AN ACT AMENDING THE CHARTER OF THE CITY

OF WATERBURY TO PROVIDE A SINKING

FUND FOR CERTAIN BONDS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

SECTION I. The Board of Aldermen of the City of Waterbury, for the purpose of providing a sinking fund for the payment of two hundred thousand dollars of Water Bonds, Fourth Series, due July first, 1910, shall, during the month of December, 1899, as a part of the regular appropriations of the said city for the ensuing year, make an appropriation of the amount of twenty thousand dollars to be paid to the Treasurer of the Sinking Fund of said city, and during the month of December in each successive year until and including the month of December, 1909, as a part of the regular appropriations for the said city for the then ensuing years, make an appropriation of a like amount of twenty thousand dollars to be paid to the Treasurer of the Sinking Fund of said city.

SEC. 2. The entire amount of said appropriations made as aforesaid shall be kept as a sinking fund for the purpose of paying, retiring, and canceling water bonds of said city, to the amount of two hundred thousand dollars, known as Water Bonds, Fourth Series; all interest derived from said appropriations made as aforesaid, shall be kept by said Treasurer of the Sinking Fund as a separate account, and shall be by him invested and reinvested in accordance with the terms of the charter of said city, and shall, after the payment of the said Water Bonds, Fourth Series, continue and remain as a portion of the sinking fund to provide for the payment of the water bonds of said city, known as Water Bonds, Third Series.

AN ACT AMENDING THE CHARTER OF THE CITY OF WATERBURY TO EQUALIZE THE

WARDS THEREOF.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

SECTION I. On and after the first day of July, 1899, all that part of the second ward of the City of Waterbury lying northerly of the line in the center of West Main Street, and westerly of the line running from the point of intersection of the center line of West Main Street and North Willow Street, through and along the center line of North Willow Street to the city limits, shall be and remain a portion of the third ward of said city. All that part of the first ward of said city lying northerly of the line in the center of East Main Street and southeasterly and southerly of the line running from the point of intersection of the center line of East Main and Wall Streets, through and along the center line of Wall Street to the city limits, shall be and remain a portion of the fifth ward of said city.

SEC. 2.

This act shall take effect from its passage.

AN ACT AMENDING THE CHARTER OF THE CITY OF WATERBURY FOR THE APPORTIONMENT OF THE HIGHWAY TAX.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

In all cases whenever a tax shall be laid or a sum of money shall be appropriated by the Town of Waterbury for the purpose of making, maintaining, or repairing the highways and roads in said town, it shall be the duty of the Selectmen of said town together with the Mayor of the City of Waterbury and two members of the Board of Aldermen of said city, to be appointed for such purpose by the President of said Board of Aldermen, to meet within thirty days from the time of the laying of any such tax or the appropriating of any such money and to determine, by a majority vote of the whole number, the portion thereof which shall be applied to the making, maintaining, or repairing of the highways and streets within the limits of said city, and in case said Selectmen and Mayor and Aldermen cannot agree within said time, by majority vote, as aforesaid, upon such apportionment, that Judge of the Superior Court who shall hold court in Waterbury next after the expiration of the time of the meeting of said Selectmen, Mayor, and Aldermen for the above purpose, shall be called in to give the deciding vote. The sum of money thus apportioned shall be paid by the Treasurer of said town into the treasury of said city within thirty days after such apportionment, and said town shall not be obliged to make or repair any highway or street within the limits of said city; provided, always, that the Town of Waterbury shall be required to make, build, and keep in repair the bridges over the Naugatuck and Mad Rivers, to the same extent as if this act had not been passed.

CONCERNING THE BUCKS HILL SCHOOL DISTRICT OF WATERBURY.

Resolved by this Assembly:

That all that part of the Bucks Hill School District of the Town of Waterbury lying on the southerly side of a line drawn from the southwesterly corner of said district to a point in the Bucks Hill highway opposite the dividing line between property of Henry Simpkins and E. Goodenough, adjacent to said highway, and from thence easterly to the southeast corner of said district, with all persons now and hereafter residing on said territory, be and hereby are transferred to the Center School District of the Town of Waterbury, to which latter district they shall hereafter belong.

AN ACT IN ADDITION TO AN ACT REVISING AND AMENDING THE CHARTER OF THE

CITY OF WATERBURY.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

SECTION I. The territorial limits of the body politic and corporate existing under the name of The City of Waterbury shall hereafter include all land and territory situated within the limits of the Center School District of Waterbury as now or hereafter defined.

SEC. 2. There shall be in the City of Waterbury a Department of Education which shall have the care and management of all the property and affairs of the Center School District of Waterbury. After this act shall take effect no meeting of said Center School District shall be held for any purpose whatever.

SEC. 3. Said department shall be under the control of the Board of Education, consisting of the Mayor, who shall be ex officio chairman, and seven members, who shall be elected biennially at the meetings of said city for the election of officers; and for this purpose separate ballots shall be provided in the several voting places in said city. The terms of office of said members shall begin on the first Monday of January next following their election, and the provisions of the charter of said city in relation to the powers and duties of city officers shall apply to said members.

SEC. 4. No person shall vote for more than four members of the Board of Education. If any ballot found in said boxes shall have the names of more than four persons for members of said board, the first four names only shall be counted, and the seven persons of the whole number voted for and counted as aforesaid having the highest number of votes shall be de
