MONDAY, January 29, 1814.

Ordered, that the reading of the journal be dispensed with. A message from the governor, by his private secretary, Mr. Charles Doty:

"Mr. Speaker: I am directed by the governor to deliver to the house of representatives a message in writing."

Which the speaker laid before the house, and is as follows: "To the House of Representatives:

The bill entitled 'An act to repeal the several acts appointing a treasurer and auditor, and for other purposes,' I return with the following objections:

It repeals all laws providing for the levying and collecting a territorial revenue; it therefore leaves the public debt without any provision for its payment. This is practical repudiation.

It creates a 'civil office,' and appoints an individual to perform its duties, and receive fees for his services.

This is a violation of the 7th section of the act of congress to establish this territorial government, which confers the power upon the governor and council to appoint all civil officers not provided for in the said act,

A call of the house was made, and Messrs. Agry, Elmore, and Manahan reported to be absent.

On motion of Mr. Hunkins,

Ordered, that Mr. Elmore be excused from further attendance in the house for the remainder of the session.

The sergeant-at-arms was then sent to notify Messrs. Agry, and Manahan that their attendance was desired in the house. Messrs. Agry and Manahan having appeared in their seats, On motion of Mr. Meeker,

Further proceedings in the call of the house were dispensed with.

The bill entitled "An act to repeal the several acts appointing a treasurer and auditor, and for other purposes," having been returned by the governor without his signature, and with his objections thereto,

The question was then put: "Will the house, on reconsideration, pass the said bill?"

And it passed in the negative,

(Two-thirds of the members not voting in the affirmative.) And the ayes and noes were taken, and were as follows: Those who voted in the affirmative were,

Messrs. Birchard, Crossman, Ellis, Grant, Manahan, Masters, Meeker, and Walker (speaker)--8.

Those who voted in the negative were,

A message from the council, by their secretary:

"Mr. Speaker: The council have receded from their amend

ments to

No. 40, (II.) 'A bill to provide for the payment of the expenses of the legislative assembly therein mentioned,'

In the item of thirteen dollars and fifty cents to W. W. Wyman for papers furnished the executive office;

And have concurred in the amendment of this house thereto, appropriating to J. W. Trowbridge five dollars.

The council have passed

No. 2, (H.) ‘A bill relating to real actions, and for other purposes,'

With amendments, in which I am directed to ask the concur rence of this house."

Mr. Parsons, by leave, presented the petition of H. Miller and other inhabitants of the county of Milwaukee, praying for the incorporation of a turnpike company, to be called the “Milwaukee and Fox River Turnpike Company;"

Which was read and laid on the table.

On motion of Mr. Platt,

Ordered, that the undermentioned resolution be taken up for consideration, to wit:

No. 9, (II.) "Resolution concerning the settlement of the ac count therein named."

Mr. Price moved to amend said resolution by striking out all after the word "that," and inserting the following as a substitute: "the sum of two hundred dollars, due from Moses M. Strong, late fiscal agent to the territory, in consequence of an error in the settlement of his accounts, made by a committee of the house of representatives in January, 1810, together with the sum of fortytwo dollars, being three years interest on said sum, amounting in all to the sum of two hundred and forty-two dollars, shall be deducted from the amount to be allowed said Strong on his account against the territory for professionl services; and said deduction when made, shall be a final discharge of the indebtedness of said Strong as fiscal agent."

Pending the question on the adoption of said amendment,

Mr. Ellis moved that said resolutien and amendment do lie on table;

And the question being put thereon,

It passed in the negative;

And the ayes and noes having been called for by Mr. Ellis,
Those who voted in the affirmative, were

Messrs. Bartlett, Birchard, Capron, Darling, Ellis, Grant, Hopkins, Hunkins, Messersmith, Palmer, and Parsons--11.

Those who voted in the negative were,

Messrs. Agry, Crossman, Hicks, Long, Manahan, Masters, Meeker, Olin, Platt, Price, Thompson, Trowbridge, and Walker (speaker)-13.

Mr. Hopkins moved that said resolution and amendment be indefinitely postponed;

And the question being put thereon,

It passed in the negative;

And the ayes and noes having been called for by Mr. Platt,

Those who voted in the affirmative, were

Messrs. Agry, Capron, Darling, Ellis, Hopkins, Messersmith, Palmer, Parsons, Platt, and Tripp-11.

Those who voted in the negative, were

Messrs. Bartlett, Birchard, Crossman, Grant, Hicks, Long, Manahan, Masters, Meeker, Olin, Price, Thompson, Trowbridge, and Walker (speaker)-14.

Mr. Hopkins moved to amend said resolution by striking out all after the word "services;"

And the question being put thereon,

It passed in the negative.

And the ayes and noes having been called for by Mr. Hop kins,

Mr. Hopkins voted in the affirmativę.

Those who voted in the negative were,

Messrs. Agry, Bartlett, Birchard, Capron, Crossman, Darling, Ellis, Grant, Hicks, Hunkins, Long, Manahan, Masters, Messersmith, Meeker, Olin, Paliner, Parsons, Platt, Price, Thompson, Tripp, Trowbridge, and Walker (speaker)—24.

Mr. Ellis then moved that said resolution and amendment do lie on the table;

And the question being put thereon,

It passed in the negative;

And the ayes and noes having been called for by Mr. Ellis, Those who voted in the affirmative, were

Messrs. Bartlett, Capron, Ellis, Messersmith, Palmer, Parsons, Thompson, and Tripp-8.

Those who voted in the negative, were

The question was then put on adopting the amendment proposed by Mr. Price;

And it passed in the affirmative.

And the ayes and noes having been called for by Mr. Platt,

Messrs. Agry, Birchard, Crossman, Darling, Ellis, Grant, Hunkins, Long, Manahan, Masters, Meeker, Parsons, Price, Tripp, Trowbridge, and Walker (speaker)--16.

Those who voted in the negative were,

Messrs. Bartlett, Capron, Hicks, Hopkins, Messersmith, Oli, Palmer, Platt, and Thompson-9.

The resolution as amended was then adopted, and the title thereof agreed to.

A message from the council by their secretary:

"Mr. Speaker: The council have reconsidered their vote by which they concurred in the first amendment of this house to bill

No. 24, (C.) A bill to amend an act entitled an act concerning justices of the peace, and for other purposes,'

And have concurred in said first amendment of this house, with an amendment, in which I am directed to ask the concurrence of this house;

And have also insisted on their amendment to

No. 43, (II.) 'A bill to provide for the leasing of school sections,'

And have appointed Messrs. Rountree and Crocker a committee of conference to which it is proposed to refer the disagreeing vote of the two houses thereon.

And have insisted on its disagreement to the amendment of this house to

No. 46, (C.) A bill making appropriations out of the territorial treasury for the payment of certain debts therein named.' And have concurred in the following bill of this house, to wit: No. 52, (II.) A bill to enable school districts to raise taxes."" The said message from the council was taken up,

And the amendments made by the council to bill No. 2, (H.) "A bill relating to real actions, and for other purposes," were read and concurred in.

And the ayes and noes having been called for by Mr. Platt upon said question,

Those who voted in the affirmative were,

Messrs. Agry, Bartlett, Capron, Crossman, Darling, Grant, Hicks, Hopkins, Hunkins, Manahan, Masters, Meeker, Olin, Parsons, Thompson, Tripp, Trowbridge and Walker (speaker)-18. Those who voted in the negative were,

Messrs. Ellis, Messersmith, Palmer, Platt, and Price-5.

And the council, having insisted on their non-concurrence to the amendment made by the house appropriating to M. M. Jackson, attorney general, $550 00, in bill

No. 46, (C.) "A bill making appropriations out of the territorial treasury for the payment of certain debts therein named;" On motion of Mr. Hunkins,

Ordered, that leave be given to M. M. Jackson to withdraw his said account.

On motion of Mr. Messersmith,

Ordered, that leave be granted to him to withdraw from the files of the house the petition of Charlotte E. Coghlin for a di

vorce.
