Mr. Ellis, by leave, introduced the undermentioned resolution, 'to wit:

"Resolved, That memorial No. 7, (C.) be made the special order for this day, at 12 o'clock, noon, at which time it shall have preference of all other business."

Mr. Hunkins moved that said resolution do lie on the table.

And the question being put thereon,

It passed in the negative.

And the ayes and noes having been called for by Mr. Ellis, Those who voted in the affirmative were,

Messrs. Capron, Hunkins, Messersmith, Olin, Parsons, Platt, Price, Thompson, Tripp and Walker (speaker)-10.

Those who voted in the negative were,

Messrs. Bartlett, Crossman, Darling, Ellis, Grant, Hicks, Hopkins, Long, Masters, Meeker and Trowbridge-11. On motion of Mr. Hunkins,

A call of the house was then made, when

Messrs. Agry, Birchard, Elmore, Manahan and Palmer, were reported to be absent.

On motion of Mr. Hunkins,

Ordered, that Mr. Manahan be excused from attendance in the house on the present call.

Then the sergeant-at-arms was sent to notify Messrs. Agry, Birchard, Elinore and Palmer, that their attendance was desired in the house.

Several of the absentees having appeared in their seats,

On motion of Mr. Darling,

Further proceedings in the call of the house were dispensed

with.

The question was then put on the adoption of said resolution, And it passed in the negative.

The ayes and noes having been called for by Mr. Ellis,

Those who voted in the affirmative were,

Messrs. Agry, Bartlett, Birchard, Crossman, Darling, Ellis, Hicks, Long, Masters, Meeker, Thompson and Trowbridge—12. Those who voted in the negative were,

Messrs. Capron, Elmore, Grant, Hopkins, Hunkins, Messersmith, Olin, Parsons, Platt, Price, Tripp and Walker (spk't.)-12. A message from the council by their secretary: "Mr. Speaker: The council have indefinitely postponed

"Resolution to request the governor to return a certain bill to the house of representatives;" and have passed

No. 2, (H.) "Memorial to congress asking an amendment to the act of congress of 29th August, 1842, and for other purposes." And have concurred in the amendment of the house of representatives to the amendment of the council to

No.4, (H.) "Resolution to appoint an agent to receive an appro. priation to replenish the library;"

And have insisted on their amendments to

No. 31, (II.) "A bill to repeal the several acts appointing a treasurer and auditor, and for other purposes;"

And have appointed Messrs. Strong and Frank a committee of conference on the disagreeing vote of the two houses, and desire a conference thereon.

And have passed

No. 30, (C.) "A bill suplementary to an act to provide for the punishment of offences against the public peace," and

No. 33, (H.) “A bill for the relief of the county of Calumet," with an amendment;

In which I am directed to ask the concurrence of this house. Mr. Long, from the committee on onrolled bills, reported as correctly enrolled the undermentioned, to wit:

No. 8, (C.) "Address of the council and house of representatives of the territory of Wisconsin, to the senate and house of representatives of the United States relative to the infringement of the boundaries of Wisconsin;"

No. 44, (C.) "A bill to submit to the people of Wisconsin the question of the expediency of forming a state government;" No. 60, (C.) "A bill to amend the act to incorporate the vil lage of Southport;"

Which were severally signed by the speaker.

Mr. Crossman, from the committee on engrossed bills, reported as correctly engrossed, the following, to wit:

No. 45, (H.) "A bill to erect the towns of Jackson and Palmyra;"

No. 48, (H.) "A bill to enable the county of Winnebago to obtain certain records from the counties of Brown and Fond du Lac."

Mr. Elmore, by leave, presented the account of Messrs. Sheldon & Hyer for printing;

Which was referred to the committee on legislative experdi

tures.

Mr. Elmore also from the same committee to which was referred the account of W. W. Wyman for printing, reported that the committee had disallowed said account, and moved that the report be accepted and the committee discharged from the further con sideration of the subject.

And the question being put thereon,

It passed in the affirmative.

A division being called,

There were ayes 14, noes not counted.

Bills on their third reading being announced by the speaker, The undermentioned were severally read the third time, passed, and the titles thereof agreed to, to wit:

No. 45, (H.) "A biil to erect the towns of Jackson and Palmyra;" and

No. 48, (H.) "A bill to enable the county of Winnebago to obtain certain records from the counties of Brown and Fund du Lac."

On the passage of bill No. 45, above named,

The ayes and noes were called for by Mr. Masters,

And those who voted in the affirmative, were

Messrs. Bartlett, Birchard, Capron, Crossman, Darling, Eilis, Elmore, Grant, Long, Messersmith, Meeker, Olin, Parsons, Platt, and Tripp-15.

Those who voted in the negative, were

Messrs. Hicks, Hopkins, Hunkins, Masters, Price, Thompson, Trowbridge and Walker, (speaker)-8.

On motion of Mr. Ellis,

Ordered, that the undermentioned bill be taken up, and the amendments made by the council thereto, be concurred in, viz: No. 23, (H) “A bill to authorize David Jones and Erastus Bailey to maintain a dam across the Pish-te-go river."

The message from the council was taken up; when

Bill No. 30, (C.) entitled "A bill supplementary to an act to provide for the punishment of offences against the public peace,” Was read the first and second time.

The amendment made by the council to

Bill No. 33, (II.) entitled "A bill for the relief of the county of Calumet,"

Was read and concurred in.

Messrs. Trowbridge and Hopkins were appointed of the committee of conference to which bill No. 31, (H.) "A bill to repeal the several acts appointing a treasurer and auditor, and for other purposes," was referred.

On motion of Mr. Capron,

Bill No. 62, (C.) "A bill to incorporate the village of Geneva," Was taken up and committed to the committee of the whole house.

Mr. Darling, by leave, introduced the following bill, which was read the first and second time; and the rule requiring bills to be printed before being considered in the committee of the whole, suspended, to wit:

No. 51, (H.) "A bill to enable the county of Portage to procure certain records from the county of Brown."

Mr. Ellis moved to reconsider the vote by which the house concurred in the amendments of the council to

Bill No. 23, (H.) "A bill to authorize David Jones and Erastus Bailey to maintain a dam across the Pish-te-go river;"

Which motion was laid on the table.

On motion of Mr. Hunkins,`

The house resolved itself into the committee of the whole house,

Mr. Platt in the chair,

For the consideration of the following bills, memorials, and resolutions, to wit:

No. 6, (C.) "Memorial to congress for the adjustment of land titles and the sale of mineral lands in the Mineral Point land district;"

No. 7, (C.) "Memorial to congress relative to the Wisconsin Marine and Fire Insurance Company;"

No. 19, (C.) "Resolutions relative to printing the laws and journals of the present session, and the reports of the decisions in the supreme court;"

No. 17, (C.) "A bill relating to the district courts in the second and third judicial districts;"

No. 24, (C.) "A bill to amend an act entitled an act concerning justices of the peace, and for other purposes;"

No. 37, (C.) "A bill to amend an act concerning proceedings in courts of record, and for other purposes;"

No. 40, (C.) "A bill to amend an act entitled an act concaring costs and fees;"

No. 50, (C.) "A bill to change the name of Cyrus Manchester Hussy Burgess to Cyrus Manchester Hussy Lay;"

No. 54, (C.) “A bill to change the name of Cordelia Elvin Hood to Cordelia Elvira Burris, and to provide that the said Cordelia shall be the adopted child and legal heir of Martin V. Burris;"

No. 64, (C.) "A bill in relation to certain county officers in St. Croix county;"

No. 62, (C.) "A bill to incorporate the village of Geneva;" No. 30, (C.) "A bill supplementary to an act to provide for the punishment of offences against the public peace:"

After some time spent therein, the committee rose and reported bills Nos. 40 and 62 with amendments, and bilis, memorial and resolution without amendment, as follows: memorial No. 6, resolution No. 19, and bills Nos. 17, 37, 60, 51, 64 and 30, and recommended memorial No. 7 to be indefinitely postponed.

The amendments to bill No. 62 were concurred in, the bill ordered to a third reading, and by special order of the house was read the third time, passed, and the title thereof agreed to.

On the question of the passage of said bill, the ayes and noes were called for by Mr. Hunkins, and

Those who voted in the affirmative, were,

Messrs. Birchard, Capron, Crossman, Elinore, Grant, Hopkins, Long, Manahan, Masters, Messersmith, Meeker, Olin, Parsons, Platt, Price, Tripp, Trowbridge and Walker (speaker)-18.

Those who voted in the negative, were

Messrs. Bartlett, Darling, Ellis, Hicks and Hunkins-5. The amendments to bill No. 40 were concurred in, when Mr. Ellis moved the indefinite postponeinent of said bill, And the question was put, and passed in the affirmative; And the ayes and noes having been called for by Mr. Ellis, Those who voted in the affirmative were,

Messrs. Bartlett, Birchard, Capron, Ellis, Elmore, Hicks, Hunkins, Long, Masters, Messersmith, Olin, Parsons, Platt, Price, Thompson and Tripp-16.

Those who voted in the negative were,
