And the question again recurring on the motion of Mr. Martin, it was put and determined in the affirmative.

On motion of Mr. Newland,

Resolved, That the standing rules of the council of the last session be adopted as the rules of the council at its present session, until others be adopted, except as to the number of officers named in the forty-sixth rule.

The following message from the house of representatives, was delivered by the clerk thereof, viz:

"Mr. President: I am directed to inform you that the house of representatives have organized pro tempore, and are ready to proceed to business."

Mr. Newland presented the following, viz:

Resolved, by the council and house of representatives, that the standing joint rules of the two houses of the last session, be adopted as the joint rules of the two houses at its present session, until others shall be adopted;

And the question being taken thereon, it was determined in the affirmative.

On motion of Mr. Martin,

Resolved, if the house concur, that a joint committee, of two members from each house, be appointed to wait upon his excellency, the governor, and inform him that the two houses of the legislative assembly are temporarily organized, and ready to receive any communication he may have to make to them.

And Messrs. Martin and Whitor were appointed on said committee on the part of the council.

The following message from the house of representatives was delivered by the clerk thereof, viz:

"Mr. President: I am directed to inform the council that the house of representatives have adopted the joint rules of the two houses of the last session, for the government of the two houses at their present session, until others are prepared and adopted; and have appointed Messrs. Walker and Hopkins of the committee on their part, to wait upon his excellency, the governor, and to inform him that the two houses are now temporarily organized and ready to receive any communication he may have to make to them."

Mr. Martin, from the joint committee appointed for the purpose, made the following report, viz:

"The joint committee, appointed to wait upon his excellency, the governor, and inform him that the two houses of the legislative assembly are now temporarily organized, and ready to receive any communication he may have to make to them, report: that they have discharged the duty assigned them, and that the governor informed the committee, that 'not conceiving that the legislative assembly had authority by law to meet at the present time, he had no communication to make to them;"

Which was read, and

On motion of Mr. Newland,

Ordered, to be laid on the table.

On motion of Newland,

The council adjourned until 10 o'clock to-morrow.

TUESDAY, December 6, 1842.

The following message from the house of representatives was delivered by the clerk thereof, viz:

"Mr. President: The house of representatives have passed a 'resolution relative to the appointment of a joint committee to inquire into the legality of holding a session of the legislative assembly at the present time,' in which I am directed to ask the concurrence of this house."

The resolution referred to in the foregoing message was thereupon read a first and second time; and,

On motion of Mr. Whiton,

The council was resolved into committee of the whole, Mr. Dewey in the chair, for the consideration of said resolution; and after a short time the committee rose and reported the same with an amendment.

The amendment was concurred in, and the resolution was, on motion, ordered to a third reading.

The resolution was thereupon read a third time and passed, and the title thereof agreed to.

The president laid before the council the report of John Y. Smith, commissioner of public buildings, together with accompanying documents. [SEE APPENDIX "A."]

Which was read; and,

On motion of Mr. Martin, Ordered, to lie on the table.

The following message from the house of representatives was delivered by the clerk thereof, viz:

"Mr. President: The house of representatives have concurred in the amendment of the council to the 'resolution relative to the appointment of a joint committee to inquire into the legality of holding a session of the legislative assembly at the present time;' and have appointed Messrs. Darling, Tripp and Meeker, of the committee on their part, under the said resolution."

The president thereupon appointed, on the part of the council, Messrs. Crocker, Martin and LaChapelle, of the committee referred to in the foregoing message.

On motion of Mr. Newland,

Ordered, That the report of the joint committee appointed to wait upon the governor, made on yesterday, be taken up and referred to the joint committee just appointed.

On motion of Mr. Martin,

The council took a recess until 4 o'clock, P. M.

FOUR O'CLOCK, P. M.

On motion of Mr. Baker,

Ordered, That the council do now proceed to the choice of a president.

Messrs. Rountree and Newland were appointed tellers;

And the ballots having been received and counted by the tellers

appointed for that purpose, it appeared that

Moses M. Strong had received five votes;

Neither of the persons voted for having received a majority of

the whole number of votes given, the president declared that no election had been made.

The council thereupon proceeded to a second ballot;

And, the ballots being again taken and counted by the tellers appointed for that purpose, it appeared that

Moses M. Strong had received five votes;

On motion of Mr. Baker,

Ordered, That further ballotings for president be postponed until to-morrow.

Mr. Crocker offered a resolution, as follows:

Resolved, That William W. Wyman be appointed to do the incidental printing of the council, until otherwise ordered.

And, pending the question thereon,

Mr. Martin moved to amend the resolution by striking out the name of "William W. Wyman," and inserting in place thereof the name of "John Delany."

And the question being taken thereon, it was determined in the negative-ayes 4, noes 6.

And the ayes and noes being called for,

Those who voted in the affirmative, are

Messrs. LaChapelle, Martin, Newland and Strong.

Those who voted in the negative, are

Messrs. Baker, Barber, Crocker, Rountree, White and Whiton.

The question then recurred on the adoption of the resolution pending, and it was decided in the affirmative-ayes 7, noes 3. And the ayes and noes being called for,

Those voted in the affirmative, are

Messrs. Baker, Barber, Crocker, LaChapelle, Rountree, White and Whiton.

Those who voted in the negative, are

Messrs. Martin, Newland and Strong.

Mr. Newland gave notice of an intention, at a future day, to

bring in a bill to alter the time for holding the district court in Walworth county.

Mr. Crocker moved that three hundred copies of the report of the commissioner of public buildings, together with the accompanying documents, be printed.

And pending the question on this motion,

Mr. Whiton moved to amend the same by striking out "three hundred" and inserting "one thousand" in place thereof; Which was disagreed to-ayes 1, noes 9. And the ayes and noes being called for, Mr. Whiton voted in the affirmative. Those who voted in the negative, are

Messrs. Baker, Barber, Crocker, LaChapelle, Martin, Newland, Rountree, Strong and White.

The question then recurred on the motion of Mr. Crocker, and it was decided in the affirmative.

Mr. Whiton gave notice of an intention to ask leave, at a future day, to introduce a bill to amend an act entitled "ar. act to amend the several acts to provide for the support of common schools." On motion of Mr. Baker,

The council adjourned.

WEDNESDAY, December 7, 1842.

The president laid before the council a special report of the register and receiver of the Milwaukee and Rock river canal; which was read and, on motion, laid on the table. [SEE APPENDIX "B."]

On motion of Mr. Barber, it was

Ordered, that the council proceed to the election of a president.

Whereupon Messrs. Newland and Rountree were appointed tellers.

And, the ballots being again taken and counted by the tellers appointed for that purpose, it appeared that
