Tabor were again read and adopted His Excellenty the Governor transmitted to the House the following message: EXECUTIVE OFFICE, To the Legislative Council : } The accompanying report of the Auditor made in pursuance of a resolution of your body at the last Session of the Legislative Council, is presented for your information and action. Owing to the loose and irregular manner, in which the sales and transfer of the property of the Tallahassee fund have been heretofore kept, the examination by the auditor has been attended with great embarrassment. He has at last succeeded in arriving at results, which the council has repeatedly heretofore, and with no success attempted. I respectfully submit to the consideration of the council, if some adequate and liberal compensation should not be authorized by the council, to remunerate him, for the labours he has bestowed, labours which have brought out of great confusion, a valuable fund to the Territory, and which, until now, has been considered scarcely worthy to be looked after. You will perceive that the balance declared to be outstanding, amounts to nearly $1200, which has been due and owing, since April 1830-31. The lots which created this fund were sold in 1829, upon three annnal instalments, the first of which was due and payable in April 1829. To secure the payments, deeds of trust were executed; and at the maturity of the first payment, many of the lots were sold, at a price less than was owed upon them. These lots, no matter in whose hands they may be, are liable for the balance of the instalments due and owing. The deeds were on record; and have given notice to every purchaser of the lien and incumbrance which attached to the sale and purchasǝ. The lots are valuable and more than capable to redeem all the liabilities, which, in consequence of those executed trusts rest against them. only necessary for the council to take some order upon those outstanding claims; and to authorize a resale of the lots where a salutary arrangement is refused by the holder. Seabrook, to sell his estate both real and personal," was again read and ordered for a third reading on to-morrow. A bill entitled, "an act to authorize Sion Smith to dispose of certain real estate," was read the third time; the yeas and nays being required on its passage, by messrs. The unfavourable report made on yesterday by the Judiciary committee on the petition of John Ray, was again taken up for consideration, and the House refused to concur in said report. Also that the House do consent to all the amendments proposed in the message of the Governor, which accompaniod said bill when returned: and that the clerk be instructed to insert said amendments; which motion unanimously prevailed: and said amendments were made: when the bill was read the third time and passed: ordered that the title be as above stated. The House again went into committee of the whole on the bill entitled, "an act to amend an act to incorporate the Central Bank of Florida,” after some time spent therein the committee rose, and mr. Downing therefrom reported said bill to the House with amendments, which report was concurred in and said bill was read a second time, and ordered to be engrossed for a third reading on to-morrow.
