No. 29, (H.) "Joint resolutions appointing an agent to present certain claims to the treasury department, and ascertain the tertorial indebtedness;"

And the question being put thereon,

It passed in the negative.

And the ayes and noes having been called for by Mr. Platt, Those who voted in the affirmative were,

No. 23, (II.) "Resolutions relative to the WiscoLsa Marine and Fire Insurance Company;"

(Which had laid on the table one day in consequence of the house refusing on yesterday to sustain the previous question)

Mr. Darling moved to amend said resolutions, by submitting the following in lieu thereof, to wit:

"Whereas the legislative assembly of the territory of Wisconsin, at its session in the year 1839, passed an act to incorporate the Wisconsin Marine and Fire Insurance Company,' approved Feb. 28th, 1839, whereby the company so incorporated is authorized to receive money on deposite and loan the same;' [see act of incorporation.]

And whereas, said company have put in circulation certificates of such deposite, having the appearance and similitude of bank bills, to the amount of 52,461 dollars, as shown by their report to a committee of the legislative assembly; [see report of M. C. Darling.]

And whereas, a large majority of the stockholders of the said company are the citizens of a foreign government, and conse quently not amenable to the laws of this territory; [see report of M. C. Darling, page 4.]

And whereas, the community possess no security for the redemption of such issues, beyond the personal integrity and honesty of the present officers of the company; [see act of incorpora. tion,] therefore,

Resolved, That congress be respectfully requested to pass a law, approving and confirming the said act of incorporation, with

such safeguards and restrictions as shall effectually protect the interests of the community against fraud and fraudulent issues, or otherwise to restrict the said corporation to such business operations as were evidently intended to be conferred by the legislative assembly.

Resolved further, That the chief clerk be directed to transmit to the hon. Henry Dodge, an attested copy of the preamble and resolutions, together with a copy of the act of incorporation, certified under the hand of the secretary and seal of the territory; the reports of the several committees upon the subject, and the communications of A. Mitchell, Esq. to the assembly; and that the said delegate be requested to lay the same before both houses of congress."

Mr. Ellis moved to amend the amendment by adding the following, to wit:

Resolved further, That the congress of the United States be asked to take action, similar to that asked for in relation to the Wisconsin Marine and Fire Insurance Company, with regard to the act incorporating the Fox River Hydraulic Company, and any act amendatory thereto, authorizing said company to issue evidences of debt."

On this question Mr. Hunkins moved a call of the house, which was made;

And the sergeant-at-arms sent to notify Messrs. Grant and Palmer that their attendance was desired in the house.

The absentees having appeared in their seats,

Further proceedings under the call of the house were dispensed with;

When Mr. Elmore moved that said resolutions and proposed amendment do lie on the table until the 4th day of July next. And the question being put thereon,

It passed in the affirmative;

And the ayes and noes having been called for by Mr. Ellis, Those who voted in the affirmative, were

Messrs. Capron, Elmore, Hopkins, Hunkins, Long, Messersmith, Olin, Parsons, Platt, Price, Thompson, Tripp, and Walker (speaker)-13.

Secretary:

"Mr. Speaker: I am directed by the governor to deliver to tie house of representatives a message in writing."

The message from the council was taken up,

When the house insisted on its amendment to bill No. 45. (EL) "A bill making appropriations out of the territorial treasury, for the payment of certain debts therein named;" in which amendment the council refused to concur.

The speaker laid before the house a message from the governor, notifying the house that he had on this day approved and deposited in the office of the secretary of the territory, bills and me morials, as follows:

"An act for the relief of the county of Calumet;"

"An act to authorize the construction of certain dams therein mentioned;"

"An act to punish trespass on lands;"

"An act to authorize school district number one, in Dase county, to lay an additional tax for building a school house;" "An act to enable the county of Winnebago to obtain certain records from the counties of Brown and Fond du Lac;" "An act to authorize James Campbell and Robert Stewart to build and maintain a dam on the Sugar river;"

"An act to enable the county of Portage to procure certain re

cords from the county of Brown;"

"Memorial to the congress of the United States, relative to a United States road from Prairie du Chein to La Pointe, on Lake Superior;" and

"Memorial to congress for the indemnification of Elbert Dick

inson."

A message from the council by their secretary: "Mr. Speaker: The governor has notified the council that he has on this day approved the following:

'An act to change the name of Cordelia Elvira Hood, to Cordelia Elvira Burris, and to provide that said Cordelia shall be the adopted child and legal heir of Martin V. Burris;"

'An act to change the name of Cyrus Manchester Hussey Bur gess, to Cyrus Manchester Hussey Lay;'

'An act to incorporate the village of Geneva;' 'An act to amend an act to incorporate the Prairieville Acad

emy;"

'An act relating to the district courts in the second and third judicial districts, and for other purposes;'

'An act to provide for the election of clerks of the boards of supervisors, and for other purposes;'

An act to legalize the official acts of Rollin Blount;"

'An act relating to territorial roads;'

'An to amend an act entitled an act concerning costs and fees;

'An act supplementary to an act to provide for the punishment of offences against the public peace;'

The council have concurred in No. 30, (H.) entited' Resoluluion rescinding No. 15, relative to adjournment,' with an amendment;

In which I am directed to ask the concurrence of this house. And have concurred in the amendments of this house to No. 21, (C.) 'A bill to amend an act entitled an act concerning justices of the peace, and for other purposes;'

And have passed

No. 40, (H.) A bill to provide for the payment of the expenses of the legislative assembly therein mentioned,'

With amendments, in which I am directed to ask the concur rence of this house."

The message from the council was taken up,

When the amendment made by the council to resolution

No. 30, (H.) "Resolution rescinding No. 15, relative to an adjournment,"

Was read and concurred in.

And the amendments made by the council to

Bill No. 40, (C.) "A bill to provide for the payment of the expenses of the legislative assembly therein mentioned," having been read,

The house refused to concur in the amendment of the council which struck out the appropriation to W. W. Wyman for papers furnished the executive office, thirteen dollars and fifty cents;

And concurred in the amendment of the council which struck out the appropriation to W. W. Wyman, for printing for executive office, seventy-six dollars and seventy-five cents.

On the question of concurring in this amendment,

The ayes and nays were called for by Mr. Platt, and

Those who voted in the affirmative, were

Messrs. Agry, Birchard, Crossman, Darling, Elmore, Grat Hunkins, Masters, Meeker, Parsons, Trowbridge and Walker (speaker)-12.

Those who voted in the negative, were

Messrs. Bartlett, Capron, Ellis, Hicks, Hopkins, Long, Olia, Platt, Thompson, and Tripp-10.

Mr. Meeker moved to amend the amendment of the council, by adding the following, to wit:

"To Joseph Jones, for services as sergeant-at-arms, ten dol

lars."

And the question being put on the adoption thereof,
It passed in the negative;

And the ayes and nays having been called for by Mr. Cross

man,

Those who voted in the affirmative, were

Messrs. Darling, Ellis, Elmore, Hicks, Long, Meeker, Par sons, Thompson and Trowbridge-9.

Those who voted in the negative, were

Messrs. Agry, Bartlett, Birchard, Capron, Crossman, Grant, Hopkins, Hunkins, Masters, Olin, Platt, Tripp and Trowbridge

Mr. Hunkins moved to amend the amendment of the council by adding thereto, the following, to wit:

"To John W. Trowbridge, for writing done for the house of

representatives, five dollars;"

Which was agreed to.

Mr. Hicks moved the following amendment, to wit: "To Wm. H. Howe, for two days services as sergeant-at-arms, for the house of representatives, at three dollars per day;" Which was disagreed to.

The amendments of the council as amended by the house

were then concurred in.

On motion of Mr. Platt, The house adjourned.
