mr. Downing from the select committee to whom the same had been referred reported as amended a bill entitled, "an act providing for the more effectual defence of the Territory of Florida," which report was concurred in by the House; and said bill was read the second time, and ordered for a third reading on to-morrow.

A bill entitled, "an act to amend the Charter of the Union Bank of Florida," was read the third time and passed. ordered that the title be as above stated.

The resolutions offered by mr. Duval on the first day of February, were again read; the yeas and nays being required on their adoption by messrs. Downing and Macou; were Yeas messrs. Berthelot, Blount, Brown of Jackson, Dennis, Duval, Holloman, Johnson. Kenan, Ramsey and Tabor-10. Nays mr. President, messrs. Brown of Columbia, Burritt, Downing, Higginbotham, Hunter, Macon, M'Neil, Morton, Smith, Walker and Wood-12. So said resolutions are lost.

The House resolved itself into committee of the whole on a bill entitled, "an act to organize an additional regiment of militia in the counties of Madison and Hamil. ton," after some time spent therein the committee rose, and mr. Blount therefrom reported said bill to the House without amendments; which report was concurred in by the House, and said bill was read a second time, and ordered for a third reading on to-morrow.

The House in committee of the whole took under consideration a bill entitled, "an act to incorporate the St. Augustine and Picolata Rail-Road company," after some time spent therein the committee rose, and mr. Morton therefrom reported said bill to the House with amendments -which report was concurred in, and said bill was read a second time and ordered for a third reading on to-mor

row.

The accompanying report of the Auditor

made in pursuance of a resolution of your body at the last Session of the Legislative Council, is presented for your

information and action. Owing to the loose and irregular manner, in which the sales and transfer of the property of the Tallahassee fund have been heretofore kept, the examination by the auditor has been attended with great embarrassment. He has at last succeeded in arriving at results, which the council has repeatedly heretofore, and with no success attempted. I respectfully submit to the consideration of the council, if some adequate and liberal compensation should not be authorized by the council, to remunerate him, for the labours he has bestowed, labours which have brought out of great confusion, a valuable fund to the Territory, and which, until now, has been considered scarcely worthy to be looked after.

You will perceive that the balance declared to be outstanding, amounts to nearly $1200, which has been due and owing, since April 1830-31. The lots which created this fund were sold in 1829, upon three annnal instalments, the first of which was due and payable in April 1829. To secure the payments, deeds of trust were executed; and at the maturity of the first payment, many of the lots were sold, at a price less than was owed upon them. These lots, no matter in whose hands they may be, are liable for the balance of the instalments due and owing. The deeds were on record; and have given notice to every purchaser of the lien and incumbrance which attached to the sale and purchasǝ. The lots are valuable and more than capable to redeem all the liabilities, which, in consequence of those executed trusts rest against them. only necessary for the council to take some order upon those outstanding claims; and to authorize a resale of the lots where a salutary arrangement is refused by the

holder.

A bill entitled, "an act to authorize the guardian of the minor heirs of Thoms Wright deceased, to sell their real estate within this Territory," was read the third time and passed. ordered that the title be as above stated.

A bill entitled, "an act to alter and change the terms of the superior courts for the Middle District of Florida," was on motion of mr. Berthelot, postponed and placed among the orders for Monday next.

A bill entitled, "an act to authorize the executors of Thomas W. Seabrook, to sell his estate both real and personal," was again read and ordered for a third reading

on to-morrow.

A bill entitled, "an act to authorize Sion Smith to dispose of certain real estate," was read the third time; the

yeas and nays being required on its passage, by messrs. Tabor and Dennis, were Yeas mr. President, messrs. Berthelot, Blount, Brown of Columbia, Brown of Jackson, Burritt, Kenan, M'Neil, Morton, Ramsay, Smith, Tabor, Walker and Wood-14. Nays messrs. Dennis, Downing, Duval, Higginbotham, Holloman, Hunter, Johnson, Macon and M'Cants-9. So said bill is pass

ed: ordered that the tltle be as above stated.

The unfavourable report made on yesterday by the Judiciary committee on the petition of John Ray, was again taken up for consideration, and the House refused to concur in said report.

The resolutions offered on yesterday by mr. Dennis, were again read: the yeas and nays being required on the question of their adoption by messrs. Dennis and Berthelot, were Yeas messrs. Berthelot, Blount, Dennis, Holloman, Kenan, Macon, M'Cants and M'Neil-8. Nays mr. President, messrs. Brown of Columbia, Brown of Jackson, Burritt, Downing, Duval, Higginbotham, Hunter, Johnson, Morton, Ramsey, Smith, Tabor, Walker and Wood-15. So said resolutions are lost.

'The bill entitled, an act to incorporate the Pensacola Steam Saw-mill company," was taken up, mr. Blount moved a reconsideration of the vote by which said bill had been passed: which prevailed.

Also that the House do consent to all the amendments proposed in the message of the Governor, which accompaniod said bill when returned: and that the clerk be instructed to insert said amendments; which motion unanimously prevailed: and said amendments were made: when the bill was read the third time and passed: ordered that the title be as above stated.

A bill entitled, "an act for the relief of James Stewart," was read the third time and passed: ordered that the title be as above stated.

The House again went into committee of the whole on the bill entitled, "an act to amend an act to incorporate the Central Bank of Florida,” after some time spent therein the committee rose, and mr. Downing therefrom reported said bill to the House with amendments, which report was concurred in and said bill was read a second time, and ordered to be engrossed for a third reading on to-morrow.

The House then adjourned until to-morrow morning at 12 o'clock.

Saturday, February 6.

The House met pursuant to adjournment, a quorum being present the journal of yesterday's proceedings was

read.

Mr. President laid before the House the following message, from the Governor,

Tallahassee, Feb. 6, 1836.

The rules and articles of War being the code of laws by which everv officer and soldier is bound when in the service of the United States, I submit to the council if they should not authorize the printing of one, two or three hundred copies, that all may be made acquainted with the duties which are required of them; and with the penalties which attach to a departure from or a neglect of those duties. There is but a single copy in the possession of the Executive.

Which was read; whereupon on motion of mr. Wood, it is ordered that three hundred copies of the rules and articles of war be printed.

mr. Burritt pursuant to previous notice asked and obtained leave to introduce a bill entitled, "an act to amend an act entitled an act to establish a tariff of fees, passed February 14th 1834," which was read by the title and ordered for a second reading on Monday next; and twenty five copies are ordered to be printed.

Also a bill entitled, "an act concerning depositions," passed November 17th 1828, which was read by the title, and ordered for second reading on Monday next.

Also a bill entitled, 66 an act to amend an act regulating the mode of suing out writs of error and prosecuting appeals in the Territory of Florida, passed February 8th 1832," which was read and ordered for a second reading on Monday next.

Also a bill entitled, "an act to amend an act to regulate proceedings in chancery, approved Nov. 7th 1928," which was read, and ordered for a second reading on Monday, and twenty five copies are ordered to be printed,

mr. Walker asked and obtained leave without previous notice (the rule being waived for that purpose) to introduce a bill entitled, "an act respecting certain records in the clerks office of Columbia county," which was read, and ordered for a second reading on Mondy next.

mr. Brown of Jackson, pursuant to previous notice, asked and obtained leave to introduce a bill entitled, "an act to repeal the 27th Section of an act entitled an act concerning wills, letters testamentary, and letters of administration and the duties of executors, administrators and guardians," which was read and referred to the Judiciary committee.

Also he gave notice that he will ask leave to introduce a bill entitled, an act supplementary to the several acts relating to the Bank of West Florida:"

mr. Dowing pursuant to previous notice asked and obtained leave to introduce a bill to be entitled, "an act to alter the charter of the Life Insurance and trust company," which was read and referred to the committee on Banks.

Also a bill entitled, "an act concerning mortgages," which was read & referred to the Judiciary committee, and 25 copies are ordered to be printed.

Also a bill entitled, "an act for the relief of Eliza M. Shaw," which was read and referred to the Judiciary committee.

mr. Tabor gave notice that he will on Monday next, intro

duce a bill to be entitled, "an act amendatory and explanatory of the militia laws now in force in this Territory."

mr. Berthelot pursuant to notice before given asked and ob tained leave to introduce a bill entitled, "an act for the relief of the Central Bank," which was read and referred to the committee on claims.

mr. Wood pursuant to notice heretofore given asked and obtained leave to introduce a bill entitled, "an act to amend the act entitled an act to incorporate the town of Appalachicola," which was read and ordered for a second reading on Monday

next.

mr. Holloman from the majority moved a reconsideration of a bill to incorporate the "Atlantic and Gulf of Mexico Rail Road company," the yeas and nays being required on said motion by messrs. Downing and Burritt, were Yeas messrs. Berthelot, Brown of Jackson, Dennis, Duval, Higginbotham, Holloman, Johnson, Kenan, Macon, M'Cants, Morton Ramsey and Wood-13. Nays mr. President, messrs. Blount, Bur ritt, Downing, Hunter, Smith, Tabor ard Walker-8. So said bill is ordered to be reconsidered, and is placed among the orders for Tuesday next.

mr. Wood gave notice that he will on Monday next introduce a bill entitled, "an act to incorporate the St. Joseph insurance company.

Also a bill entitled, "an act incorporating the St. Joseph Bank of Florida."

mr. Duval pursuant to previous notice asked and obtained leave to introduce a bill entitled, "an act respecting the escheated estate of William Pritchard deceased," which was read and ordered for a second reading on Monday.

mr. Kenan asked and obtained leave (without previous notice, the rule being for that purpose waived) to introduce a bill entitled, "an act for the relief of Albert G. Tomlinson," which was read and referred to a select committee; messrs. Kenan, Morton and Ramsey were appointed thereon.

mr. Wood gave notice that he will on Monday next intro. duce a bill entitled, " an act for the relief of Edward Chand ler."

mr. Smith asked and obtained leave (without previous notice the rule being for that purpose waived) to introduce a bill en. titled, " an act to incorporate a corps of military exempts, for the defence of the city of St. Augustine, during the present Indian war," which was read and referred to the militia com1 mittee.

mr. Morton presented the memorial of R. B. Ker, in reference to a canal across the Peninsula, which was read and referred to the committee on the State of the Territory.

mr. Johnson offered the following resolutions: Whereas, under the militia law of this Territory, passed and approved on the 15th January 1836, the citizens of this Terri tory are permitted to commute and exempt themselves from the obligation of defending the homes, the firesides, and the lives of the good people of Florida, against the savage foe, by the payment of a sum of money: and whereas it is reported, that sundry persons have availed themselves of this permission and have paid considerable sums therefor, to the officers enti
