Those who voted in the negative, were

Messrs. Barber, Crocker, Dewey and Martin, (Pres't,)—4.

Bill No. 58, "A bill to provide for the payment of certain territorial debts therein named," was then taken up, and

On motion of Mr. Strong,

The bill was re-committed to the committee of the whole.
Mr. Rountree moved that the council adjourn;

Which was disagreed to.

On motion of Mr. Strong,

The council resolved itself into a committee of the whole, for the consideration of bill No. 58;

Mr. Dewey in the chair.

After some time, the committee rose and reported back to the council said bill with amendments, in which they asked the concurrence of the council.

The question being on concurring in the amendments made in committee of the whole, and a division thereof having been called, it was taken upon each amendment separately, as follows:

The first amendment was concurred in;

And the question being on concurring in the second amendment, which was as follows, viz:

"To John Y. Smith, for extra services as commissioner of public buildings, fifty-seven dollars and fifty cents;"

The ayes and noes were called, and it was determined in the negative, as follows:

Those who voted in the affirmative, were

Messrs. Crocker, La Chapelle, Newland, Strong and White-5. Those who voted in the negative, were

Messrs. Barber, Dewey, Heath, Hugunin, Rountree, Whiton, and Martin, (Pres't,)—7.

The third amendment was then concurred in.

The question being on concurring in the 4th amendment, which was by striking out the following, viz:

"For the purpose of paying a reward for the apprehension of William Caffee, charged with the crime of murder, the auditor is directed to issue his warrant on the treasurer of the territory, in

favor of any person who shall make satisfactory proof to him that he has paid said reward, or any part thereof, for the amount so paid: Provided, said warrant shall not exceed in the aggregate the sum of two hundred dollars."

The ayes and noes having been called, and it was determined in the affirmative, as follows:

Those who voted in the affirmative, were

Messrs. Barber. Crocker, Dewey, Newland, Strong, White, Whiton, and Martin (Pres't,)-8.

Those who voted in the negative, were

Messrs. Heath, Hugunin, La Chapelle, and Rountree-4. The question then was on agreeing to the 5th amendment, which was by striking out the following, to wit:

"For the purpose of paying a reward for the apprehension of Edward Jones and Henry V. Moore, fugutives from justice in Racine county, the auditor is directed to issue his warrants on the treasurer of the territory, in favor of any person who shall make satisfactory proof to him that he has paid said reward, or any part thereof, for the amount so paid, provided said warrants shall not exceed, in the aggregate, the sum of two hundred dollars;"

Upon which question the ayes and noes having been called, It was determined in the affirmative, as follows:

Those who voted in the affirmative, were

Messrs. Barber, Crocker, Dewey, Newland, Strong, White, Whiton, and Martin (Pres't,)-8.

Those who voted in the negative, were

Messrs, Heath, Hugunin, La Chapelle, and Rountree-4. The sixth and seventh amendments were then concurred in; And on the question to agree to the eighth amendment, which was by striking out the following, to wit:

“To J. Hathaway and A. W. Hatch, register and receiver of the Milwaukee and Rock river canal, in place of the fees allowed by law, including office rent and copying tract book, one hundred and fifty-five dollars;"

The ayes and noes were called, and it was determined in the negative, as follows:

Those who voted in the affirmative, were

Messrs. Dewey, Heath, La Chapelle, Rountree, Strong, and Martin (Pres't,)-6.

Those who voted in the negative, were

Messrs. Barber, Crocker, Hugunin, Newland, White, and Whiton-6.

Mr. Crocker moved to reconsider the vote, by which the council refused to concur in the amendment of the committee, striking out the item appropriating for George H. Walker, acting canal commissioner, one hundred and ten dollars;

On which motion the ayes and noes were called, and it was determined in the affirmative, as follows:

Those who voted in the affirmative, were

Messrs. Barber, Crocker, Dewey, Hugunin, Newland, Strong, White, and Whiton-8.

These who voted in the negative, were

Messrs. Heath, La Chapelle, Rountree, and Martin (Pres't,)—4. The question then recurring on agreeing to the report of the commitee, by striking out the appropriation to George H. Walker of the sum of one hudred and ten dollars;

The ayes and noes were called, and it was determined in the negative, as follows:

Those who voted in the affirmative, were

Messrs. Heath, La Chapelle, Rountree and Martin, (Pres't,) 4. Those who voted in the negative, were

Messrs. Barber, Crocker, Dewey, Hugunin, Newland, Strong, White and Whiton-8.

Mr. Barber moved that the council adjourn;

Which was disagreed to.

Mr. Hugunin moved to strike out the enacting clause of said bill;

On which motion the ayes and noes were called, and it was determined in the negative, as follows:

Those who voted in the affirmative, were

Messrs. Heath, Hugunin, La Chapelle, Rountree, and Martin, (Pres't,)-5.

Those who voted in the negative, were

Messrs. Barber, Crocker, Dewey, Newland, Strong and White-6. Mr. Barber moved to further amend said bill, by striking out the appropriation to N. Smith, of three dollars and fifty cents, for services in the supreme court clerk's room;

Which was agreed to.

The question then being on ordering said bill to be engrossed for a third reading;

And the ayes and noes being called, the question was determined in the negative, as follows:

Those who voted in the affirmative, were

Messrs. Barber, Crocker, Newland, Strong and White-5.
Those who voted in the negative, were

Messrs. Dewey, Heath, Hugunin, La Chapelle, Rountree and Martin, (Pres't.)-6.

The following message from the house of representatives was delivered by the clerk thereof, viz:

"Mr. President: I am directed to present the following bills and resolution for your signature, to wit:

'An act concerning removals from office;"

'An act to make valid the official acts of Frederick Borcherdt, a justice of the peace;'

·

'An act to provide for laying out and openiug territorial roads;' And a Resolution to rescind a resolution to provide an office for the auditor and treasurer of the territory."

The bills and resolution presented for the signature of the president, referred to in the foregoing message, were then signed by him.

Mr. White moved that the council adjourn;

Which motion was disagreed to.

Mr. La Chapelle moved to reconsider the vote, by which the council refused to order bill No. 65 to be engrossed for a third reading;

Upon which the president announced, that said vote could not be reconsidered without the unanimous consent of the council; the council having once refused to order said bill to be engrossed for a third reading, and then reconsidered said refusal.

The question of reconsideration was then put, and the ayes and noes having been called, they were as follows:

Those who voted in the affirmative, were

Messis. Barber, Crocker, Dewey, Heath, La Chapelle, Newland, Rountree, Strong, White, and Martin (Pres't,)—10. In the negative-Mr. Hugunin.

So the question was lost, there being a negative vote.

On motion of Mr. Strong,

Mr. Hugunin had leave to change his vote on said question of reconsideration, from an affirmative to a negative vote;

So the unanimous consent of the council was given to reconsider the vote by which the council refused to order said bill to be engrossed.

Mr. Crocker then moved, that the council proceed to reconsider the votes by which the amendments made in committee of the whole to said bill were concurred in by the council;

And the ayes and noes having been called, the motion was determined in the affirmative, as follows:

Those who voted in the affirmative, were

Messrs. Crocker, Dewey, La Chapelle, Newland, Rountree, Strong, and Martin (Pres't,)-7.

Those who voted in the negative, were

Messrs. Barber, Heath, Hugunin, and White-4.

The question then recurring on agreeing to the report of the committee, striking out the several appropriations to George H. Walker, A. W. Hatch, and J. Hathaway,

And the ayes and noes having been called, it was determined in the affirmative, as follows:

Those who voted in the affirmative, were

Messrs. Crocker, Dewey, Heath, Hugunin, La Chapelle, Newland, Rountree, Strong, and Martin (Pres't,)-9.

Those who voted in the negative, were

Messrs, Barber and White-2.

Mr. Barber moved that the council adjourn;

Which was disagreed to.

The question then recurring on ordering said bill to be engrossed for a third reading,
