Mr. Martin introduced a bill entitled

S. 128.

An act to legalize the marriage of Simon F. Gibbs and Carrie E. Cross and make their children legitimate;

Which was read the first and second times and referred to the Committee on the Judiciary.

A joint resolution from the House as follows:

Resolved by the Senate and House of Representatives, That a Joint Special Committee consisting of three Senators and five Representatives be appointed by the presiding officers of the two Houses respectively, to consider what legislation may be necessary for the proper publication of the Military History of Vermont, now in preparation by the State Military Historian, and report by bill or otherwise; Was read and adopted in concurrence.

The President appointed as the Committee on the part of the Senate under the foregoing resolution,

Senator Ide, for the Committee on the Judiciary, reported a bill entitled

S. 129. An act in relation to the rights of married women; Which was read the first and second times and under the rule ordered to lie and be printed.

Mr. Jones, from the Committee on Printing, to which was referred a joint resolution from the House relating to printing the address of E. J. Phelps on the life and character of Hon. Samuel Prentiss, submitted a report as follows:

SENATE CHAMBER, Nov. 6, 1882.

To the Honorable Senate now in Session:

The Committee on finance, to which was referred joint resolution relating to printing the address of E. J. Phelps on the life and character of Samuel Prentiss, respectfully report, that they have considered the same, and find that the practice of directing small appropriations of the kind here in question has prevailed so long as to become a recognized custom, and that expenditures so authorized are regarded as correct. The resolution in question having reached its present stage in accordance with the practice so established, we recommend its adoption in concurrence. At the same time we suggest that in future the practice should not be preserved, but that all such expenditures should be provided for by bill.

Thereupon Mr. Howard moved that the Senate propose to the House to amend the resolution as follows:

By inserting after the word "last," in the eighth line, the words following:

And the same number of copies of the address delivered by Hon. G. G. Benedict before the Vermont Officers' Reunion Society, on Thursday evening, Nov. 2, 1882;

Which was agreed to.

Thereupon the resolution was adopted in concurrence with proposals of amendment.

Mr. Whitcomb, from the General Committee, to which was referred House bills of the following titles:

H. 62. An act to incorporate the Brandon West Side Sewer Association;

H. 167. An act to amend an act entitled act to incorporate the Guildhall Aqueduct Company, approved Nov. 23, 1874;

Reported in favor of their passage;

Thereupon the bills were severally read the third time and passed in concurrence.

Mr. Dartt presented a petition of Luther O. Green, and thirty-eight others, praying for the adoption of the Constitutional Amendment prohibiting the manufacture and sale of intoxicating liquors;

And the same was referred to the Committee on Constitutional Amendments.

The hour having arrived for a meeting of the two Houses in Joint Assembly, the Senate repaired to the hall of the House.

Having returned therefrom, on motion of Mr. Ide, the Senate adjourned.

A message was received from His Excellency the Governor, by Mr. Wales, Secretary of Civil and Military Affairs, as follows:

I am directed by the Governor to inform the Senate that he has this day approved and signed a bill originating in the Senate of the following title, viz.:

S. 75. An act to provide for the drill and instruction of the officers of the militia.

A bill entitled

S. 30. An act to amend chapter thirty-six, of the Revised Laws, relating to the town system of schools;

Was taken up, and pending the discussion of the same, on motion of Mr. Ide, the Senate adjourned.

AFTERNOON.

A message was received from the House of Representatives by Mr. Merrill, their Assistant Clerk, as follows:

I am directed to inform the Senate that the House have considered Senate proposals of amendment to joint resolution, relating to printing the address of E. J. Phelps on the life and character of Hon. Samuel Prentiss ;

And have concurred therein.

And have refused the same a third reading.

S. 118. An act to incorporate the Burlington Trust Company; And have passed the same in concurrence.

A House bill entitled

H. 34. An act to pay George A. Hines for services rendered the sum therein named ;

Was taken up as a special order;

Thereupon, on motion of Mr. Estey, the bill was ordered to lie.

Mr. Walker, from the Committee on the Judiciary, to which was referred a bill entitled

S. 112. An act to incorporate Trenor W. Park Home for Destitute Children and Women;

Reported, recommending that the bill be amended by striking out the following words at the end of section eight, to wit. : "And for such not exceeding the amount of cash in its treasury at the time of its creation";

Which was agreed to, and the bill was read the third time and passed.

Mr. Burnap, from the Committee on the Judiciary, to which was referred a bill entitled

S. 13. An act to amend section one thousand five, chapter sixty, of the Revised Laws, entitled "Witnesses' depositions in civil cases Reported, recommending that the bill be amended by striking out all after the first three lines of section one, and inserting in lieu thereof the following words:

In any trial or inquiry in any suit, action or proceeding in any court, or before any person having by law or consent of parties, authority to examine witnesses or hear evidence, the husband or wife of any party thereto, or of any person in whose behalf such suit or proceeding is prosecuted or defended, shall, except as hereinafter provided, be competent to give evidence the same as any other witness, in behalf of any party to such suit, action or proceeding.

Nothing herein contained shall render any husband or wife competent to give evidence for or against each other in any criminal action or proceeding (except to prove fact of marriage in case of bigamy or adultery,) or in any proceeding for divorce on account of adultery (except to prove the fact of marriage) or in any action for or on account of criminal conversation.

No husband or wife shall be permitted to disclose any confidential communication made by one to the other during marriage.

Pending the question, Will the Senate agree to the same? on motion of Mr. Burnap, the bill was ordered to lie and be printed with proposals of amendment.

Mr. Walker, from the Committee on the Grand List, to which was referred a House bill entitled

H. 213. An act to amend section three hundred eighty-five of chapter twenty-six of the Revised Laws;

Reported adversely to its passage;

Thereupon on motion of Mr. Boyden, the bill was ordered to lie and be made a special order for Friday next at ten o'clock and thirty minutes in the forenoon.
