Those who voted in the negative, were

Messrs. Hicks, Hopkins, Palmer, Platt, and Price-5.

Mr. Ellis, by leave, introduced the following resolution, which, On motion of Mr. Platt,

Was laid on the table until to-morrow, at two o'clock, P. M., to wit:

"Resolved, by the council and house of representatives of the territory of Wisconsin, that this assembly is not required to be governed by the disbursement of the appropriation made by congress for the expenses of said assembly, by any estimates which may have been submitted to congress, either by the governor of this territory or the secretary of the treasury."

On motion of Mr. Platt,

Ordered, that the select committee to be appointed, to which the auditor's report is referred, be instructed to report to-morrow morning.

Bills on their third reading being announced by the speaker, The undermentioned were severally read the third time, pas sed, and their titles agreed to, to wit:

No. 35, (H.) "A bill to prevent disturbances and interruptions at camp meetings;"

No. 31, (H.) “A bill to repeal the several acts appointing a treasurer and auditor, and for other purposes;"

No. 7, (C.) "A bill to provide for the election of clerks of the boards of supervisors, and for other purposes."

On the question of the passage of bill No. 31, aforesaid, a division was called,

And there were ayes 13, noes 9.

A message from the governor by Mr. Charles Doty, his private secretary:

"Mr. Speaker: I am directed by the governor to present to the house a message in writing."

The undermentioned bill was read the third time, to wit:

No. 2, (II) "A bill concerning the time of commencing actions, and for other purposes;"

When Mr. Ellis moved that said bill do lie on the table;

And the question being put there on,

It passed in the negative.

And the ayes and noes having been called for by Mr. Ellis,

Those who voted in the affirmative, were

Messrs. Bartlett, Birchard, Ellis, Hicks, Long, Messersmith, Meeker, Olin, Platt, Price, and Thompson-11.

Those who voted in the negative, were

Messrs. Agry, Crossman, Darling, Elmore, Grant, Hopkins, Hunkins, Manahan, Masters, Palmer, Parsons, Thompson, Tripp and Walker (spk'r.)—14.

The question was then put on the passage thereof;

And it passed in the affirmative;

And the ayes and noes having been called for by Mr. Ellis,

Those who voted in the affirmative, were

Messrs. Agry, Birchard, Crossman, Darling, Elmore, Grant, Hopkins, Manahan, Masters, Meeker, Olin, Palmer, Parsons, Tripp, and Trowbridge-15.

Those who voted in the negative, were

Messrs. Bartlett, Capron, Ellis, Hicks, Long, Messersmith,

Platt, Price, and Walker (spk'r.)-9.

Pending the question on agreeing to the title of said bill,

Mr. Ellis moved to amend the same by striking out all after the word "bill," and inserting in lieu thereof the words, "to defraud non-residents out of their lands;"

And the question being put on the adoption thereof,

It passed in the negative;

And the ayes and noes having been called for by Mr. Ellis,

Those who voted in the affirmative, were

Messrs. Ellis, Hicks, Long, Messersmith, Platt, and Price-5. Those who voted in the negative, were

Messrs. Agry, Bartlett, Birchard, Capron, Crossman, Darling, Elmore, Grant, Hopkins, Hunkins, Manahan, Masters, Meeker, Olin, Palmer, Parsons, Tripp, Trowbridge, and Walker (speaker) -17.

Mr Darling then moved to amend the title so as to read, "A bill relating to real actions, and for other purposes;" And the question being put thereon,

It passed in the affirmative;

A division being called for,

There were ayes 17, noes not counted.

So the title was agreed to.

On motion of Mr. Platt,

Ordered, that the undermentioned memorials be taken up for consideration, to wit:

No. 4, (II.) "Address of the council and house of representa tives of the territory of Wisconsin, to the senate and house of representatives of the United States, concerning the mineral lands in said territory;"

No. 5, (II.) "Address of the legislature to the secretary of the treasury of the United States, in relation to the marshals of the territory."

Pending the question on ordering memorial No. 4 to be engrossed for the third reading,

Mr. Ellis moved to amend the same by striking out all after the word "case," in the third paragraph, and all of the fourth paragraph, on the second page of the printed memorial;

And the question being put thereon,

It passed in the negative.

Mr. Ellis moved further to amend said memorial, by striking out the two paragraphs immediately preceding the last;

And the question being put thereon,

It passed in the negative.

Memorials Nos. 4 and 5 were then severally ordered to be engrossed for a third reading.

On motion of Mr. Hicks,

The house resumed the consideration of the following memorial, to wit:

No. 6, (H.) "Petition to the congress of the United States, praying for the passage of a law to enable the inhabitants of the territory of Wisconsin to form a constitution and state government."

Mr. Ellis moved that the said memorial be indefinitely post poned;

And the question being put,

It passed in the affirmative;

And the ayes and noes having been called for by Mr. Hicks, Those who voted in the affirmative were,

Messrs. Agry, Bartlett, Birchard, Capron, Ellis, Grant, Long, Marahan, Masters, Meeker, Palmer, Parsons, Price and Walker, (speaker)-14.

Those who voted in the negative were,

Messrs. Crossman, Darling, Hicks, Hopkins, Hunkins, Messersmith, Olin, Platt, Thompson, Tripp and Trowbridge-11. On motion of Mr. Trowbridge,

The house adjourned until half past 2 o'clock, P. M.

HALF PAST TWO O'CLOCK, P. M.

The speaker laid before the house the message of the governor, received this morning, notifying the house that he had on this day approved and deposited in the office of the secretary of the territory the following, to wit:

"An act to set off several towns therein named," and

"An act to lay out the several ter.itorial roads therein named." The undermentioned bills were severally referred to the committee of the whole house, to wit:

On motion of Mr. Manahan,

No. 41, (H.) "A bill to amend an act entitled an act establishing courts of probate, defining their duties," &c.

On motion of Mr. Platt,

No. 51, (C.) "A bill to revive and amend an act entitled an act to incorporate the town of Plattville, approved February 19, 1841." On motion of Mr. Crossman,

No. 44, (C.) "A bill to submit to the people of Wisconsin the question of the expediency of forming a state government." Thereupon, the house resolved itself into the cominittee of the whole house, for the consideration of said bills;

Mr. Ellis in the chair.

And after some time spent therein, the committee rose, and by their chairman reported bill No. 41 with, and No. 51 without amendments, and that they had made progress in bill No. 44, and desired leave to sit again for the consideration thereof.

The amendments to bill No. 41, were concurred in, and the said bill ordered to be engrossed for a third reading.

Bill No. 51 was then ordered to the third reading;

And leave granted to the committee to sit again for the consid eration of bill No. 44.

On motion of Mr. Platt,

Ordered, that all rules of the house, prohibiting the third reading and passage of bill No. 51 now, be suspended in reference to said bill;

Which was then read the third time, passed, and the title thereof agreed to.

On motion of Mr. Marahan,

Ordered, that all rules of the house prohibiting the third reading and passage of bill No. 41 now, be suspended in reference to said bill;

Which was then read the third time, passed, and the title thereof agreed to.

Mr. Trowbridge moved that the undermentioned memorial be taken up and considered in committee of the whole bouse, to wit:

No. 8, (C.) "Address of the council and house of representatives of the territory of Wisconsin, to the senate and house of representatives of the United States, relative to the infringement of the boundaries of Wisconsin."

On motion of Mr. Birchard,

A call of the house was made.

And Mr. Palmer was reported to be absent, when

On motion of Mr. Thompson,

Further proceedings in the call of the house were dispensed with.

The question was then put on agreeing to take up and consider memorial No. 8 in the committee of the whole;

And it passed in the affirmative.

And the ayes and noes having been called for by Mr. Ellis, Those who voted in the affirmative were,

Messrs. Birchard, Crossman, Darling, Elmore, Grant, Long,

Manahan, Masters, Messersmith, Meeker, Parsons, Price, Trowbridge and Walker (speaker)-14.
