Her books have ever been opened to the Legislature, and she has within a short time submitted to two examinations by committee. Her integrity is unimpeachable. It is proposed now to carry out a recommendation of the Executive, involving in the outset, broad and palpable infractions of the charter of the Bank, and a no less plain and palpable infraction of the principles of common justice. The Bank of Mineral Point is a creditor of the Territory in a sum of nearly twenty thousand dollars, on which she is receiving mo interest, and there is no fixed period on which she may rely, for re-imbursement. I would appeal to the just, sober, second thought of your body, whether strict justice is subserved by adopting at this moment extraordinary and unprecedented measures, having a direct tendency to impugn the character of the institution.

Mr. Whiton moved that the communication just read be laid on the table, which was decided in the affirmative.

The undermentioned bill and resolution from the Council, were read the first and second time, viz:

No. 9. "A bill to amend an act entitled 'an act in relation to collectors, assessors, and supervisors of roads ;'" and

"Resolution requiring committees on public expenditures in .he two Houses to act jointly."

On motion, the said bill and resolution were considered in com

mittee of the whole, Mr. Childs in the chair, and were reported to the House without amendment,

Which were severally ordered to a third reading.

On motion of Mr. Sholes,

The standing rule prohibiting bills from being read the second and third time on the same day, was suspended, and the said bill and resolution were severally read the third time, passed, and the titles thereof agreed to.

Ordered, That the clerk acquaint the Council therewith.
On motion of Mr. Sholes,

The House adjourned.

Wednesday, August 12, 1840.

Mr. Ray presented the accounts of Harrison Reed and D. H. Richards, for publishing resolutions relating to the southern boun dary.

Referred to the committee on claims.

Mr. Shackelford, from the committee on claims, reported that the accourts of H. Reed and D. H. Richards had been allowed, and moved that they be referred to the committee on expenses. So referred.

Mr. Street moved that resolution No. 1, entitled "Resolution relating to adjournment," be now taken up and considered;

Which was agreed to.

The Secretary of the Council was introduced, and delivered the following message :

"Mr. Speaker-The Council have passed resolutions and a bill as follows, in which I am directed to ask the concurrence of this House, viz:

"No. 2. Resolution to amend a resolution concerning the set. tlement of the accounts of the late acting commissioner.

"No. 5. Resolutions calling on the Secretary of the Treasury of the United States, for information relative to appropriations made by Congress for the use of the Legislative Assembly, and No. 10. A bill concerning the Supreme Court."

Resolution No. 1, was then taken up, when Mr. Billings moved a call of the House, and that absent members be sent for ;

Which was agreed to.

The roll was then called, and the Sergeant-at-Arms sent after Messrs. Beardsley, Brunson, Childs, Jenkins and Shew.

Mr. Wells, by leave, offered the following joint resolution, entitled

"Joint resolution relating to the duties of Reporter of the Supreme Court ;"

Which was read the first and second time.

Mr. Whiton, from the judiciary committee, by leave reported bill No. 12, entitled "A bill relating to the general elections for the year 1840;"

Which was read the first and second time.

The Sergeant-at-Arms reported the attendance of the members sent for, when,

On motion of Mr. Sholes,

Ordered, That resolution No. 1, relating to adjournment, and bill No. 12, entitled "A bill relating to the general elections for the year 1840," be committed to the committee of the whole House now.

The House then went into committee of the whole on said res alution and bill, Mr. Shew in the chair.

After a short time, the committee rose, and reported the bill to the House without amendment, and asked leave to sit again on the said resolution ;

Which was granted.

On motion of Mr. Sholes,

Ordered, That the rules of this House requiring bills to be

engrossed, and prohibiting them from being read the second and third time on the same day be suspended with reference to bill No. 12, and that said bill be now read the third time, and passed. The said bill No. 12, was then read the third time, passed, and the title thereof agreed to.

Ordered, That the Clerk request the concurrence of the Coun. cil therein.

On motion of Mr. Street,

Ordered, That resolution No. 1, relating to adjournment, be now considered in the committee of the whole.

The House then went into committee of the whole on said res." olution, Mr. Shew in the chair, and after some time spent therein rose and reported the resolution with an amendment."

The following message was received from the Council by the Secretary thereof:

Mr. Speaker The Council have concurred in bills and a reso lution of this House as follows:

"No. 5. A bill to attach the county of Portage to the county of Dane.

No. 9. A bill to divide the town of Elk Horn, and to organise the town of Whitewater.

"No. 11. A bill to organize the county of Washington, and for other purposes; and

No. 2. Resolution in addition to resolutions relating to the southern boundary, and the admission of Wisconsin into the Union as a State," approved Jan. 13, 1840.

"In bill No. 9, and resolution No. 2, without amendment, and in bills No. 5 and 11, with amendments to each, in which I am directed to ask the concurrence of this House.

"The Council have negatived bill No. 4, of this House, entitled A bill relative to the Bank of Mineral Point,' by striking therefrom the enacting clause, and have appointed Messrs. Brigham and Arndt, on the committee of conference, to confer with the com. mittee appointed by this House on the disagreeing votes of the

two Houses, to bill No. 8, (H. R.) entitled 'A bill relating to the duties of Register of Deeds of the county of Dane.""

On motion of Mr. Billings,

The House adjourned until 2 o'clock, P. M..

On motion of Mr. Longstreet,

A call of the House was made, and the Sergeant-at-Arms sent after the members that were absent.

Mr. Sholes, from the joint committee on enrolment, reported the following to be correctly enrolled, viz:

An act to amend an act entitled an act in relation to collectors, assessors and supervisors of roads.

An act to amend an act entitled an act to provide for the sup. port of common schools and for other purposes.

An act to divide the town of Elk Horn and to organize the town of White-Water; and

Resolution in addition to resolutions relating to the Southern Boundary and the admission of Wisconsin into the Union as a State, approved Jan. 13, 1840.

The Speaker signed the said several bills and resolution, and ordered them to be presented to the President of the Council for his signature.

Mr. Jenkins, by leave, offered the following resolution, which was adopted...!

Resolved, That the committee on corporations be instructed to enquire into the expediency of bringing in a bill to provide for placing the Bank of Mineral Point in a safety fund system, and to report by bill or otherwise.

The Sergeant-at-Arms having reported the attendance of all the members,
