Also, a communication on executive business.

Mr. Whiton presented

The petition of certain citizens of Milwaukee, Racine, Rock, and Walworth counties, praying for the passage of laws providing for the election of certain officers, according to an act of congress; Which was referred to the committee on the judiciary.

Mr. Whiton, from the committee on the judiciary, reported Bill No. 23, "A bill for the relief of Philip Schaumburg;" Which was read the first and second time; and,

On motion of Mr. Strong,

So much of the rules of the council, as would require the printing of said bill No. 23, before being considered, were suspended, so far as said bill was concerned.

The message from the governor was then read.

Bill No. 17, "A bill to incorporate the Prairieville Manufacturing Company,"

Was taken up, read the third time, and

On motion of Mr. White,

Laid on the table.

Bill No. 19, "A bill to prohibit public shows for gain without a permit,"

Was then taken up for consideration, and was read the third time, when

On motion of Mr. Crocker,

It was laid on the table.

Joint resolutions No. 3, "Resolutions asking the appropriation of land by congress, for the purpose of establishing within the territory of Wisconsin, institutions for the instruction of the deaf and dumb and blind, and an asylum for the insane," were taken up.

On motion of Mr. Strong,

The resolutions were amended by striking out the word "one," in the tenth line of the first resolution as engrossed; also, the words, "an equal quantity of said," in the fourteenth line of the same; also, the words, "an equal quantity of land," occurring in the sixteenth line of the same.

The resolutions were then read the third time and passed, and the title to the same agreed to.

Mr. Strong offered the following resolution:

Resolved, That the governor be requested to inform the council what are the numbers of the twenty-seven canal bonds, returned at the instance of B. Kilbourn, and received by the governor during the past week.

Which was adopted.

The message from the governor on executive business was then read and referred to the committee on the judiciary.

On motion of Mr. Strong,

The committee of the whole were discharged from the further consideration of bill No. 18, "A bill to provide for the election of a territorial printer."

On motion of Mr. Strong,

The vote by which the committee of the whole were discharged from the further consideration of bill No. 18, was reconsidered. On motion of Mr. Strong,

The council resolved itself into a committee of the whole for the consideration of said bill No. 18;

Mr. Crocker in the chair.

After some time, the committee rose and reported said bill back to the council with amendments, in which they asked the concurrence of the council;

The council concurred in the amendments of the committee of the whole, and the bill was ordered to be engrossed for a third reading.

Bill No. 7, (H. of R.) "A bill to provide for the punishment of embezzling public money;"

Was then taken up and read the first and second time.

Bill No. 13, (C.) "A bill fixing the time of holding the annual session of the legislative assembly, and for other purposes;"

Which had passed the house of representatives with an amendment, was taken up, and the amendment of the house of representatives was concurred in by the council.

Bill No. 1, (H. of R.) entitled "A bill to change the time of holding courts in certain counties of the second judicial district," which had passed the house of representatives with an amendment to the second amendment of the council, was then taken up;

Mr. Crocker moved, that the council recede from its first amendment to said bill;

Which was agreed to.

On motion of Mr. Newland,

The council resolved itself into a committee of the whole, for the consideration of the amendment of the house of representatives to the second amendment of the council to said bill,

Mr. Dewey in the chair.

After some time spent therein, the committee rose, and by their chairman reported back to the council said amendment without amendment, and also recommended that the council disagree to said amendment of the house of representatives;

And the question being, "will the council adopt the report of the committee of the whole?"

The report was adopted, and the amendment disagreed to.

On motion of Mr. Whiton,

The 30th rule of the council was suspended as to bill No. 22, "A bill to authorize Ira Hersey and A. L. Field to build a dam across Rock river," and to No. 21, "A bill to authorize the construction of a dam across Rock river."

On motion of Mr. Whiton,

The council resolved itself into a committee of the whole for the consideration of said bills Nos. 21 and 22;

Mr. Newland in the chair.

After some time the committee rose, and by their chairman reported bill No. 21 back to the council with amendments, and bill No. 22 without amendment.

The council concurred in the amendments of the committee of the whole to bill No. 21,

And the bill was ordered to be engrossed for a third reading. On motion of Mr. Whiton,

Bill No. 22 was laid on the table.

Mr. Whiton, from the select committee to whom was referred the petition of Jesse Miles and others, on leave granted, reported Bill No. 24, "A bill to authorize Clauden Stoughton and Luke Stoughton to build and maintain a dam across the Rock river; and also to suthorize Anson W. Pope and Virgil Pope to build and maintain a dam across said stream."

Mr. Whiton, chairman of the committee on enrollment, by leave, presented the following resolution, viz:

"WHEREAS, it appears by the reports of the joint committee on enrollment, that his excellency the governor, did refuse to receive a bill which had passed both houses of the legislative assembly, entitled "An act to annex certain fractions or lots of land to the town of Rock, in the county of Rock," and did also refuse to receive a certain resolution which had passed both houses of the legislative assembly, entitled "Joint resolution to authorize the cancelling of certain canal bonds," when said bill and resolution were presented to him for his approval;

Resolved, if the house of representatives concur therein, That the said committee be instructed to present the said bill and resolution again to his excellency for his approval."

Which resolution, on motion of Mr. Whiton, was laid on the table.

On motion of Mr. White,

The council took a recess till 2 o'clock, P. M.

TWO O'CLOCK, P. M.

Bill No. 17, "A bill to incorporate the Prairieville Manufacturing Company," was taken up.

On motion of Mr. White,

The blank in the third section of said bill was filled with the words, "J. H. Kimball, S. H. Barstow, and A. W. Randall;"

The blank in the fifth section of the same was filled with the words, "President and;" and

The blank in the eleventh section filled with the words, "make report on the first Monday of May."

The bill was then ordered to a third reading.

On motion of Mr. White,

And by the unanimous consent of the council, the following amendment was added to the bill, viz:

"Section 16. Any person who shall have been made liable as a partner in said company, and has paid any sum of money on account of said liabilities, may have and maintain an action of assumpsit against any or all of the stockholders in said company, to recover from them the proportion due from each respectively of the

demand so paid by him, according to the number of shares by them respectively owned or held, of the stock of said company."

The following message from the house of representatives was delivered by the clerk thereof, viz:

"Mr. President: I am directed to inform the council that the house of representatives have insisted on their amendment to the amendment of this house to bill No. 1, entitled " A bill to change the time of holding courts in certain counties of the second judicial district," and have appointed Messrs Hamilton and Darling a committee of conference on their part; and I am further directed to request the appointment of a like committee by this house, to which it is proposed to refer the disagreement of the two houses on the said amendment."

Bill No. 17 was then read the third time, and the question being on the final passage of the same, the ayes and noes were called. On motion of Mr. White,

A call of the council was ordered.

Messrs. La Chapelle, Newland, Baker, and Hugunin, were reported absent.

On motion of Mr. Strong,

Messrs. La Chapelle and Newland were excused from attendance.

On motion of Mr. White,

Further proceedings under the call of the council were dispensed with.

The question being on the passage of bill No. 17, the result was as follows:

Those who voted in the affirmative, were

Messrs. Baker, Crocker, Newland, White, Whiton, and Martin, (Pres't)-6.

Those who voted in the negative, were

Messrs. Barber, Heath, Rountree, and Strong-4.

So the bill passed the council, and the title to the same was agreed to.

The following message was delivered from the governor, by his private secretary, Mr. Charles Doty, viz:
