Those who voted in the negative, were

And the motion was determined in the negative.

Mr. Whiton then moved, that the bill be amended by striking hout the words "exclusive of costs," in the second section of said bill;

And the question being on said motion,

Mr. Barber moved to amend the same, by striking out the word "exclusive," and inserting in lieu thereof the word "including;" And the motion was agreed to.

And the question on agreeing to the amendment as amended, then recurring,

Mr. La Chapelle moved that the bill be indefinitely postponed; And the ayes and noes having been called,

Those who voted in the affirmative, were

Messrs. Dewey, La Chapelle, Rountree, Whiton, and Martin (Pres't,)-5.

Those who voted in the negative, were

Messrs. Barber, Crocker, Hugunin, and White-4.

So the bill was indefinitely postponed.

On motion, the council took up bill No. 25, (H. of R.) "A bill to revive the act entitled 'an act for the relief of insolvent debtors,' approved January 13th, 1840;" and,

On motion, said bill was indefinitely postponed.

On motion of Mr. Rountree,

The council took a recess till half-past 7 o'clock, P. M.

HALF-PAST SEVEN O'CLOCK, P. M.

The following message from the house of representatives, was delivered by the clerk thereof, viz:

"Mr. President: I am directed to inform the council that seats have been prepared in the representatives' hall for their reception, preparatory to the election of a committee, upon joint ballot, to ascertain the terms upon which a settlement can be made with the Milwaukee and Rock River Canal Company."

On motion, a call of the council was had, and the sergeant-atarms was sent for the absent members.

The members having taken their seats, further proceedings under the call were dispensed with.

On motion of Mr. Strong,

The council repaired to the representatives' hall, to meet the house in joint convention for the election of a committee of two, by joint ballot, to investigate the affairs of the Milwaukee and Rock River Canal Company, under the joint resolution for that

purpose.

Having returned from the joint convention,

Mr. Newland, the teller on the part of the council, had leave to report, and he thereupon reported

“That the whole number of votes cast in said convention, for the election of a committee under a joint resolution of the two houses, to investigate the affairs of the Milwaukee and Rock River Canal Company, were thirty-six; and that,

Edward V. Whiton received thirty-four votes;

Moses Meeker received eleven votes;

Mason C. Darling received twenty votes;

Albert G. Ellis received one vote;
William S. Hamilton received one vote;
J. H. Manahan received one vote;
Charles M. Baker received one vote;

Col. R. Long one vote;

Blank one vote;

And nineteen votes being a majority of all the votes cast, that Messrs. Whiton and Darling were declared duly elected said committee."

Mr. Whiton gave notice, that on some future day he should ask leave to introduce a bill entitled "A bill to amend an act entitled 'an act to organize certain towns in the counties of Racine and Rock.""

The following messages from the governor was delivered by his private secretary, Mr. Charles Doty, viz:

"To the Legislative Council:

I have approved and signed a bill entitled 'An act to organize the town of Pike, in the county of Racine, and to annex certain land to the town of Southport, in said county;'

And deposited it in the office of the secretary of the territory. J. D. DOTY.

I have approved and signed a bill entitled 'An act to provide for levying and collecting a territorial revenue," and a bill entitled 'An act to amend an act entitled 'an act to provide for the government of the several towns in this territory, and for the revision of county government," and deposited them in the office of the secretary of the territory.

A message from the governor, on executive business, was also received.

Mr. Newland, from the joint committee of conference on the disagreeing vote of the two houses relative to bill No. 65, “A bill to provide for the payment of the expenses of the legislative assembly,' had leave to report, and he thereupon reported as follows, viz:

"The committee of conferrence, to whom was referred the disagreeing votes of the two houses on bill No. 65, (C.) “A bill to provide for the payment of the expenses of the legislative assembly," report

That they recommend to the house to recede from their second amendment to the bill;

To the council to concur in the third amendment to the bill; To the two houses to adopt, as a substitute for the eleventh amendment of the house, the following:-" To John Catlin, for preparing the journals of the house of representatives for publication, for the sessions not heretofore published, affixing an index thereto, and superintending the printing of the same, two hundred dollars."--" To John V. Ingersoll, seventy five dollars, and to John P. Sheldon one hundred and twenty-five dollars, for preparing the journals of the council for publication, for the sessions not heretofore published, affixing an index thereto, and superintending the of the same;"

To the house to recede from their fifteenth amendment;

To the council to concur in the twentieth amendment of the house, with the following amendment:-strike out "two hundred and fifty dollars," and insert "one hundred and fifty dollars;" To the house to recede from the twenty-fourth amendment; To the council to concur in the twenty-fifth amendinent of the house of representatives, with the following amendment, viz:add thereto "To Sheldon & Hyer, for nine hundred and eighty-one copies of the Wisconsin Democrat, furnished the legisla tive council during the last and present session, fifty-eight dollars and eighty-six cents."-" To Sheldon and Hyer, for incidental printing for the house of representatives from the 12th of April to the close of the present session, inclusive, one hundred and twenty-one dollars and sixty-three cents."-" To Seth Van Bergen for furnishing, cutting and hauling to the steps of the capitol, for the use of the legislative assembly, five cords of wood, thirteen dollars and fifty cents."

The said report was laid on the table.

On motion of Mr. Hugunin,

The council proceeded to the consideration of executive business;

And having disposed of the same,

Mr. La Chapelle asked leave of absence for the remainder of the session;

And, on motion, leave was granted.

On motion of Mr. Strong,

The council resolved itself into a committee of the whole, for the consideration of bill No. 49, (H. of R.) "A bill entitled an act in relation to certain actions in ejectment;"

Mr. Barber in the chair,

After some time the committee rose, and reported back to the council said bill with amendments;

In which amendments the council concurred.

On motion, the rule which precluded a third reading of the bill then, was suspended;

And the bill was then read the third time, passed, and the title thereof agreed to.

The following message from the house of representatives was delivered by the clerk thereof, viz:

"Mr. President: The house of representatives have adopted the joint report of the committee of conference on bill No. 65, (of this house,) entitled 'A bill to provide for the payment of the expenses of the legislative assembly.""

Mr. Whiton, from the committee on enrolled bills, reported as correctly enrolled, the following entitled bills and memorials, viz: No. 57, "A bill to amend the act authorizing Samuel H. Farnsworth to build and maintain a dam on the Menominee river;"

No. 52, "A bill in relation to dams on the Manitouwoc river;" No. 64, "A bill to amend the statutes of this territory relative to the sales of land under execution or mortgage, and to legalize certain conveyances;"

No. 36, "A bill to repeal parts of certain acts therein named, and for other purposes;"

No. 50, "A bill concerning the City of the Four Lakes;"

"Memorial of the legislative assembly of Wisconsin, praying that the office of governor may be made elective by the people;" and

"Memorial to congress relative to the expenses of the legislative assembly."

On motion of Mr. Strong,

The council proceeded to the consideration of the report of the committee of conference on bill No. 65, "A bill to provide for the payment of the expenses of the legislative assembly;"

And, on motion, said report was adopted.

The following message from the house of representatives was delivered by the clerk thereof, viz:

"Mr. President: I am directed to present the following bills and memorials for your signature, viz:

'An act concerning the City of the Four Lakes;'

'An act to repeal parts of certain acts therein named, and for other purposes;'
