SEC. 5. The President and Directors shall have power to transact all business of the company, to wit: That of mining and smelting and every thing connected therewith by themselves or their agents, and shall, with a majority of the stockholders, have power to make such by-laws, rules and regulations for the government of said company as they may deem proper, Provided, such by-laws, rules and regulations are not inconsistent with the constitution and laws of the United States or the laws of this 'Territory.

SEC. 6. The shares of said company shall be personal property and liable to tax. and shall be transferable in such manner as shall be prescribed by the by-laws of said company, and shall be liable to taxation to the same extent, and no greater, as other property is, and to be taken in execution in the same manner as other personal property is, or may hereafter be liable by law to be taken ; and it shall be competent for the Legislature at any time to prescribe the manner in which execution shall be levied thereon.

AN ACT to provide for laying out and establishing a Territorial Road from the south line of the Territory in the town of Beloit, in the county of Rock, to Madison, in the county of Dane.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That Lucius G. Fisher, Thomas A. Holmes, and David Humes, be, and they are

AN ACT to change the corporate name of the Wisconsin University of Green
Bay, and for other purposes.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That the corporate name of the Wisconsin University of Green Bay, be and is hereby changed to Hobart University of Green Bay, and by that name and Hobart Universistyle shall be known in law.

SEC. 2. That none of the Trustees named in the act of incorporation of said University, shall have the power of delegating any Trustees not to authority to any other of the said board of Trustees to vote by proxy for the purpose of transacting business before said board, and the acts and doings of said board of Trustees not in conformity with the provisions of this act shall be null and void.

SEC. 3. That so much of the act to which this is amendatory as contravenes the provisions of this act, is hereby repealed.

Location of Road from Madison to Janesville.

NO. 19.

AN ACT to locate and establish several Territorial Roads therein named.

SECTION 1. Be it enacted by the Council and House of Representatives [of the Territory of Wisconsin,] That Henry F. Janes, John Catlin and Volney Atwood, shall constitute a board of commissioners to locate and establish a territorial road commencing at Madison, in Dane county, thence on the nearest and most eligible route to Janesville, and again commencing at or near the seventy five mile post on the Military road leading from Prairie du Chien to Green Bay, thence on the nearest and most eligible route to Janesville, until it intersects the aforementioned road, providing that said commissioners shall have power to adopt a portion of any territorial road which they may find to have been previously located on said routes.

SEC. 2. Ebenezer Peck, Berry Haney and John Medcalf, shall constitute a like board to locate a territorial road commencing at From Madison to Madison, in Dane county, thence on the most eligible route to Arena, and thence to Helena.

SEC. 3. Said boards or a majority of each shall meet at Madison, at such time as they may agree upon, and proceed to the discharge of the duties assigned them agreeably to the provisions of an act, entitled an act to provide for laying out and opening territorial roads approved January 3, 1838.

AN ACT to provide for the compensation of the officers of the Legislative
Assembly, and for other purposes.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That there shall be paid out of the sum appropriated by Congress to defray the expenses for the Legislative Assembly for the year one thousand eight hundred and thirty-eight.
