CITY CLERK.

SEC. 35. There shall be a City Clerk elected as hereinbefore provided. He shall be clerk of the Board of Aldermen and of its committees and of the Boards of Finance, Public Safety, and Health, and shall record their doings. He shall send, immediately after it takes effect, a copy of any ordinance, resolution or order of the Board of Aldermen, and any resolution or order of any board or committee of which he is clerk, to each department or officer affected thereby. He shall issue all notices and warnings of the meetings of the Board of Aldermen, the Boards of Finance, Public Safety, and Health, and of the committees of each of said boards, which notices and warnings shall be given or served as may by ordinance be provided, and shall perform such other clerical services as may be required by the ordinances of the city. He shall publish all city ordinances as soon as the same are enacted, and record the fact and date of such publication. He shall make, upon the records of said city, entries of his own acts in serving and publishing notices of orders passed by the Board of Aldermen. Said clerk shall devote his entire time to the service of the city, and shall have no other occupation during his term of office; and he shall keep his office open during such hours of each business day as the ordinances of the city shall direct.

SEC. 36. Said clerk may, with the approval of the Mayor, appoint an Assistant City Clerk, whose compensation shall be fixed by the Board of Aldermen, and who, after having taken the oath or affirmation provided by law for said clerk, shall assist said clerk, and, in the absence or disability of said clerk, shall have all of the powers and duties of said City Clerk. All acts of said Assistant Clerk, and all records kept by him, shall have the same validity and effect as acts and records of the City Clerk. Said Assistant Clerk may be removed by the City Clerk at any time, with the Mayor's approval.

SEC. 37. All records hitherto kept, or which may here- Validity of after be kept, by any clerk of said city, shall have the same validity as the records of Town Clerks, and shall be in all courts prima facie evidence of the truth of the matters therein recorded. Of any official record hitherto kept, or which may hereafter be kept, by any clerk of said city, or by any Assistant Clerk thereof, a copy certified under the hand of any such recording officer shall be received in all courts as evidence, in the same manner as the original record would be received.

TREASURER.

SEC. 38. There shall be a Treasurer, who shall be elected as hereinbefore provided, who shall have the same power and authority as Town Treasurers have, and shall be accountable to said city. He shall give bonds in the amount of forty thousand dollars.

SEC. 39. All city funds shall be deposited in such bank or banking institution as shall be designated by the Board of Finance, whose duty it shall be to obtain the highest rate of interest therefor consistent with the safety of deposits. All interest upon said deposits shall belong to said city.

SEC. 40. All city funds shall be deposited in the bank or banking institution by him within twenty-four hours after he receives them, but the hours of any Sunday or holiday shall not be counted, and he shall obtain from the bank or other institution where such deposit is made duplicate receipts for the money so deposited, one of which duplicates shall be filed with the Comptroller within twenty-four hours after the deposit is made, but the hours of any Sunday or holiday shall not be counted.

SEC. 41. The Treasurer shall pay all orders drawn on him by the City Clerk and countersigned by the Mayor and the Comptroller, in the order in which they shall be presented to him. When it shall happen that there is not money in the treasury sufficient to pay all the orders presented, he shall number and register said orders in the order in which they shall be presented to him, and shall on no pretense pay or advance money upon a subsequent order until he shall have money in the treasury sufficient to pay all orders prior in number on his register.

SEC. 42. The Treasurer shall report to the Board of Finance, at the first regular meeting thereof in each month, the amount of money belonging to said city in his hands. and the sources from which it was received, and shall present to said board, each month, his accounts for the month next preceding, properly audited and certified by the Comptroller.

SEC. 46. SEC. 47. He shall keep a separate account of each specific Separate item of the appropriations, and shall require all warrants to state specifically against which of said items the warrant is drawn. Each account shall be accompanied by a detailed statement in a separate column, of the unpaid contracts and outstanding orders charged against it.

drawn, or the appropriation for one item of expense to be drawn upon for any other purpose, or by any department other than that for which the appropriation was specifically made, except in case of transfers made as is hereafter provided. No warrant shall be issued unless sufficient funds to pay the same shall actually be in the treasury. If he shall certify any bill, contract, or claim in excess of the appropriation properly applicable thereto, the city shall not be liable for such excess, but he shall be personally liable therefor, and his sureties shall also be liable to the amount of his bond. SEC. 49. The Comptroller shall give bonds in the amount of twenty-five thousand dollars to the City of Waterbury. He shall have an office in the City Hall, and shall keep the same open during such hours as the Board of Finance may direct. In case of the absence, inability, or disability of the Comptroller, the Mayor shall have the power to appoint some person to perform his duties temporarily.

SEC. 50. The Comptroller shall, at the end of each fiscal year, or oftener if directed by the Board of Finance, and also upon the death, resignation, removal, or the expiration of the term of any officer, audit, or cause to be audited, examine, and settle the accounts of such officer and if he shall be found indebted to the city, the Comptroller shall state an account and file the same with the City Attorney, together with a copy of the official bond of such officer, if any, and give notice thereof to him or his legal representatives; and the City Attorney shall proceed to collect such balance from such officer or his sureties within six months from the receipt of such account. Notice of the audit shall be given by the Comptroller to the officer or his legal representatives before the final statement of the account; and, if desired by such officer or his legal representatives, opportunity shall be given for a hearing. A copy of such notice, with an affidavit to the fact of service thereof, shall be filed with the statement of account, as evidence of service of notice.

SEC. 51. The Comptroller shall be the purchasing agent for said city and all its departments, and no claim for any article furnished said city or any of its departments shall be
