On motion of Mr. Elmore,

The house resolved itself into the committee of the whole house, for the consideration of the following bills, Mr. Capron in the chair:

session of the legislative assembly;"

No. 38, (H.) "A bill to authorize Clovis A. La Grave to keep a

ferry;" and

After some time spent therein, the committee rose, and reported

Ordered, that bills Nos. 38 and 39 (H.) be engrossed for a third reading, and that bill No. 27 (C.) be ordered to a third reading.

On motion of Mr. Darling,

Ordered, that so much of the rules of this house as prohibits bill No. 27 (C.) from being read the third time, be suspended with reference to said bill.

Which was read the third time, passed, and the title thereof agreed to.

On motion of Mr. Platt,

So much of the 16th rule as prohibits bills from being read the second time on the same day, was suspended with reference to bill No. 38, (H.)

And the said bill was read the third time, passed, and the title thereof agreed to.

On motion of Mr. Trowbridge,

So much of the 16th rule of the house as prohibits bills from being read the second and third time on the same day, was suspended in reference to bill No. 39, (H.)

The said bill was recommitted to the committee of the whole house.

On motion of Mr. Mecker,

The following bills were referred to the same committee, to wit: No. 30, (H.) “A bill to repeal an act regulating taverns and groceries;"

No. 35, (H.) "A bill to prevent disturbances and interruptions at camp meetings."

The house then resolved itself into the committee of the whole house, for the consideration of the said several bills,

Bill No. 35 was ordered to be engrossed for a third reading. Mr. Hunkins moved that bill No. 30 be indefinitely postponed, And the question being put thereon,

A message from the council by their secretary:

"Mr. Speaker: The council have passed the following, in which I am directed to ask the concurrence of this house, to wit: No. 39, (C.) 'A bill to incorporate the city of Milwaukee;" No. 54, (C.) A bill to change the name of Cordelia Elvira Hood to Cordelia Elvira Burris, and to provide that the said Cordelia shall be the adopted child and legal heir of Martin V. Burris;' and

No. 23, (H.) 'A bill to authorize David Jones and Erastus Bailey to build and maintain a dam across the Pish-te-go river,' with amendments."

The speaker stated that the question pending before the house, was on concurring in the amendments made by the committee of the whole house to the undermentioned bill, to wit:

No. 31, (H.) "A bill to repeal the several acts appointing a treasurer and auditor, and for other purposes;" when,

On motion of Mr. Elmore,

A call of the house was made, and Messrs. Hunkins, Olin, Palmer, Platt, and Price, reported to be absent.

On motion of Mr. Bartlett,

Ordered, that Mr. Olin be excused from attendance in the house.

The sergeant-at-arms was sent to notify Messrs. Hunkins, Palmer, Platt and Price that their attendance was desired in the house; Several of the absentees having appeared in their seats; and, On motion of Mr. Elmore,

Further proceedings in the call of the house were dispensed with.

Mr. Hicks moved to amend said bill by striking out all after the enacting clause and inserting the following, to wit:

"Section 1. That all persons having in their possession any evidences of debt against the territory, shall present the same to the auditor of the territory, at Madison, for record, who shall record in a book to be kept by him for that purpose, the nature of the claims of indebtedness, acknowledged by the territory, by whom signed, and countersigned, when dated, the several amounts and to whom payable.

Sec. 2. The auditor shall place on all vouchers not returned after record such mark or device as will prevent a second registration.

Sec. 3. So much of any law of this territory as provides for the assessing and collecting a territorial revenue, is hereby repealed.

Sec. 4. The secretary of the territory shall cause to be published a correct copy of this act in all the weekly journals of this territory; and all paper charges for publishing the same shall be paid out of any money appropriated by congress to pay for printing the laws of the territory.

Sec. 5. The auditor shall receive for the services contemplated by this act such sum as the legislature may think just and proper;"
