I. Proprietors of lands fronting on street to be notified before pavement is laid; connection with sewers, water and gas mains Board of Public Works may make such connection if their notice is neglected; unless otherwise ordered by the Board of Aldermen. 3. Be it ordained by the Board of Aldermen of the City of Water

bury:

SECTION I. Whenever an order shall have been passed for paving or repaving with wood, stone or other material any street or streets of the city, in or through which there shall be. before the execution of such order, any sewer or any gas or water mains laid down, it shall be the duty of the Board of Public Works to examine the land and buildings upon said street, to prescribe the connections proper to be made with such sewer, gas or water mains by the proprietors of such lands, and to give to such proprietors reasonable notice, requiring them to make such connections before such pavement is laid or relaid, as the case may be.

SEC. 2. If the requirements of said notice shall not be complied with, it shall be and hereby is made the duty of said board, unless otherwise ordered by the Board of Aldermen, to cause all such connections so ordered by them as aforesaid, to be made, and the expense of making the same shall be paid by the proprietors of said lands respectively, and shall be a lien upon said lands in favor of said city, to be secured and enforced in the manner now provided by the charter and ordinances of the city in other cases.

SEC. 3. No person or corporation shall make, or cause to be made, any opening, aperture, or excavation for any purpose whatever, in any street or sidewalk in said city, without permission from the Superintendent of Streets, upon written application therefor, as provided in the ordinance concerning licenses and permits. Any person violating, or causing or procuring a violation of any of the provisions of this section, shall forfeit and pay a penalty of not less than ten nor more than one hundred dollars for every such violation.

SEC. 4. The Board of Public Works shall issue licenses to such persons as may be deemed competent by said board, to make all necessary connections with gas mains, water mains, steam supply pipes, and public sewers. The application for said license shall be accompanied by a bond to the City of Waterbury, acceptable to said Board of Public Works, for the proper performance of the work, the restoration of the street to its former condition, and the indemnification of the city against all damages that it may be compelled to pay, or shall in fact pay, for injuries sustained in consequence thereof, and for all cost which the city may incur in doing any work in connection with the restoration of said street.

SEC. 5. Whenever any person or corporation shall, in pursuance of the provisions of the two next preceding sections, take up any portion of any pavement, or make any excavation in any street, paved or unpaved, or make any connection with any water main, gas main, steam supply pipe, or public sewer, it shall be the duty of the person or persons taking up such pavement or making such excavation or connection, as soon thereafter as practicable, to restore such pavement, and to fill such excavation, and to tamp or puddle the earth placed therein, so that the same shall not settle; and to put such street and pavement in as good condition, in all respects, as they were in before such pavement was taken up or such excavation or connection made, all of which shall be done to the acceptance of the Superintendent of Streets, and the Board of Public Works may, if they see fit, refill such excavations and replace such pavement and collect the cost of the same from the licensee. Any person offending against any of the provisions of this

section, shall forfeit and pay a penalty of not less than ten nor more than one hundred dollars for every such offense.

SEC. 6. When any excavation is made in any street, the person or persons by or for whom such excavation is made, shall cause a rail or other sufficient fence to be placed and fixed so as to enclose such excavation, and the earth, gravel, or other material thrown into the street therefrom; and such fence shall be continued during the whole time such excavation shall be open. And a sufficient number of lighted lanterns to provide for public safety, shall be fixed to some part of such fence, or in some other proper manner over or near such excavation, and the earth, gravel or other material taken from the same, and so kept from the beginning of the twilight of the evening through the whole of the night, and shall be continued every evening and night during all the time such excavation shall be open or in state of repair, and said person or persons shall obey any order of the Superintendent of Streets with regard to the number or positions of said lanterns. Any person offending against any of the provisions of this section shall forfeit and pay a penalty of not less than ten nor more than one hundred dollars for every such offense.

SEC. 7. Every person intending to erect or to repair any building upon any land abutting on any of the streets of said city, may receive a license to occupy a portion of such street for building materials in the manner, and upon such terms and conditions as provided in the ordinance concerning licenses and permits, and in all cases the portion so allotted shall be enclosed and lighted as prescribed in section six.

SEC. 8. Any person duly licensed or permitted to occupy any part of any street, while erecting or repairing any building, or making excavations in any street, for any purpose, shall provide safe and convenient passage around or over the same for public travel, and shall keep such passage free from stone, earth, bricks or any other material which shall be a hindrance to public travel, and shall obey any order of the Superintendent of Streets in relation thereto, shall not obstruct the street gutters in any manner so as to prevent or retard the flow of water therein, and shall be responsible to said city for
