No. 28, (C.) "A bill to provide for the punishment of the offence of trespass on the lands of individuals and for other purposes."

Mr. Trowbridge moved that the undermentioned bill be referred to the same committec, to wit:

No. 37, (II.) “A bill to authorize Jared Lake and his associates to build and maintain a wharf."

On motion of Mr. Platt,

A call of the house was then made, when Messrs. Agry, Hicks, Messersmith, and Price, were reported to be absent.

Mr. Darling moved that the absentees be excused from atterdance;

Which was disagreed to.

The sergeant-at-arms was sent to notify Messrs. Agry, Hicks, Messersmith and Price, that their attendance was desired in the house.

Several of the absentees having taken their seats.

On motion of Mr. Grant,

Further proceedings in the call of the house were dispensed with.

The motion of Mr. Manahan to go into committee of the whole on said bills, was then put and agreed to.

Thereupon the house went into the committee of the whole house, for the consideration of said bills;

Mr. Price in the chair:

After some time spent therein, the committee rose, and by their chairman reported said bills, with amendments to each;

Which were concurred in by the house, and bill No. 28, ordered to the third reading, and bill No. 37, ordered to be engrossed. Mr. Parsons moved that bill No. 31 do lie on the table;

And the question being put thereon,

It passed in the negative.

Mr. Thompson moved to amend the said bill, by striking out the first three sections thereof;

And the question being put,

It passed in the negative.

And the ayes and noes having been called for by Mr. Thompson,

Those who votod in the affirmative, were

Messrs. Hopkins, Price, Thompson, and Tripp-4.

Those who voted in the negative, were

Messrs. Bartlett, Birchard, Crossman, Darling, Ellis, Elmore,

Grant, Hicks, Hunkins, Manahan, Masters, Messersmith, Meeker, Olin, Parsons, Platt, Trowbridge, and Walker (spk'r.)-18.

Mr. Hunkins moved to amend said bill by striking out the 7th section thereof.

Mr. Parsons moved to amend the motion by striking out the words "who neglect or refuse to" before "shall," and the words "shall forever be debarred a recovery of such debt," in said section. Which amendment was accepted by Mr. Hunkins.

Mr. Hicks moved that the bill be laid on the table till Monday next;

Which motion the speaker decided to be out of order.

Mr. Grant moved that the house do now adjourn;

Which was disagreed to.

Mr. Thompson moved that said bill and amendment do lie on the table;

And the question being put,

It passed in the affirmative.

Mr. Trowbridge offered a resolution to discontinue certain territorial suits;

Which the speaker decided, being of a general nature, could not be acted on withont giving one days notice, and that the resolution would therefore lie over until to-morrow.

Mr. Ellis one of the tellers appointed by the two houses, in convention held this day, to canvass the votes given for the office of superintendent of territorial property reported, that thirty-one votes had been given for the said office.

Of which, John Y. Smith rceived twenty, blank eight, J. G. Knapp one, William N. Seymour one, and dont like to tax the territory one.

John Y. Smith having received a majority of all the votes given, by the said convention was declared by the president thereof, to have been duly elected to the said office.

On motion of Mr. Meeker,

The house adjourned.

MONDAY, January 22, 1844.

The undermentioned petitions were severally presented and referred, to wit:

By Mr. Tripp: two petitions from the inhabitants of the town of Bark river, in the county of Jefferson, praying that a portion ef said town may be set off, into a separate town to be called “Jack son;"

Referred to the committee on corporations.

By Mr. Masters: the petition of the inhabitants of town six north, in range sixteen east, in the county of Jefferson, praying for the organization of said town to be called "Sparta;"

Referred to the committee on corporations.

By Mr. Hunkins: the petition of the inhabitants of the town of Nemahbin, in the county of Milwaukee, praying that the name of said town be changed to "Delafield;"

Ordered, to be referred to a select committee, to be composed

of three members.

By Mr. Long: the petition of Amos Hill and others, citizens of the county of Iowa, praying that said Hill be divorced from his wife Elizabeth J. Hill;

Referred to the committee on the judiciary.

Mr. Hunkins presented the account of J. A. Noonan, for printing for the use of the territory;

Which was referred to the committee on territorial expendi

tures.

The speaker laid before the house a communication from Messrs. Sheldon and Hyer, relative to printing;

Which was read, and

On motion of Mr. Elmore,

Was referred to the committee on legislative expenditures. Mr. Crossman, from the committee on engrossed bills, reported to be correctly engrossed the undermentioned, to wit:

No. 37, (H.) "A bill to authorize Jared Lake and his associates to build and maintain a wharf."

Mr. Marahan, from the committee on territorial expenditures,

to which was referred sundry accounts, reported that said committee had allowed the following accounts, to wit:

Accounts of E. V. Whiton, John Catlin, Simeon Mills, William N. Seymour, George Messersmith and M. M. Jackson.

And had disallowed the following, to wit:

Of H. S. Baird, A. A. Bird, Arthur Bronson, Henry O. Sholes, George Beatty, J. Chadwick, and Alexander Mitchell.

On motion of Mr. Platt,

Ordered, that the report be accepted and the committee discharged from the further consideration of said accounts.

On motion of Mr. Ellis,

Ordered, that Messrs. Baird and Sholes severally have leave to withdraw their accounts.

On motion of Mr. Hunkins,

Ordered, that the judiciary committee, (which had been instructed to report all matters in their hands on to-day,) have one day longer in which to report,

Mr. Meeker from the committee on finance, to which the undermentioned bill had been referred, reported the same back to the house, without amendment, to wit:

No. 6, (H.) "A bill to provide for assessing and collecting the county revenue for the county of Grant."

Mr Meeker also, from the same committee, to which had been referred the report of the treasurer of the territory, reported the same to the house, without any action thereon, and moved that the committee be discharged from the further consideration of said bill and report,

Which was agreed to; when

On motion of Mr. Meeker,

Ordered, that said report of the treasurer be referred to the committee on territorial expenditures.

Mr. Long, from the committee on enrolled bills, reported as correctly enrolled, the following:

Which were signed by the speaker, to wit:

No. 29, (H.) "A bill to establish certain territorial roads therein named;"

No. 13, (H.) "A bill to set off the several towns therein named."

Mr. Long, also, from the same committee, reported that they

did on this day present to the governor for his approval the fol ing, to wit:

"Resolution relative to extinguishment of the Indian title to lands there in mentioned;"

"An act to organize the county of Fond du Lac for judicial pur poses;"

An act in relation to the qualifications of voters for state government, and for the election of delegates to form a state constitution;" and

"An act to authorize the construction of a bridge across the Milwaukee river, in the town of Milwaukee."

A message from the council, by their secretary:

"Mr. Speaker: The governor has notified the council that he did on the 20th inst. approve and deposite in the office of the secretary of the territory, bills of the following titles, to wit:

'An act to amend an act entitled an act to incorporate the trustees of the village of Mineral Point, approved January 11th, 1844;'

'An act to amend certain acts relative the the counties of Dodge and Washington."

'An act to authorize the president and trustees of the village of Southport to raise money, and for other purposes;'

'An act to authorize the crection of a bridge across Root river? 'An act to organize the county of Dodge, and to provide for the locating the seat of justice of the same;'

'An act to authorize school district No. I, in the town of Lancaster, to levy a tax; also,

Resolution requiring the governor to supply the Wisconsin Dragoons, at Mineral Point, with arms.'

The council have passed

No. 43, (C.) A bill to postpone the payment of principal and interest moneys, due from purchasers of canal lands, and for other purposes,'

In which I am directed to ask the concurrence of this house." Mr. Darling, from the committee on the judiciary, to which was referred bill No. 40, (C.) entitled "A bill to amend an act entitled an act concerning costs and fees," reported the same to

the house with amendments.

And then said bill was read the second time.
