SEC. 52. The Superintendent of Streets shall not use any teams or laborers in the employment of and paid by the City of Waterbury for the performance of any work, labor or service for any person, persons or corporations other than said city, except in cases where the requirements of the charter and ordinances of said city make the performance of such work, labor or service necessary for such persons as neglect or refuse to comply therewith.

SEC. 53. This ordinance shall not be so construed as to prevent or preclude the Superintendent of Streets, with and by the consent or direction of the Board of Public Works, from obtaining gravel or other material for use on the streets of said city from the lands of any person, persons or corporations, by digging cellars or grading lots whence such gravel or material may be obtained. Every person neglecting to comply with the provisions of this section shall forfeit and pay a penalty of not exceeding ten dollars for every such offense.

SEC. 54. Hereafter, when any curb is ordered laid in any public street of this city, it shall not be less than five inches in thickness, eighteen inches in depth, and in pieces not less than four feet long.

SEC. 55. If the proprietor or proprietors of any land or building fronting any highway or street in said city shall neglect or refuse to perform the thing or things required by any order of the Board of Aldermen for the making, grading, paving or flagging, or the repairing of any sidewalk in said city adjacent to said land or building in the manner and within. the time specified in such order, he or they shall forfeit and pay for each offense a penalty not exceeding ten dollars, and a penalty not exceeding one dollar for each week while such refusal or neglect shall continue.

SEC. 56. Whenever the word "street" or "streets" is mentioned in this ordinance it shall be understood as including alleys, lanes, courts, greens, public squares and public places, and it shall also be understood as including the sidewalks, unless the contrary is expressed or such construction would

be inconsistent with the manifest intent of the Board of Aldermen.

SEC. 57. Any person violating any of the provisions of this ordinance excepting where a different penalty is otherwise specially provided in any section thereof, shall forfeit and pay a penalty of not less than two nor more than fifty dollars for every such offense, and a like penalty for each day's continuance thereof.

AN AMENDMENT TO THE ORDINANCE ENTITLED "STREETS," CONCERNING THE COVERING

Be it ordained by the Board of Aldermen of the City of Waterbury:

The ordinance of this city entitled "Streets," is hereby amended by adding thereto the following sections:

SECTION I. The owner of any lot or building in front of which there may be a sidewalk built, constructed, or composed, wholly or in part, of glass, iron, or other substance liable to become slippery by use or wear, shall cause said sidewalk, or such portion thereof as shall be so built, constructed, or composed, to be kept at all times fully and thoroughly covered, to the satisfaction of the Superintendent of Streets, with some suitable material or covering for the purpose of preventing slipping thereon.

SEC. 2. All iron covers or doors for coal holes, coal shutes, or hatchways, situated in any sidewalk in this city, shall in like manner be kept covered with some suitable material or cover, to the satisfaction of the Superintendent of Streets.

SEC. 3. Any person who shall neglect or refuse to comply with the provisions of the foregoing sections within five days after notification by the Superintendent of Streets thereto, shall forfeit and pay a penalty of not less than two dollars nor more than ten dollars for each week while such refusal or neglect shall continue.

Be it ordained by the Board of Aldermen of the City of Waterbury:

SECTION I. The Board of Finance shall annually, during the first week of the month of December, submit to the Board of Aldermen an estimate of the expenses, liabilities and resources of said city for the year beginning on the first day of January next succeeding, giving the particulars, as far as practicable, and recommending such tax on the ratable estate within the limits of said city, as they shall deem necessary to meet such expenses.

SEC. 2. Said Board of Aldermen having made such alterations in said estimates and rates as they shall deem proper, shall, before the twentieth day of said month of December, lay such taxes and appropriate the proceeds thereof to the several purposes aforesaid. Said taxes shall be based upon the ratable estates within the limits of said city on the grand list of the Town of Waterbury, next last completed.

SEC. 3. Whenever said Board of Aldermen shall deem it necessary to lay a special tax, estimates shall be submitted in like manner as for an annual tax. The Board of Aldermen may authorize the Collector of Taxes to discount any special tax of any person or persons, when paid before the first day of July next following the laying thereof.

SEC. 4. In no case shall said Board of Aldermen or the Board of Finance of said city allow the expenses of said city to exceed the amount of taxes and assessments previously laid for the current year, together with the current income from other sources, except in cases and for purposes for which said city is authorized by particular act of the Legislature of Connecticut to issue bonds and when bonds are issued therefor.

SEC. 5. Whenever any tax has been laid as aforesaid, the Board of Finance with the Mayor shall prepare and sign a proper rate bill therefor.

SEC. 6. Said Board of Finance and Mayor shall cause such rate bill with a proper warrant for the collection of such tax to be delivered to the collector of said city.

SEC. 7. The Board of Aldermen may by vote abate the taxes assessed upon such persons as are poor and indigent, causing a proper entry thereof to be made on their records, and a certificate thereof to be delivered to the collector.

SEC. 8. The Board of Aldermen may from time to time establish a sinking fund, or sinking funds, to provide for or reduce any indebtedness of said city, and said board may from time to time make such appropriation to such fund as they may deem proper from the taxes or surplus of said city.

SEC. 9. The Collector of City Taxes shall pay over to the City Treasurer all taxes collected by him each day, and shall settle up his tax book and pay over to the City Treasurer the balance due thereon at such time after one year from the date when such taxes became due, as may in each case be required by the Board of Aldermen of said city.
