Mr. Whiton presented

A remonstrance against the petition from citizens of Beloit and Clinton, praying for a town to be set off;

Which was referred to the select committee, consisting of Messrs. Whiton, Baker and Barber, to whom the petition on the same subject had been referred.

Also, a petition from H. G. Spencer;

Which was referred to the committee on incorporations.

Mr. Martin, chairman of the committee on the judiciary, moved that said committee be discharged from the further consideration of a petition of Rand and others, for dividing the town of Elkhorn; also, of the petition of inhabitants of Genesee, for a division of said town; also, of the remonstrance of R. B. Burroughs and others; also, of the petition of certain citizens of Troy; also of the proceedings of a meeting held at Hart Prairie;

The motion was agreed to,

And, on motion, said petitions and remonstrance were referred to the committee on incorporations.

Mr. Martin, from the committee on the judiciary, reported bill No. 9, "A bill to legalize the proceedings of the inhabitants of Winnebago county, in the organization of said county;"

Which was read the first and second time.

And, on motion, so much of the rules of the council as prevent the reading of the same the third time before being printed and considered in committee of the whole, were dispensed with so far as the said bill was concerned.

Mr. Crocker, from the committee on territorial affairs, to whom was referred bill

No. 2, "A bill to provide for the appointment of a superintend ent of territorial property, and for other purposes,"

Reported the same with an amendment.

Mr. La Chapelle, from the committee on engrossed bills, reported bill

No. 5, "A bill authorizing clerks to issue certificates to jurors and witnesses;"

As correctly engrossed.

Mr. Hugunin, from the committee on schools, reported bill
No. 3, "A bill relative to taxes for school purposes,"

With amendments.

Bill No. 5, was then called up, and, on motion, read the third time.

On motion of Mr. Baker,

It was laid on the table.

Mr. Martin, on leave, introduced bill

No. 10, "A bill to change the boundaries of certain towns therein named;"

Which was read the first and second time.

On motion of Mr. Martin,

So much of the 29th rule of the council as requires bills to be printed before being considered in committee of the whole, was suspended so far as the bill under consideration was concerned. Mr. Newland, on leave, introduced bill

No. 11, "A bill to repeal so much of an act supplementary to the several acts relating to the Milwaukee and Rock river canal, approved February 12, 1841, and such other acts or parts of acts, as authorize the sale of canal lands and issuing bonds to aid in the construction of said canal;"

Which was read the first and second time.

On motion, so much of the rules of the council as require the printing of bills and joint resolutions before being considered in committee of the whole, was suspended so far as said bill was concerned.

Mr. Newland, on leave, introduced bill

No. 12, "A bill to amend an act to prevent trespass and other injuries being done to the possessions of settlers on public lands, and to define the right of possession on said lands, approved January 4th, 1840."

Mr. Barber, on leave, introduced bill

No. 13, "A bill fixing the time of holding the annual sessions of the legislative assembly, and for other purposes;"

Which was read the first and second time.

On motion of Mr. Martin,

The council resolved itself into a committee of the whole for the consideration of bill No. 10;

Mr. Whiton in the chair;

After some time the committee rose, and by their chairman reported the same back to the council without amendment.

The report of the committee of the whole was concurred in by the council, and the bill was ordered to be engrossed for a third reading.

On motion of Mr. Whiton,

The council resolved itself into a committee of the whole, for the consideration of bill No. 4, “A bill to annex certain fractions or lots of land to the town of Rock, in the county of Rock;"

Mr. Hugunin in the chair.

After some time, the committee rose and reported the same back to the council without amendment;

The report of the committee of the whole was concurred in, and the bill ordered to be engrossed for a third reading.

On motion of Mr. Rountree,

The council resolved itself into a committee of the whole for the consideration of bill

No. 2, "A bill to provide for the appointment of a superintendent of territorial property, and for other purposes;"

Mr. Baker in the chair.

And pending the consideration thereof, the chief clerk of the house of representatives was announced, when the president resumed the chair, and the following message was received, viz:

"Mr. President: The house of representatives have passed a resolution relative to referring certain papers to a joint committee, and have appointed on their part, under the same, Messrs. Agry and Meeker, in which the concurrence of this house is asked."

The committee of the whole then resumed their session; and after some time rose and reported said bill back to the council with amendments;

In which report the council concurred; and the bill was ordered to be engrossed for a third reading.

Mr. Barber moved that the message of the governor, transmitted to the council March 11, 1843, be taken up;

And, on motion, the same was referred to the committee on ter ritorial affairs.

On motion of Mr. Hugunin,

The council resolved itself into a committee of the whole for the consideration of No. 3, "A bill relative to taxes for school purposes;"

Mr. Crocker in the chair.

After some time the committee rose, and reported the same back to the council with amendments, in which they asked the concurrence of the council;

And in which the council concurred.

On motion of Mr. Martin,

Said bill was then committed to the select committee on township government.

On motion of Mr. Hugunin,

The council adjourned.

TUESDAY, March 14, 1843.

The council met pursuant to adjournment.
The journal of the previous day having been read,

The following message from the house of representatives was delivered by the clerk thereof, viz:

"Mr. President: I am directed to present for the concurrence of this house, the following bill, viz: No. 1, 'A bill to change the time of holding courts in certain counties of the second judicial district,' which has been passed by the house of representatives."

Mr. Whiton presented,

A petition from Jesse Miles and others, praying for the privilege of building a dam across Rock river; also,

A petition from Harrison Stebbins and others, for the same purpose;

Which were referred to the select committee composed of Messrs. Whiton, Baker and Barber.

Mr. Whiton also presented,

The petition of Lyman Morse and others, praying for the setting off of a town to be called "Franklin;"

Which was referred to the committee on incorporations.

Mr. Baker gave notice, that he should at some future day, introduce "a bill for the preservation of deer."

Mr. Martin, chairman of the committee on the judiciary, reported from said committee,

No. 44, “a bill to amend the sct of the Revised Statutes, entitled 'an act relating to the judicial districts;""

Which was read the first and second time.

Also, No. 15, “a bill to regulate the fees of clerks in cases of naturalization,"

Which was read the first and second time.

Also, "joint resolution to authorize the cancelling of certain canal bonds;"

Which was read the first and second time.

Mr. Martin, from the same committee, also submitted the report of said committee, adverse to the petitions of Adhelaid Deisuer, and of Thomas Fowlston, praying for divorces.

On motion of Mr. Newland,

Bill No. 6," a bill to authorize the register of deeds of Washington county to procure copies of certain records from the office of register of deeds of Milwaukee county," was taken up, and

On motion, said bill was ordered to be engrossed for a third reading.

On motion of Mr. Martin,

Bill No. 9, "a bill to legalize the proceedings of the inhabitants of Winnebago county," &c.

Was read the third time and passed;

And the title thereof was then agreed to.

On motion of Mr. Newland,
