion of Mr. Ellis,

Ordered, that the aforementioned bill No. 27, be printed and referred to the committee on the Judiciary.

Mr. Elmore moved that the undermentioned resolution be now taken up for consideration, to wit:

No. 15, (H.) "Resolution relative to the adjournment of the present session of the legislative assembly."

And the question being put thereon,

It passed in the negative.

And the ayes and noes having been called for by Mr. Elmore, Those who voted in the affirmative were,

Messrs. Bartlett, Darling, Ellis, Elmore, Hopkins, Long, Parsons, Price, Thompson, Tripp and Walker, (speaker)-11. Those who voted in the negative were,

Messrs. Agry, Birchard, Capron, Crossman, Grant, Hicks, Hankins, Manahan, Masters, Mecker, Olin, Palmer, Platt, and Trowbridge-14.

Mr. Darling, from the committee on the judiciary, to which several petitions on the subject had been referred, reported the undermentioned bill, to wit:

No. 28, (H.) "A bill to organize the county of Fond du Lac for judicial purposes;"

Which was read the first and second time.

Mr. Crossman moved that the house adjourn until 2 o'clock this afternoon, when

Mr. Elmore moved that the house do now adjourn.

The speaker decided that the latter motion being privileged,, would first be put.

And the question being put thereon,

It passed in the affirmative.

So the house adjourned.

THURSDAY, January 11, 1844.

Mr. Olin presented the petition of C. Eastman, and other citizens of Milwaukee, for the removal of vagrant Indians;

Which was referred to the committee on territorial affairs. The speaker laid before the house a communication of M. M. Jackson, attorney general, relative to the suit of William Doughty, vs. the territory of Wisconsin;

Which was read, and

On motion of Mr. Long,

Ordered, to be laid on the table and printed. [SEE APPENDIX.]

Mr. Elmore, by leave, offered the following resolution,
Which was adopted, to wit:

"Resolved, That the committee of conference, on the disagreeing vote of the two houses, on resolution relative to the location of university lands, be requested to report forthwith."

Mr. Platt, from the committee on mining and smelting, to which a resolution of this house on the subject had been referred, made a report relating the mineral lands of Wisconsin, and the leasing system. [SEE APPENDIX.]

Accompanied by the following memorial, to wit:

No. 4, (II.) "An address of the council and house of representa tives of the territory of Wisconsin, to the senate and house of rep resentatives of the United States, concerning the mineral lands in the said territory;"

Which was read the first and second time.

On motion of Mr. Platt,

The said report was accepted, and five hundred copies thereof ordered to be printed.

A message from the council by their secretary:

"Mr. Speaker: The council have passed

No. 31, (C.) A bill to amend certain acts relative to the countics of Dodge and Washington;'

No. 21, (C.) A bill to amend an act entitled an act concerning justices of the peace, and for other purposes;'

No. 38, (C.) 'A bill to amend an act entitled an act to repeal an act entitled an act to incorporate the stookholders of the Bank of Mineral Point,' approved February 18th, 1842;

In which I am directed to ask the concurrence of this house; And have passed

No. 17, (H.) Resolution concerning a light house at Sauk Harbor.""

Mr. Trowbridge, from the committee on roads, to which several petitions on the subject had been referred, reported the undermentioned bill,

No. 29, (II.) "A bill to establish certain territorial roads therein named;"

Which was read the first and second time.

Mr. Long, from the committee on enrolled bills, reported the following to be correctly enrolled:

No. 18, (II.) "A bill to authorize the president and trustees of the village of Southport to discontinue a street;" which was signed by the speaker.

Mr. Ellis, from the committee of conference, to which resolution No. 11, (C.) was referred, relating to the selection of seminary lands, reported that an informal meeting of the committee had been held, at which the chairman of the committee on the part of the council recommended to the house to recede from its amend ments, to which the committee on the part of the house could not accede;

And he therefore moved that the said committee be dissolved. Mr. Parsons moved to amend the motion by adding to it the following words:

"And that a new committee be appointed;"

Which was agreed to.

And then the motion was adopted.

Messrs. Price and IIunkins were appointed said committee on the part of this house.

A message from the governor by Mr. Charles Doty, his private secretary;

Which the speaker laid before house, notifying it, that he had on the 10th instant approved bills of the following titles, to wit: "An act to change the time for holding the annual meetings of the several boards of county supervisors;" and

"An act to organize the county of Sauk."

Mr. Darling moved to reconsider the vote by which the house on yesterday indefinitely postponed bill

No. 23, (C.) "A bill to define the boundaries of certain counties therein named and for other purposes."

And pending the question thereon,

Mr. Darling moved to lay the said motion on the table;

And the question being put thereon,

It passed in the negative.

The question was then put on the motion to reconsider;
And it passed in the negative.

Bills on their passage being announced, the undermentioned was read the third time, passed and title thereof agreed to, to wit: No. 32, (C.) "A bill in relation to the territorial road from Mineral Point, by Whitewater, to Milwaukee."

Mr. Palmer offered the following resolution, to wit:

"Resolved, That the committee on the judiciary, be instructed to inquire into the expediency of reporting a bill requiring the respective clerks of the district courts of the several counties to present to the respective clerks of the boards of county commissioners, or supervisors, as the case may be, within five days after the adjournment of the court, a full statement of all the certificates issued to jurors, and to witnesses summoned on the part of the territory, and any other indebtedness which their counties may have incurred on account of the sessions of the courts;

Which was adopted.
